A chain of emails discussing the possible investigation by a Naval Criminal Investigative Service (NCIS) investigator of a FBI agent who had been present in Afghanistan when a prisoner died. The agent filled out an action report upon return, and responded to the NCIS's written list of questions which had to do with the death in question. The investigator did not give him any information as to whether or not he was a target.

This was the case, but Steve is a little off on a couple of things. I am the guy that voiced concerns over the
potential failure to report issue.

You can seethe protocol belo~ for reportjrg in the Afghanistan and then oscl Irecollection.
Here's the background from S'1 he was with the SF forces that captured th£f SUbject iQ
question. After a raid, theSUbject was taken away for interrogationand as always, SAl Jalong
withthe restof the shooyers (SFto which he is attached) departed to return to their base of operations.
c::::::::Jwas not presentor in the vicinity ofthe interrogationthat evidently led to the death of the subject. b 6
Hewrotehis after action. Some time later, NCIS came to him with a written list of questions, in retrosapect b7C
he nowrealizes hadto do with the death in question, which he responded to. He has already been
lntervlewed b~ N~ISi The NelS investigatorthis time would no' give him any info or say whetherhe is a
targetor not. spoke withthe Agent's Association attorneyand based on that conversation and the
facts above, e pans to talkwith NCIS, today.
I needto knowfrom wherethe concerns came from that have been vooiced he might have a failureto
reportproblem and mightbe in troublewith us.

All'agents in Afghanistan who participatein SSEs are requiredto complete an after action report
(MR) uponreturn. Within thisMR, they note times of d~arturi and return, information or items
recovered, and any pertinent or noteworthyactivity. I thin twE SSE, while I was there and he was
out on a third and had notreturned when I left. On one of the SSEs, was asked by the military to
provide answers to a set of questions that I believe are relatedto the incident in question but I'm not sure
without knowing additional details. So, in addition to the MR, there may also be a second document
describing his actionsandwhat he saw.
