SUBJECT: Command Emphasis on Pqper Detainee Treatment
1. Our primary mission is to find hostile forces, and then capture or kill them. This appliei tcrevery
Soldier, Sailor, Airman and Marine in CEOTF-AP." However, our work does not end there. When
we capture detainees, we must aggressively exploit them for battlefield intelligence. •
2. But there are limits: We must treat all detainees 'Droner/v. I want to emphasize the following:
a. Saddam's regime tortured people — Americans will 'not. Do not sink to Saddam's level.
b. You may not interrogate detainees."at all costs." Use Only approvertinterrogation techniques,
of War (POWs) under the Geneva Convention,

c. Treat all detainees humanely. Give them essential foOd, water, sleep and medical care.
d.

International law states that "no physical or mental torture; nor any other form of coercion,
may be inflicted on POWs to secure .,. information of any kind.... POWs who refuse to answer may
not be threatened, insulted, or exposed to. unpleasant ... treatment Of any kind."
e. POWs must always "be protected, particularly against acts of violence or intimidation."
f. Protectyourself from accusations of torture. Document injuries that dccurduring an arrest,
and document the detainee's condition when you .u rn him over to a detentibn facility.
.3. Commanders must immediately re-enaphasize- these points down to the lowest level. Do not let a
team conduct a mission, or hold a detainee, unless you are confident they will follow these rules.

4. Service mem.h.ert must immediately report all suspected violations. Cdminanders must •
investigate all reports. Violations may be prosecuted under the UCIVIT and the Law of War.
5, I do not want to sacrifice intelligence opportunities,. We "must aggressively interrogate and
exploit, detainees for intelligence,' but we must do it properly. There are many effective and legal
techniques for gathering intelligence, andI expect you to use them.
