SUBJECT: Call for Closure ofthe Detention Facility at Guantanamo Bay
CaseNumber: 0803618
The Under Secretary ofDefense for Policy andthe Executive Secretary has reviewed the
above tasker and recommendcancellation for the following reasons.
• Most ofthe issues raised in the letterhave becomeOBEdue to the Supreme
Court's decision in the Boumediene case, the MilitaryCommissions Act and
the Detainee Treatment Act- all of whichare available on the internet. The
• SCOTUSdecision, which entitled Guantanamo Detainees full Constitutional
privilege to habeas, and these pieces of legislation passed by Congress and
signed into law, answer the bulk of questions/claims made in the letter.
• We should not get in a debate with the writer aboutthe interpretation of
intemationallaw, especially sincewearedealing with "Law of Watt andnot
with criminal law, Any answergiven will clearlynot be satisfactory to the
writer, as this criticof administration's policies offersno viable alternative
solutions for detaining terrorists duringwartime.
• This letter is riddled with inaccuracies and going on record to correctthem
would open the President or otherUSGofficials up to becoming a pen pal with
this organization.
