Task # 4a: What is the basis for MP support to interrogation? From MP community viewpoint, not FM 34-52.

Answer #4a:

1.
No Army MP regulation or field manuals provide for MP Support to interrogation. The three primary references for MP Internment and Resettlement Operations are AR 190-8, FM 3-19-40 and 3-19-1. What is found in these publications is that M.P coordinate with MI to passively collect information that may be used in current or future operations. The MP provides an "area for intelligence collection efforts" per AR 190-8 paragraph 3-3, (23). Additionally, MPs typically screen mail, collect personal affects, confiscate contraband items ti and turn those of intelligence value over to military intelligence. The MP coordinates shelter, protection, accountability, and sustainment for detainees.

Guidance specific to MP — MI interactions are found in the following regulations and field manuals:

a.
Army Regulation (AR) 190-8 Enemy Prisoners of War, Retained Personnel Civilian Internees and Other Detainees: paragraph 2-1 (d) "Prisoners may be, interrogated in the combat zone." (e)"Prisoners May not be threatened, insulted, or exposed to unpleasant or disparate treatment of any kind because of their refusal to answer questions. Interrogations will normally be performed by intelligence or counterintelligence personnel."

b.
Field Manual (FM) 3-19.40, Internment/Resettlement Operations, 1 August 2001, Preface, establishes this FM as the .doctrinal foundation for detainee operations. The MP role in information gathering is seen in Section 4-95. "All facility personnel must detect and report significant information. They can acquire important information through observation and insight, even though they are not trained intelligence specialists."

c.
FM 3-19.1, Military Police Operations, 31 January 2002, paragraphs 4-42 to 4-43, further defines the role of MP units in detainee operations and references MI. Section 4-42. The Army is the Department of Defense's (DOD's) executive agent for all EPW/CI operations. Additionally, the Army is DOD's executive agent for long-term confinement of US military prisoners. Within the Army and through the combatant commander, the MP are tasked with "coordinating shelter, protection, accountability, and sustainment for EPWs/Cls". In 4-43 the WR function addresses the MP roles when dealing with EPWs/C1s, dislocated civilians,

There are three primary sources upon which the MP support to
interrogation is based (AR 190-8, FM 3-19-40 and FM 3-19-1).


The roles of the MP in Detainee Operations including intelligence operations are consistently defined as custodial; coordinating shelter, protection, accountability, and sustainment and coordinating with Mi for passing information.


The role is one of passive collection specific to those elements of
information that MP may be exposed to.
