L_.,--_ _Jn connection with detainee abuse at the Baghdad Central Confinement Fac1 lty, u
Ghraib, Iraq. Three of these defendants have already been arraigned and are pending trial dates ..
On 21 June 2004, the military judge for these cases ordered a discovery deadline ofJuly 31,
2004. Under the provisions of Rules for Courts-Martial (RCM) 701, the Government must
release all relevant documents from the investigations concerning detainee abuse at the
confinement facility at Abu Ghraib over to the defense on or prior to July 31, 2004.
The Government's prosecution team has become aware that your agency is currently
conducting an investigation that could have relevant information to these courts-martiaL ·
Moreover, the defense counsel in these cases have specifically asked for any "Central
Intelligence Agency Inspector General Investigations" (See Attachments 1, 2). As the
Government representative, I am requesting that your agency provide a copy of any relevant
investigations for inspection and possible dissemination to the defense counsel. The Government
believes that the release of the investigation, especially Witness statements obtained during the
course of the investigation, is an essential step in expeditiously resolving these cases. While the
Government understands, due to the late notice, that your agency cannot produce these
documents for inspection prior to the discovery deadline, I am requesting to inspect any
documents at the earliest possible date. It is the Government's goal that the extensive pretrial
discovery issues can be resolved infonnally without resort to the Court's subpoena power.
