Investigation initiated following discovery of a CD during an office clean-up in Afghanistan, containing numerous pictures of American soldiers posing with pistols and M-4 rifles pointed at the heads and backs of hooded and bound detainees. The photographs were taken by a number of soldiers from the Second Platoon of the 22nd Infantry Battalion while stationed at Fire Base Tycze, Dae Rah Wod. Numerous soldiers admitted to posing in the pictures and taking and downloading the photographs as "mementos" of their time in Afghanistan. The investigation found probable cause to believe that eight soldiers committed the offense of Dereliction of Duty, but not the more serious charge of Aggravated Assault. Most of the soldiers interviewed stated that they were not aware of any set policy on the treatment of detainees, and did not realize at the time that their actions were wrong. A sergeant stated that he had also seen pictures on Army computers of detainees being kicked, hit or inhumanely treated while in U.S. custody.
The photographs also included pictures of soldiers "PUC'ing" (Person Under Control) each other, a platoon ritual in which soldiers would be bound and hooded like detainees by other platoon members, and have water thrown on them.

SSGjdescribed the photographs .4 through 6, as being "PUC", Persons Under Control (PUC). This was a very close platoon, and we would tie up a felloW soldier and horseplay around to celebrate a promotion, award or birthday. It was done to be on my birthday, j. voluntarily, as the other soldiers also participated in the events. The deceased Afghanistan Male (photograph 20 and 21), I do not know who he is. The only one I can think of it being is the guy killed when he shot the Rocket Propelled Grenade (RPG) at the tower on DRW. SSG j•am"was hot present during the attacks, and was' not aware if a Commanders 15-6 was conducted or 'a SPOT Report was done. SSG

At 1045, 06 Jul 04, SAjnterviewed CPT
Legal Claims, Office of the Staff Judge Advocate (OSJA), FDNY, who
stated he has no idea where the compact disc came from and has no
idea how he would not have seen it, if it were in his office. CPT
stated there were boxes in his office that he never looked through, but
he believes that the disc was put in his office after he left the theatre on
or about 01 Apr 04. CPTjfurther stated an interpreter (NFI but
described as a thin middle-eastern male, approximately 5'6" or less,
wore "preppy" clothing a lot, worked in Bagram Collection Point (BCP) in
either document exploitation or with the interro ators) gave him a disc
and wanted him to put pictures on it. CPT jtated he never
examined the disc and forgot to put pictures on It. CPT asked
the interpreter if he wanted the disc back, but the interpreter told him not
to worry about it. CPT the disc In question,
but insists the disc wasigts unsure if this is

At 1745, 06 Jul 04, SAjand INTj this office, interviewed PFC j B Company, 2/22nd Infantry Bn, 10th MTN DIV, FDNY, who stated he deployed to Afghanistan at the end of July 2003 with 2nd Platoon. His duties included grenadier and guard at the Doh Rah Wod (Firebase (FB) Tycze) compound, Afghanistan. From arrival in Afghanistan to approximately Dec 03, pFcamplikelated he participated in Mountain-A Viper and went on emergency leave. From Dec 03 to mid-Feb 04, PFC
stated he was assigned to FB Tycze where his duties includedirituard duty, and detainee guard in the persons under control (PUC) facility. PFC....stated after his mission in FB Tycze his platoon was assigned to Qualot until April and then returned to Kandahar for redeployment. PFQIIIIIIIIPstated the detainees lived in decent living conditions, but those conditions became much better when the new PUC facility was built. When asked what PFC thought maltreatment was, he replied with hitting, slapping, or general j1646 el mistreatment of other individuals. PFC 11111111111.stated what he saw in P-7 through P-9 was abuse and maltreatment. PFC {stated tha kr944 there was no standard operating procedure (SOP) put out by the chain of command or by the SF leadership. PFC grnipstated that they we authorized to play loud music and keep detainees awake if the interrogators wanted them to. PFC MIPstated they kept the detainees awake by holding them up or by playing the loud music. PF
further related the detainees were only kept at the facility for a few days to about to a week. PFC elated P-11 depicted tower one at FB Tycze after it was struck by a rocket-propelled grenade (RPG from an Afghanistan male. PFCjstated the incident occurred at approximately 0145, 18 Jan 04, while he was on duty in tower three, which was located across the FB. PFC IIIIIIII1Pstated that there had been machine gun fire the entire night and closer to the time of the attack the gunfire started impacting within the FB. At the time of the attack, he heard three loud explosions and turned back to see tower one had become engulfed in flames. He observed two soldiers blown out of the tower and soldiers firing from the area where the attack came from. PFCIIIIIMpstated that he the individual depicted in P-20 was the individual who attacked the guard tower that night PFC further related that he believed all the pictures were taken at Fa Tycze and he never observed the SF soldiers and interrogators at the FB do anything unusual or treat anyone inhumanely.
Agent's Comment: PFCjdeclined to provide a written statement,
but agreed to allow SAjo take detailed notes for toc-i t eg"
documentation. The pictures that are described above were taken from
the CD provided by the. Afghanistan CID office. These pictures were
made into a photographic packet and labeled 1-21 and produced into
seven controlled and signed for packets. This was done to facilitate
questioning of soldiers and to ensure descriptions of pictures were
accurate. This also reduces confusion regarding what picture the.
individual soldiers are referring to. If further investigation reveals
additional photographs, then they will be added to the photographic

weapons aimed at the head of Afghanisti prisoners/detainees and being in about two photographs where he was holding a unloaded pistol at the covered head of a prisoner/detainee (See Waiver Certificate and Sworn Statement for details).
AGENTS COMMENTS: SPC IMINwas initially interviewed at 0945, 8 Jul 04 and during the course of the interview, he made a incriminating statement concerning "bad photo's" being exposed by members of his unit prior to the incident in Iraq and only became aware of this after the news broke on television and newspapers of the Iraqi incidents. 1:07 INV ce-qc..1 only a couple of weeks and was deployed to Afghanistan. His platoon
arrived around August 2003 time frame and was based out of Kandahar
International Airport. His position was automatic rifleman. He related he
went to Bagram Air Base about half way through his nine month
deployment for only two weeks and returned to Kandahar for the
remainder of the mission. While in Bagram for the two weeks he did
guard PUC's (detainees) at the facility named Orgun-e for a couple of
hours at a time and switched with fellow soldiers. He related he did not
witness or participate in any detainee abuse, SPC imp was not
aware of the pictures shown regarding DRW and was only aware of the
RPG attack involving the wounding of three Us soldiers from word of
mouth from fellow first platoon soldiers.

3 hrs Discussed case with SAjparticularly evidence issues; all CPU's not previously examined in field were forwarded to USACIL; questioned SA11111.1111Pegarding the one or two rolls of film seized; these had , not been forwarded as the images in the questioned CD were digital, and the SAC ...Iat Bagram, a computer crime coordinator for the Benning Bn, indicated initial exam of evidence in original case was related to images being produced on a Fuji brand camera (see original RFA —0122-04); as such film was not sent and VHS compact cassettes were no examined as the office does not have a compatible VHS machine to examine.

SUMMARY OF INVESTIGATIVE ACTIVITY
From 1 Dec 04 to 17 Dec 04, Intern bh2t9- , this office,
attempted to obtain DA Form 4833 from CPj Commander,
HSB, 3rd Bn, 321st FA, Ft Bragg, NC and was told on that they were
working issue and he felt the Bn Commander may have completed the
form and would check on this. It ended up no action has been taken.
CPT IIIIIIIIIIPindicated he was working the issue.
Contacted CPTjwho related that he had questions Ole-3
concerning the action that needs to be taken as he felt the charges weren't justifiable and was looking for advise. I advised again that this (06-3
investigation has interest at the highest levels and it is imperative this
form is completed whether or not action is taken and he needed to
coordinate with his local SJA for advice. CPT jindicated the

Received fax in my disto box which pertained toj. The form included a MFR from CPTjSJA which indicated "No Action was Taken" due to insufficient evidence. Posted copies in copied file and original file to go fonward. Pending adminsitrative processing.
Completed adjudication in ACl2, closed message and MFR•to CRC with Commander's signature, copies posted in file and assembled originals in original file. Reviewed for completeness and then packaged for Registered mailing to CRC. Case forwarded to Evidence Custodian for final disposition of evidence.
