This sworn statement of a Major assigned to Iraq in March 2003 discusses his understanding and experience at Abu Ghraib prison and the condition he found. The Major was a member of the Combined Joint Task Force at Abu Ghraib prison and he stated: "It appeared many detainees had been brought in and were being held without any real probable cause, other times rounded up just because they were of military service age or were in the vicinity of a raid." Estimated that only about 15% of the detainees were of any real intelligence value. He said "1 am a New York City puller officer in my civilian job and, looking at the situation from a police perspective, I believed there were some problems with the retention and release policies and, criteria at the Board."

I • WANT TO MAKE THE FOLLOWING STATEMENT UNDER OATH:
am currently assigned as the S-3 (35E) Officer with 6th Battalion (BN). 98th Division (institutional Training), Dem. MA. On
10 Mar 3, I was mobilized and cross-leveled to B Co, 325th MI BN, which had mobilized on 10 Feb 03 and was already
processing and training at Fort Dix, NJ. I was -only at Fun Dix for about two weeks when B Co, 325th departed Dix and arrived
in Kuwait on 28 Mar 03. We were in Kuwait for about three to three and a half weeks waiting on our equipment via ship, creation
and configuring the Tactical HUMINT Teams (THTs), and preparing to convoy into Iraq once the war began. On or about 27
Apr 03, we convoyed to Baled, Iraq, about 70 miles north of Baghdad, where I was transferred from B Co to the 325th battalion
staff and served as the Counterintelligence (CI) Officer. My main responsibility as the CI Officer was to task d t '
THTs. About 10 Jun 03. I was transferred to the CJTF-7 staff and was assigned to the C2X shop working f
1st MI BN, California *A ' card, who was the CX2 until he departed on 18 Nov 03.

necrrung using Ahu Gharaib (AG), t was a arc of the proposal to make AG a central detention facility. 1 did not think AG
was a very good choice considering the AG's history and association with the Hussein Regime. Later on (date?) there was that
discussion about making AG a central interrogation facility as well and concentrating detainees of intelligence value there. Up
until this point, Camp Cropper was the facility for detainees of unclligence interest and I do not know why the decision was made 1 to close Cropper and move sc. . t fac 1 assumed that LTG SANCHEZ and BO FAST made the decision, but I do not know, also working in the CJTF-7 C2X shop went on a site sum of AG, but I reallyhad nu ow c o c ccision wiz . As a C2X staff officer, I worked periodically with d Camp Cropper and then at AG, and els() who was the Officer-in-Charge of the interrogation operations. Most of my communicatitio with OM and was via e-mail and less frequently by telephone for time
¦ sensitive issues. Most of my eouurtunic.atiou was foe-used on uNwics about spezifie.s detainev.s, as I had the na -asibility of daily briefingthe CJTF Conunand about the stasis of significant detainees and what information the interrogators I was not involved in the staffing process of the Interrogauon Rules of Engagement request that was sent up f t AG. I was a Battle Captain at the time and I was only tasked to find x: Interrogation SOP for modification and imp =cam . I teed to go to the Detention Facility at Guantanamo.Bay (GTMO), Cuba. but was unsuccessful in directly obtaining any assistance. I then contacted a colonel (I can't recall his name) at CENTCOM Headquarters and asked for his assistance in acquiring the GTMO

SOP. bat I never heard anything back from him. It was shortly the.-natter that MU Miller's GTMO 11ger Team" arrived to otter
assistance at AG. I do not know who was staffing the IROE request, although it could have been the 205th MI BDE doing it, as
COL PAPPAS had a strong interest in AG operations and was basically running his own little e 205th. 1 personally
never saw the IROE request and was never consulted about.a. On one occasion, I filled in fo and sat in on a •
Detainee Release Board that met once a week to determine which detainees would be released rom AG. That Board also had BG
KARPINSKI and BG FAST as members. 1 am a New York City puller officer in my civilian job and, looking at the situation
from a police perspective, I believed there were some problems with the retention and release policies and, criteria at the Hoard. It

appeared many detainees had hum brought in and were being held without any real prc -,hable cause, often times being rounded up
just because they were of military service age or were in the vicinity of a raid. Ac there were not enough screeners in pmperly
categorize the detainees, a great number probably ended up at AG when they shouldn't have. I would estimate that only about 15
percent of the detainees were of any real intelligence value, and the retention of the others contributed to the overcrowding of AG.
Addiuenally, because of what appeared to be a reluctance to releasclavecurity detainees, very few were released as a result of
