Rumsfeld about releasing Taliban armed forces from Guantanamo since the war in Afghanistan is over. This is a letter from the Acting CIA Assistant Inspector General for Investigations to a doctor for potentially retaining them as a medical expert in the upcoming trial of David Anthony Passaro. Mr. Passaro was a CIA contractor charged with four (4) counts of assault in connection with the beating death of an Afgahni detainee, Abdul Wali, on a military base at Asadabad, Kunar Province, Afghanistan, June 21, 2003. The letter states that the Department of Justice was pursuing the prosecution and the CIA OIG was cooperating with the matter. The medical expert was being forwarded documents and materials to review. The letter also states that there will be a follow up meeting to discuss the matter further and to discuss the fee for the retaining the expert.

Prosper states that "The United States and its Coalition partners are at war with the al Qaida network and remnants of the Taliban who continue to support them. The al Qaida network today is a multinational enterprise with operations in more than 60 countries; there are active hostilities are ongoing daily in Afghanistan and around the world; and We continue to fight against enemy combatants who are planning and conducting attacks against us. He then states that: detainees, regardless of their lack of status as POWs under the Third Geneva Convention of 1949, will be treated consistent with American values and the principles of the international law of armed conflict; United States Government personnel are not permitted to torture detainees or participate in torture by others; and the authority to detain enemy combatants for the duration of hostilities exists in law independent of the civil judicial or criminal justice system. Finally, Amb. Prosper states "The United States is strongly committed to protecting and advancing human rights."

Opinion Editorial on Guantanamo Detainees from Ambassador Pierre-Richard Prosper, Ambassador-at-Large for War Crimes Issues. The Op-Ed states that terrorists need not be granted POW status under Article 4 of the Geneva Convention but should be treated consistently with the Convention nonetheless. The law of war grants broad authority for detentions of enemy combattants to prevent them from rejoining hostilities. Detentions have already lead to valuable information which has thwarted attacks in Europe and elsewhere. Detainees are treated humanely: three meals a day that are culturally sensitive, medical treatment, freedom to worship, opportunity to raise concerns about conditions. ICRC monitors treatment. U.S. is currently holding 600 detainees from 40 countries. They will eventually be returned to their own countries for prosecution or detention or released. Detainees who have refused to disclose information continue to pose a threat and will not be released to committ acts of terror.

This letter is from William H. Taft, IV of the State Department to Jakob Kellnberger, President of the International Committee for the Red Cross (ICRC) concerning an Opinion Editorial a member of the ICRC's legal staff wrote for the Financial Times (of London). The Op-Ed was critical of the U.S. policies in prosecuting individuals involved in international terrorism, the U.S. detention of those individuals and the assertion that the detainees have a right to challenge their detention under international law. Mr. Taft states that there is "no such entitlement in the 1949 Geneva Conventions. However, the implication in the article is that the Geneva Conventions do provide such entitlement" and this assertion has the "effect of misleading the public" as to the rights of the detainees. He insists that “There are several other erroneous and inappropriate statements in the article” and that “Your legal staff certainly knows...[that] military courts may exercise jurisdiction over civilians who are unprivileged belligerents or security detainees as well as military personnel; this is consistent with the express terms of both the Third and Fourth Geneva Conventions.” The letter concludes with “we value the serious dialogue we have always had with you and your representatives on the implementation of the Geneva Conventions and the detentions in Guantanamo generally.”

This letter is a response from the Canadian Minister of Foreign Affairs, Bill Graham to Dennis Edney of Edley, Hattersley & Dolphin concerning a Guantanamo detainee Omar Ahmed Khadr, who is a Canadian citizen. Mr. Graham acknowledges Mr. Edney's December 11, 2003 and January 20, 2004 letters and the amicus curiae briefs Mr. Edney has filed on behalf of Mr. Khadr. Mr. Graham explains why the Canadian government has not likewise filed briefs in the matter and states "the Government continues to make representations to the relevant U.S. authorities on behalf of Mr. Khadr, including with regard to his health, consular visits, the conditions of his detention, and the requirements of due legal process. In particular, we have formally registered our opposition to the death penalty as an acceptable punishment or as a sentence for any Canadian detainee held at Guantanamo Bay."

United Nations Special Rapporteur report on allegations of potential detainee abuse at Kandahar, Afghanistan. This is an annex of a report which purports to describe how suspected Taliban detainees were bound and hooded while in U.S. custody in March 2002 in Kandahar, Afghanistan. It is alleged that soldiers punched, kicked and forced to use buckets as toilets while in custody. It is also alleged that the detainees had their heads and beards shaved. There is also a second series of abuse allegations from the Uruzgan Provence of Afghanistan. The reports states “According to the information received, at the scene of the raid they had their hands and feet tied, were blindfolded and hooded, and flown to the US base at Kandahar. It is reported that upon arrival at the base the prisoners were beaten, kicked and punched by soldiers, made to lie on their stomachs with their hands tied behind their backs and-their legs chained. Where upon soldiers walked across their backs.”

FBI Letter from T. J. Harrington to the Dept. of Defense concerning suspected mistreatment of detainees. The letter notifies DOD of three separate incidents of "highly aggressive interrogation techniques being used against detainees in Guantanamo." The email states "FBI SA entered the observation room (at Guantanamo) and complained that curtain movement at the observation [the] window was distracting the detainee, although no movement of the curtain had occurred. She directed a marine to duct tape a curtain over the two-way mirror between the interrogation room and the observation room. SA characterized this action as an attempt to prohibit those in the observation room from witness in her interaction with the detainee." and "The FBI SA observed [a female military person] apparently whispering in the detainee's ear, and caressing and applying lotion to his arms (this was during Ramadan when physical contact with a woman would have been particularly offensive to a Moslem male). On more than one occasion the detainee appeared to be grimacing in pain, and [the female military person’s] hands appeared to be making some contact with the detainee. Although SA could not see her hands at all times, he saw them moving towards the detainee's lap.”

Mr. Kellenberger asks that this be carried out under conditions that respect the confidential nature of those documents in order to preserve and protect the integrity of the ICRC's work in this field. Mr. Kellenberger states “l appreciate your sensitivity to the relation between the manner In which such ICRC documents are distributed and used and the ICRC's ability to maintain the cooperation of parties to armed conflict that Is necessary to the fulfillment of Its humanitarian mandate.”

This letter is from William H. Taft, IV, State Department Legal Adviser, to Christophe Girod, the Head of Delegation of the International Committee for the Red Cross (ICRC) concerning the U.S. transfer of Russian nationals from Guantanamo to Russia. Mr. Girod expressed the ICRC's concern for the safety of the Russians to be repatriated to Russia. Mr. Taft’s letter stated that the U.S. received assurances from the Russian government that the repatriated detainees would not be persecuted or tortured upon their return. He notes that Russia is a signatory to the European Convention on Human Rights, the United Nations Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment, and the International Covenant on Civil and Political Rights, and also permits the ICRC to visit and inspect Russian prison facilities. He concludes with stating that “These decisions are made at senior levels through a process involving officials most familiar with international legal standards and obligations and the conditions in the countries concerned.” And giving his own assurances that the U.S. has reviewed the transfer and finds it appropriate and consistent with the international agreements the U.S. is party to.

This letter is a response from the Canadian Minister of Foreign Affairs, Bill Graham to Nathan J. Whitling of Parke McLaws Barristers & Solicitors, concerning a Guantanamo detainee Omar Ahmed Khadr, who is a Canadian citizen. Mr. Graham acknowledges Mr. Edney's December 11, 2003 and January 20, 2004 letters and the amicus curiae briefs Mr. Edney has filed on behalf of Mr. Khadr. Mr. Graham states " We have discussed with U.S officials the legal protections to be accorded to Mr. Khadr while he is incarcerated, as well as the legal protections that he is entitled to receive when, and if he goes to trial. In." Mr. Graham also states “Further, Mr. Khadr is not currently charged with any crime” and “In closing, let me say that the Canadian government will continue to monitor closely the situation at Guantanamo Bay. Our dialogue with U.S. officials about the legal protections to be accorded to Mr. Khadr will also continue.”

Letter from Theo van Boven, U.N. Special Rapporteur on Torture to Amb. Moley concerning the detention of Riduan "Hambali" Isamuddin. Mr. van Boven expresses his opinion that Mr. Isamuddin is in "secret" U.S. detention and is being held incommunicado. Mr. van Boven states that Mr. Isamuddin's rights are "set forth…in the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, the Declaration on the Protection of all persons from being subjected to Torture and Other Cruel, inhuman or Degrading Treatment or Punishment, and the Convention against Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment" and should be afforded "the safeguards concerning the liberty, security and the dignity of the person." Finally, Mr. van Boven asked that Mr. Isamuddin not be deported to any of the countries desiring him for criminal charges of terrorism if "the aforementioned person would not be subjected to torture or any other forms of Ill-treatment upon" delivery to that government.

The al Qaida network today is a multinational enterprise with operations in more than 60 countries; there are active hostilities are ongoing daily in Afghanistan and around the world; and We continue to fight against enemy combatants who are planning and conducting attacks against us. He then states that: detainees, regardless of their lack of status as POWs under the Third Geneva Convention of 1949, will be treated consistent with American values and the principles of the international law of armed conflict; United States Government personnel are not permitted to torture detainees or participate in torture by others; and the authority to detain enemy combatants for the duration of hostilities exists in law independent of the civil judicial or criminal justice system. Finally, Amb. Prosper states "The United States is strongly committed to protecting and advancing human rights.

This letter is a follow-up to previous letters sent to Canadian Foreign Affairs officials concerning Mr. Omar Ahmed Khadr, a Guantanamo Bay Detainee. The letter requests that the Canadian Department of Foreign. Affairs and International Trade seek the following assurances from the U.S.: i) Conversations between Omar and his defense counsel will not be monitored; ii) Omar will not be excluded from any portion of the proceedings; iii) Arrangements will be made to transfer Omar to Canada for the purpose of serving any sentence which may be imposed upon him; iv) Any military commissions will be open, the media present and appropriately cleared representatives of the accused's government may observe the proceedings; and v) Omar may be permitted to talk to appropriately cleared family members via telephone, and two appropriately cleared family members would be able to attend his trial
