On 24 Dec 2003 American forces raided a house in the Slaikh Alrabee neighborhood of Baghdad. The men inside were taken in to custody with blindfolds and cuffed behind their backs. The men allege that during their arrest they were abused by being kicked, punched and dragged. All the men were taken from the house to. Radwaniya Palace. After they arrived at the Palace they were thrown to the ground and their hands were untied and replaced with handcuffs, which were put on very tight. The detainees were processed, initially screened, and interrogated. The men claim they were threatened, and had dogs biting at their clothing on numerous occasions while at the palace. The detainees remained at the TSF for approximately two days before being transferred to the Baghdad Central Confinement Facility (BCCF), Abu Ghraib. Available medical records pertaining to the detainees were reviewed and there were no injuries noted on the medical records consistent with their allegations of abuse. The capturing unit personnel confirm there was approximately $72,900. USD and 32 million Iraqi Dinar confiscated from the home. There was no probable cause to believe the offenses of aggravated assault and cruelty and maltreatment occurred as alleged; therefore, they are unfounded. There was probable cause to believe that a sergeant on the raid did steal the money.

INVESTIGATIVE SUMMARY
On 27 May,2004, this office was notified by the Prisoner Interview/Interrogation Team (PIT) (CID), Abu Ghraib Prison, Baghdad, IA, that 11 detainees alleged they were abused while detained at the Ruthwania Palace, IZ.
Preli investigation revealed American forces raided the residence of the

wilily and alle edl took 80,000 U.S. Currency, 30 million Iraqi Dinar, gold, and jewelry. The ales further alleged they were all transported to the Ruthwania palace, where they were kicked, punched, threatened, and had dogs biting at their clothing on numerous occasions while at the palace.
Investigation by this office and review by Headquarters (HQ), USACIDC, determined there was sufficient credible information to believe the offenses of aggravated assault, and cruelty and maltreatment, did not occur as alleged.
Investigation determined theMIR males were captured on 24 Dec 03, by members of the 1st Battalion (BN), 3rd and 5th Special s (SFG). Meinbers of the capturing units were interviewed and related the males were captured without incident and taken to a Temporary Screening Facility (TSF) at Ruthwania palace, IZ, where the detainees were processed, initially screened, and interrogated. The detainees remained at the TSF for approximately two days before being transferred to the Baghdad Central Confinement Facility (BCCF), Abu Ghraib, IZ (AGI), by members of 5th SFG Dec 3. All personnel interviewed denied abusing or witnessing any abuse of the family at the time of their capture, or during their detainment at the TSF prior to being transferred to the BCCF.
Available medical records pertaining to the detainees were reviewed and there were no injuries noted on the medical records consistent with their allegations of abuse.

This investigation was coordinated with MAJ Staff Judge Advocate, 10th SFG, United States Army Special Operations Command, Forward Operating Base (FOB) Central, Baghdad, IZ, who opined there was no probable cause to believe the offenses of aggravated assault and cruelty and maltreatment occurred as alleged; therefore, they are unfounded. MAJ Orther opined there was insufficient evidence to prove or disprove the ällenflarceny of private funds and larceny of private property pertaining to SSG
Investigation established probable cause to believe SSG committed the offenses of larceny of private funds and property as interviews with the capturing unit personnel confirm there was approximately $72,900 U.S. Currency and 32 Million Iraqi Dinar alonwith other personal property which was confiscated from the home of the

family. SSG was identified as the person responsible for
ocuinenting the money and ensuring it was transferred with the detainees to the BCCF; however, interviews of the personnel responsible for receiving the property at the prison determined SSG only turned in a gold watch belonging to one of the family members; he never turn in the money.
On 20 Jan 06, this office received a request from the 10 th Military Police Battalion (CID), to conduct, further investigative activity.
Further, investigation disclosed there was no documen regarding tik apprehension or transfer of property belonging to the family. Interviews of capturing unit members revealed a large sum of currency was collected during the operation; however; there were no records or log book indicating it was turned in to BCCF. An interview of the property room custodian at the Ruthwania P • closed the currency collected during the operation was transferred to SSG for transport to BCCF. Extensive efforts were made to locate any records from the

ily and their property, but all attempts were unsuccessful. Interviews of BCCF, TIF, and Ruthwania Palace personnel disclosed due to poor record keeping at the onset of Operation Iraqi Freedom, many records from that time period were lost, inadvertently destroyed or never existed.
Investigation disclosed based on the e investigation, there was insufficient evidence to prove or disprove SSG committed the offense of Larceny of Private Funds and Property due to the lack of documentationand accountability of the property after the operation and capture of the family.. Further, there was no documentation or evidence to support the money of the family was ever turned in to the BCCF as no records existed to suppoffThe money was ever turned

On 27 May 2004, this office was notified by the Prisoner Interview/Intenogation Team (PIT) (CID), Abu Ghraib Prison, Baghdad, IZ, 11 detainees alleged they were abused while detained at the Ruthwania Palace, E.

investigation revealed American Forces raided the residence of the
mily and allegedlytook $80,000 U.S. Currency, 30 Million Iraqi Dinar, Gold, and jewelry. The males further alleged they were all transported to the Ruth_wania Palace, where they were kicked, punched, threatened, and had dogs biting at their clothing on numerous occasions while at the palace.

Investigation by this office and review by Headquarters (HQ), USACIDC, determined there was sufficient credible information to believe the offenses of Aggravated Assault, and Cruelty and Maltreatment, did not occur as alleged.

Investigation determined the males were captured on 24 Dec 03, by members of the 1st Battalion (BN), 3rd and 5th Special -V (SFG). Members of the capturing units were interviewed and related the _ males were ca.ptured without incident and taken to a Temporary Screening Facility (TSF) at Radanwiyah Palace, IZ, where the detainees were processed, initially screened, and interrogated. The detainees remained at the TSF for approximately two days before being transferred to the Baghdad Central Confmement Facility (13CCF), Abu Ghraib, IZ by members of 5th SFG on 27 D ersonnel interviewed denied abusing or witnessing any abuse of the family a the time of their capture, oriduring their detainment at the TSF prior to being transferred to the BCCF.

(U) On 27 May 2004, this office was notified by the Prisoner Interview/Interrogation Team (PIT) (CID), Abu Ghraib Prison, Baghdad, IZ, 11 detainees alleged they were abused while detained at the Ruthwania Palace, IZ.
Preliminary investigation revealed American Forces raided the residence of the
familyand ly took $80,000 U.S. Currency, 30 Million Iraqi Dinar, Gold, and jewelry. The ales further alleged they were all transported to the Ruthwania Palace; where they were'
ere kicked, punched, threatened, and had dogs biting at their clothing on numerous occasions while at the palace.

Investigation by this office and review by Headquarters (HQ), USACIDC, determined there was sufficient credible information to believe the offenses of Aggravated Assault, and Cruelty and Maltreatment, did not occur as alleged.

Investigation determined the ales were captured on 24 Dec 03, by members

of the 1 St Battalion (BN), 3rd and 5 Special Forces ouPs (SFG). Members of the capturing units were interviewed and related the males were captured without incident and taken to a Temporary Screening Facility (TSF) at Radanwiyah Palace, IZ, where the detainees were processed, initially screened, and interrogated. The detainees remained at the TSF for approximately two days before being transferred to the Baghdad Central Confinement Facility (BCCF), Abu Ghraib, IZ (AGI), by members of 5t h SFG on 27 Dec 03. All personnel
interviewed denied abusing or witnessing any abuse of the IIIIMfamily at the time of their capture, or during their detainment at the TSF prior to being transferred to the BCCF.

Available medical records pertaining to the detainees were reviewed and there were no
injuries noted on the medical records consistent with their allegations of abuse.

Interviews with the capturing unit personnel confirm there was approximatel 00 U.S. Currency and around 32 Million Iraqi Dinar ted from the home of the family and turned into the TSF were in-processed. Interviews with unit personnel identified SGT as the person responsible f r do ing the money and ensuring it was transferred with the detainees to the BCCF. SGT was interviewed:, he invoked his legalrights and did notprovide either a written or verbal statement. Documents recording the seizure of the money and other property from the

family residence were never located. Memb ainee property section at the Abu Ghrai Prison were interviewed and revealed SGT never turned in an roperty for the =Hy, except for a watch belonging to
(U) This investigation was coordinated with Staff Judge Advocate, 10th Special Forces Group, United States Army Special Operations Command, Forward Operating Base (FOB) Central, Baghdad, IZ, who opined there was no probable cause to believe the offenses of Aggravated ruelty and Maltreatment occurred as alleged; therefore, they are unfounded. MAJ further opined there was insufficient evidence to prove or disprove the alle s of Larceny of Private Funds and Larceny of Private Property pertaining to SGT

On 27 May 04, this investigation was initiated upon notification from the Prison Interrogation TeaM (CID), Abu Ghraib Prison, Abu Ohraib, Iraq that several detainees alleged they were abused while detained at the Radwaniya Palace, Baghdad International Airport, Baghdad, Iraq.
About 0900, 27 May 04 this office, received via e-mail the victim interviews conducted by SA this office.

NDRS vir NDRS All related they were at home w en merican orces raided the house, 0200, 24 Dec 03, in Slaikh Alrabee Neighborhood, Baghdad, IZ. American Forces broke the front door and threw distracting devices in the house. After entering the house all the occupants' hands were tied behind their backs. All the women in the house were tied to the stairs in the house and the men were taken to the kitchen and they were all hooded or blind folded. The d_ etainees alleged the house was ransacked and approximately $80,000.00 US dollars and $30,000,000.00 Iraqi dinner were stolen. In addition to the money all the gold in the house and women's jewelry were stolen and the Americans broke all the windows in the vehicles and the furniture in the residence Detainee related he was hit in the head witwooden object when they stormed the house and was cut an• a most knocked unconscious. Detainee tated he was hit in the head as well and knocked to the ground. When he was dragged into one of the HMMWV's he was kicked in the head. During the raid no one spoke to the Iraqi's and the house was inspected without anyone going with them. All the men were taken from the house to. Radwaniya. Palace. After they arrived at the Palace they were thrown to the round and their hands were untied and replaced with handcuffs, which were put on very tight. Detainee elated his father was with him; however, his father was in poor medical condition and was taken to an unknown hospital. He relate_ d he has not heard about his father nor does he know what his current condition is. While at the Palace they were forced to kneel on the ground (stones) with their faces on the ground for four days and nights. When it was dark they were taken inside the palace and placed in the same position on the concrete floor. All the detainees stated they were hooded the entire time and were unable to see. Further, they were not fed and were not allowed to sleep, during those four days. When some of the d ' ees asked what they had done, they were kicked and punched on the head and back. Detainee ted he was hit so hard he lost consciousness. During those four days at the palace the Americans released do s on them; however, the dogs only bit their clothing and never caused any physical injuries. Detainee lso related that at one point he was being interrogated and the interrogator lifted up his hood and insu to im by threatening to shave his head and beard and make him wear woman's clothing. The interrogator also stated he was going to have sexual relations with the Detainees mother. He described the interrogator as a white male with blond,hair and

Detainee related he did not know if the interrogator physically assa him because he was hooded, except for the time when he was insulted by the interrogator. Detainee related he lost feeling in his right hand because the handcuffs were to tight while he was at the Palace and he was kicked very hard in the right thigh. All the detainees related they were punched and kicked several times while at the palace. They related the abuse stopped after they left the Palace and they have all been treated very well since arriving at Abu Ghraib. They were asked as to why they had so much money in the residence, which they replied they are a wealthy family as they are in the transportation business with many busses and

Iraq in support of Operation Iraqi Freedorn. While we were in Iraq our taskings varied, during the mission on 24 Dec 03, I was working in the BN Operation$ Center. The mission was extremely successful, initially we were looking for one individual and We captured ten detainees. The detainee$ were transported to the kaclwiniyah.Place Complex (RPC) and placed in the Temporary Holding Facility: I perSonally, did not have contact with the detainees. My job was to supervise and provide guidance on the intelligence gained from the dotument exploitation and tactical questioning. inprocessing, no strip searches were Conducted. We did have one EOD dog smell the captured docurnents for any explosive
Materials. At no time did we ever utilize the dog to harrass or frighten the detainees. The detainees were provided food, water,
and the chance to utilize the latrine. All detainees were allocated and provided with at least 4 hours of sleep, IAW CJTF-7
guidelines. All 10 Detainees were a - d bo t the large amount of money taken off the Objective and their stories did not match up. The lead interrogator, SGT , briefed me on his findings on 25 December 2003. Based upon the overwhelming
circumstantial and monetary evideriCe (captured in the Tactical Interrogation Reports), I recommended that all 10 detainees be
transferred to the Abu Gurayb Prison and placed on a Military Intelligence Hold. From the best of . ' ection, all 10
detainees were there for about 24 firs before they were transported to the Abu Gurayb Prison. SGT transferred the
detainees to Abu Gurayb, signed all money and captured items over to the Abu Gurayb Prison Inprocessing enter, handed in all
the required CPA capture documents ancrswom statements and then returned to RPC. All the Interrogation ikcapture and
inproce are located on our SIPR LAN under the HUMINT/Detainee folders.

A: Sgt was the only person allowed direct contact with the detainees, but there was always an observer for security
purposes wi m. Personnel on the security detail would escort the detainees to about 15 feet from the holding room to the
interview room or to the bathroom:

A: By SOP the detainees were supposed to by examined, but I do not know if an examination was conducted.

A: I don't know the names, but they would have been people from 10th Mountain assigned to the BN or personnel from
Headquarters Support Company (HSC). The security detail was comprfsed of the guard force assigned to protect our compound.

During the detainees stay at the RPC they

were provided MREs and bottled water 3 times a day, to which the guards and the interrogators ensured the meals contained no

pork products or anything that would conflict with the detainees religious beliefs or medical conditions. The majority of the detainees stay was spent inside the holding facility, which provides each person more than ample room to lie down and sleep comfortably. There were times in which the detainees were taken outside in the courtyard area for fresh air and to be taken to the latrine. The detainees were placed on their knees inside the holding area (the room has a smooth concrete floor) for short periods of time during the day. In the evening the guards and the interrogators would ensure the detainees were laid doWn and covered with blankets to sleep. Normally during an interrogation the detainee was placed in a chair to set during the interrogation, at times some even had their handcuffs removed and recuffed in the front. AT NO TIME during any interrogation that I conducted or witnessed did any of these detaineeS making the allegations or any of the other detainees that were proCessed through the RPC get abused in any Way, shape, or fonn. The dOcuments and equipment that was captured on the objective cluting this raid in which these detainees were rolled up was brought back to the RPC and handed over to the interrogators for exploitation. The items were generally marked with the room number/house number and if possible which individual the item was associated with acCording to the site exploitation conducted by the capturing unit. All of the items brought in with the detainees were secured in the MID SOP at the RPC, to ensure no one tampered with the items and that the items were under constant • supervision. When the detainees were taken to Abu Gayrab their belongings were transferred with them. (I am not sure what happened to their items once they were transferred to Abu Gayrab, nor who on that end received the items). To the best of my knowledge these detainees stayed at the RPC for 2 days before being transferred to Abu Gayrab. ThiS group of detainees to the best of my knowledge was mostly cooperative and docile. The were transferred to Abu Gayrab due to ties with illicit activities.

A. Some of them yes. I assisted with the interro atien.
Q.. During the inprocessing of the detainees, were dogs used to scare the detainees?

A. Not that I know of, because I o no I Was there for the inprocessing. The dogs were used to sniff for explosives if it
was believed the detainee and property were involved in making ex losive devices.

I a.memeber of the 372 nd mp co.primary . mos 92g(cook). arrived in hilla iraq 6jun 03. was there fromJune to sept, was doing.an law and order mission. while there my unit ran the police stations and .the police training camp. doing my time in hilla i did the cooking and made sure the unit had it supplies. in oct o3 we were assigned to the ahu ghraib prison, from oct 03 to dec 03 i was cooking for the unit. in dec 03 i went to the abu ghraib prison property room. i was there from dee 03- mar 04. while i was there i collected property form inmates that were being processed into the prison. along with the property i also collected any money that came in: all the property and money was documented on dd form 4137, and put into a property, log book. the to book listed the inmates number and all property that i
came in with the Inmate. the inmate viewed the
property and then signed that they saw their property and that we were holding it till their release. if the
inmate came with large sums of money (merman) the money was put into a safe. along with the money was
put a copy of the 4137, a copy into the file folder, and one given to the inmate. we also documented it in the
property log book, which the inmate would then sign. doing my time there we were exchanging the old dinar for
the new dinar for all inmates. we took all money to the local ioank and there it was exchanged. if any
counterfiet was found it was destoyed at the bank. for large sums belonging to one person we documented it on
a 4137 with the inmates number and the amount of . .dinar they had. it was -then exchanged along with the other
diar. doing my time there we had recieved large amounts of money from raids that belonged to many iraqis.
the money was all lumped together and exchanged as one sum. i left the property room on? march 2004_.
which was the last time i came into contact with any inmate from the prison. my unit 372nd .nipp co left the
prisoh in april 2004. on april 19, 2004 we were then extended for the shooter mission. we were sent to
anaconda. in may i was assigned to a unit and went to camp cedar. i was there from may 2004- july 2004. on
july 17 2004 i flew to kuwait. i was in kuwait from july 17 2004 to.04. on aug 2 2004 my unit flew
ho:.-.airforce base. i arrived at my HOR on aug 8, 2004
