To all EADs and ADs at FBIHQ,
I would like to provide some additional clarification regarding the attached e-mail and
EC. This EC was erroneously sent via e-mail to all FBIHQ employees, as opposed to
each Executive Assistant Director and Assistant Director at FBIHQ. It also lacked
sufficient explanation and administrative directions. This EC applies only to HQ Divisions and
not field offices,
The American Civil Liberties Union (ACLU) has filed a law suit against various agencies in the United
States Government, inclUding the FBI, requesting all documentslrecords held by that entity,
and created from 9/12/2001 to 5/25/2004, that pertain to the treatment of detainees held outside the United
States. On September 15, 2004, the ACLU obtained a court order from the United States Court, Southern
District of New York, ordering these United States Government agencies, including the FBI, to
produce these documents.
The Records Management Division (RMD) Freedom of Information and Privacy Act
(FOIPA) Litigation Teams have already coordinated searches in units, determined by RMD FOIPA
Litigation Teams as most likely to be in possession of responsive materials. The purpose of
this EC was to ensure that other entities at FBIHQ not previously identified by the Litigation Teams are
queried for any remaining documents that might be responsive to this court order. .
Should you determine that your Division may potentialll have material responsive to this search, please
