Email is a response to Sen. Barbara Milkulski's request for information. It states that FORSCOM [United States Army Forces Command] attachment, called Detainee ops, has as its purpose "to provide information on the pre-mobilization training of the 372 Military Police Company". Executive Summary states that training has included "process offenders, select type of body search to perform, use unarmed self defense techniques, determine the level of force required, secure offender with hand irons, use of riot baton, and riot formations, but not Geneva Convention human rights standards. Includes detailed training agendas and blank forms for training assessment. Also includes a Use of Force and Weapons Security Agreement, on which each soldier needs to sign off, listing the policy of use of deadly force (as a last resort and only after verbal persuasion, unarmed defense techniques, chemical aerosol irritant projectors, MP club, military working dogs, and presentation of deadly force capability, respectively).

EXECUTIVE SUMMARY
(U) State of Training for 372 nd MP Company on Specified Topics
The 372nd Military Police Company was mobilized first in August of 2001 for an SFOR (Bosnia) mission lasting six months, for a total mobilization time of nine months. They were demobilized from this mission in February 2002 and it was May before they received their equipment back and resumed IDT training. In October, 2002 the 372d MP Company was identified as a CGUI and was officially alerted on 6 Jan 2003 for Operation Enduring Freedom. The unit was mobilized in February 2003. They were recently extended and are still in theater. Last fall, some soldiers had to redeploy as a result of achieving 24 months of total mobilization (double tap), and they were not replaced. This was due to them having served in Noble Eagle prior to SFOR rotation.
On 7 December 2002 (from 1330-1430 the 372 11d MP Company was scheduled to receive a Law of Land Warfare briefing. as the SJA and OIC of the legal team which provided the training. Sign in sheets for this training have not been located. It is important to note that many soldiers were cross leveled into the unit upon mobilization and therefore would not have been present for this training period.
On Saturday, January 12, 2002, the 372 nd MP Company was scheduled to receive training on a number of tasks related to Law and Order Operations. These tasks included: Process offenders,
Select Type of Body Search to Perform, Use Unarmed Self Defense Techniques, Determine the Level of Force Required, Secure Offender with Hand Irons, Use of Riot Baton , and Riot Formations (each subject was an hour in length). These tasks all involve contact with prisoners.
In reviewing the 220 th MP Brigade's Yearly Training Brief, Leadership training was scheduled and took place every quarter in the form of NCODP and ODP. Some of the subjects in FY02 included OPSEC procedures, Area Security, MMSO, and Prepare a Warning Order.
No specific evidence of Code of Conduct or Geneva Convention human rights standards training exists on any available training schedules, although it was stated that Geneva Convention training should also occur as a part of Post-Mobilization training and may have been provided at the Mobilization Site.
The 220th Bde METL (October 2000) includes the task "Direct Internment/Resettlement (I/R) Operations" for which the commander gave an assessment of a "P" rating on 1 December 2001. While all MPs receive UR training, UR Operations do not belong on a Combat Support MP company's METL and was therefore not a primary focus for 372 nd MP Company training. In addition, in the last several years the only major USARC exercise (Exercise Gold Sword) involving processing and treatment of detainees and EPWs has been cancelled due to operational requirements of the units which would ordinarily conduct the training (800 th MP Bde).

The 372d's normal peacetime parent command is the 336th MP Battalion from Pittsburgh, PA. While the 336th MP BN is deployed to Iraq, the 400th MP Battalion has assumed C2 of the soldiers of the 372d MP soldiers that have redeployed.

(U) Training of the 372nd MP Company prior to Operation Enduring Freedom
The 372d Military Police Company mobilized for an SFOR rotation on 4 August 2001 and returned from Bosnia on 18 March 2002. The unit did not begin any IDT training nor receive their equipment until May 2002. In late 2001 and early 2002, many of the soldiers that did not deploy to Bosnia mobilized with four (4) other Army Reserve units ISO Operation Noble Eagle. Records indicate that of the 372d Military Police soldiers mobilized for Operation Enduring Freedom/Iraqi Freedom,-(41) had served under Operation Noble Eagle and (71) had deployed ISO SFOR (Bosnia). (58) had not mobilized under Noble Eagle or SFOR. In October 2002 the 372d MP Company was identified as a CGUI (Commanding General Unit of Interest). On 6 January 2003 the unit was alerted for Operation Enduring Freedom (OEF). The unit mobilized on 24 February 2003, reported to the Mobilization Station (Ft Lee, VA) and subsequently deployed to Iraq. This EXSUM covers the training period from the unit's reorganization and reconstitution from Bosnia to their mobilization for OEF.
Most of the training as documented in current training records indicate the unit trained on collective, supporting and individual tasks relating to a Combat Support Military Police mission.
Specifically in reference to the current situation involving the 372d Military Police Company, unit training records indicate:
On 6 AUG 01 the unit was validated by BG Szakmary on the following applicable tasks: Code of Conduct, Law of Land Warfare, SAEDA, Rules of Engagement and Force Protection.
On 7 DEC 02 the unit conducted Anti-terrorism Force Protection Training, Equal Opportunity Training, SAEDA training, and Law of Land Warfare.training
IAW the Yearly Training Brief, the unit scheduled ODP and NCODP every quarter. These were primarily METL-focused and concentrated on Operations Security, Area Security, Maneuver and Mobility Support Operations, and Military Decision-making.
The unit's Mission-Essential Task List as of 15 July 2002 identified five tasks: 1. Conduct Law and Order Operations. 2. Area Security Operations. 3. Movement and Mobility Support Operations. 4. Mobilize, deploy and redeploy and 5. Conduct Anti-terrorism/Force Protection procedures. As a supporting task of Conduct AT/FP, the unit identified the following Internment/Resettlement (UR) related tasks on their METL: 1. Supervise an EPW Holding Area and 2. Perform Field Processing of EPW. The Training Assessment Model (TAM) for TY 02 indicates that the unit was not scheduled to train on these during the IDT/drill periods, rather training for these tasks would be scheduled at Annual Training and upon Post-mobilization. unit did evaluate both of these tasks as a "P", signifying needing additional training. They also annotated on the TAM that they needed improvement in each of the tasks.
The unit listed on their Post-mobilization Training and Support Requirements for FY 03 that "Supervising an EPW Holding Area" was one of 14 tasks the unit identified as a "Prioritized Collective Task" that would need to be trained on upon mobilization. As a Combat Support Military Police Company, the 372d Military Police Company would not typically train collectively during peacetime on Internment/Resettlement Operations.

Training will be conducted under the Train to Standard concept. After Action reviews will be conducted after each training event. Safety Briefings will be conducted prior to each training event.

5.
All Platoon Sergeants, Platoon Leaders and Section Sergeants will attend all Training Meetings

6.
Training Outlines and sign-in attendance rosters are required for all blocks of instruction. These items MUST be turned in to the Operations/Training NCO by the end of the drill period and attached to the original Training Schedule.

7.
First Line Leaders must prepare work plans prior to the start of the training period. The section leader must approve the work plan and one copy must be with the First Line Leader during the training period.

8.
Opportunity Training will be utilized by leaders to train their soldiers in Common, MOS, or METL based tasks during periods of "down time" training events. NBC task will be integrated into each training activity.

9.
Birth month audits will be conducted for each soldier that applies. See Admin, Supply, Ops, Maint

The Term ALL as used in this training plan indicates that all personnel assigned to this unit will attend the training period unless properly
excused from doing so by the Commander, or is performing concurrent training as outlined on the training plan. ALL (-) indicates all
personnel except administrative details and sections following a section work plan.
2.
Each month all equipment that will require a service during the following month will be turned into the maintenance sergeant by COB.

3.
Church call will be (1) hour in length only. Conducted at the church of the individual's choice.

4.
Training will be conducted under the Train to Standard concept. After Action reviews will be conducted after each training event. Safety Briefings will be conducted prior to each training event.

5.
All Platoon Sergeants, Platoon Leaders and Section Sergeants will attend all Training Meetings

6.
Training Outlines and sign-in attendance rosters are required for all blocks of instruction. These items MUST be turned in to the Operations/Training NCO by the end of the drill period and attached to the original Training Schedule.

7.
First Line Leaders must prepare work plans prior to the start of the training period. The section leader must approve the work plan and one copy must be with the First Line Leader during the training period.

Opportunity Training will be utilized by leaders to train their soldiers in Common, MOS, or METL based tasks during periods of "down time" training events. NBC task will be integrated into each training activity.
9.
Birth month audits will be conducted for each soldier that applies. See Admin, Supply, Ops, Maint

10.
Sections Will refer to work plan in support of Lanes Training.

In accordance with paragraph 2-10, AR 290-11, I am responsible
for the security and accountability of arms, ammunition, and
explosives when assigned to me.

2.
I have been briefed on AR 190-14, Carrying of Firearms and Use
of Force for Law Enforcement and Security Duties, dated 23
September 1988. I specifically have read and understand the
following:

a. The minimum amount of force necessary to fulfill assigned duties will be used. Deadly force will only be used as a last resort.
b. The following, a situation: IN THE ORDER LISTED, will be used to handle

3. Military working dogs will be used in accordance with AR
190-12. Dogs will be released only if the lesser measure o f force
would not be effective and only after a challenge or order to halt

understand the following applies to the use of deadly force:

a. Deadly force will be used only under condition of extreme
need and as a last resort, when all lesser means have
failed or cannot reasonably be used.

b. Deadly force will be used only under one or more of the
following circumstances:

(1)
In self-defense, when in immediate danger of death or
serious injury.

(2)
To protect property related to National Security when
reasonably necessary to prevent:

(a)
Threatened theft, damage, or espionage aimed at
property or information designated as vital to
National Security.

(b)
Actual theft, damage, or espionage aimed at
property or information which, though not vital,
is designated as substantially important to
National Security.

(c)
Escape of an individual whose unauthorized
presence near property or information vital to
National Security is a reasonable threat of
theft, sabotage or espionage.

(3)
To prevent sabotage or theft of property (such as
operable weapons or ammunition) which, in the hands of
an unauthorized person, presents a substantial
potential threat of death or serious bodily harm to
others.

(4)
To prevent serious offenses against persons
involving death, threatened death, or serious bodily
harm (such as murder, armed robbery, aggravated
assault, or rape).

(5)
To apprehend or to prevent the escape of a suspect
when probable cause exists to believe the suspect has
committed one of the offenses specified above.

(6)
To prevent the escape of a dangerous prisoner, when
deadly force reasonably appears to be necessary and
when specifically authorized by competent authority
governed by this regulation.

DA military and civilian personnel engaged in law enforcement or security ditties will avoid the use of force where they can carry out thier duties without resorting to its use. In such cases where the use of force is warranted, DA personnel will use the minimum amount of force necessary to reach thier objective. Only as a last resort will deadly force be used and only as described in this regulation.

b.
In evaluating the degree of force required for specific law enforcement or security situations, the following options should be considered in the order listed:

Unarmed defense techniques

(3)
Chemical aerosol irritant projectors

c.
Principles defined in this regulation on the use of deadly force with firearms will be applied to personnel

using a weapon or equipment which, when properly employed in thier intended application, would exert deadly force.
d. Deadly force is justified only under conditions of extreme necessity and as a last resort when all lesser means
have failed or cannot reasonably be employed. Deadly force is justified under one or more of the following circumstances.
(1) Self-Defense and defense of others. When deadly force reasonably appears to be necessary to protect law
enforcement or security personnel who reasonably believe themselves or others to be in imminent danger of dearth or serious bodily harm.

Assets involving national security: When deadly force reasonably appears necessary to prevent the actual theft or sabotage of assets vital to national security. DOD assets will be specifically designated as "vital to national security" only when thier loss, damage, or compromise would seriously jeopardize the fulfillment of a national defense mission. Examples include nuclear weapons; nuclear command, control, and communication facilities and designated restricted areas containing strategic operational assets, sensitive codes or special access programs.

(3)
Assets not involving national security but inherently dangerous to others: When deadly force reasonably appears to be necessary to prevent the actual theft or sabotage of resources, such as operable weapons or ammunition, that are inherently dangerous to others; such as assets that, in the hands of an unauthorized individual, present a substantial potential danger of death or serious bodily harm to others. Example include high risk portable and lethal missiles, rockets, arms, ammunition, explosives, chemical agents, and special

nuclear material.

(4)
Serious offenses against persons. When deadly force reasonably appears necessary to prevent the commission of a serious offense involving violence and threatening death or serious bodily harm. Examples include murder, armed robbery, and aggravated assault.

(5)
Arrest or apprehension. When deadly force reasonably appears to be necessary to arrest, apprehend, or prevent the escape of a person who, there is probable cause to believe, has committed an offense of the nature specified in (2) through (4) above.

(6)
Escapes. When deadly force has been specifically authorized by the Secretary of the Army and reasonably appears to be necessary to prevent the escape of a prisoner, provide law enforcement or security personnel have probable cause to believe that the escaping prisoner poses a threat of serious bodily harm either to security personnel

or others.
e. Additional requirements for the use of firearms.
(1)
Give an order to halt before firing.

(2)
Warning are prohibited.

(3)
When a firearm is discharged, it will be fired with the intent of rendering the person(s) at whom it is discharged incapable of continuing the activity of course of behavior prompting the individual to shoot.

(4)
Shots will be fired only with due regard for the safety of innocent bystanders.

(5)
In case of holstered weapons, a weapon should not be removed from the holster unless there is reasonable expectation that use of the weapon may be necessary.
