ANT TO MAKE THE FOLLOWING STATEMENT UNDER OATH:. . . I have been assign, . to Fort Hood since July 2003 and was assigned to tho 549th Area Support Medical COMPany:ancl I deployed as an individnal in .support. of Operation Iraqi Freedom on 20 Oct 03, I arrived to Al A0.4 on II; Oct 03. and joined the 3rd Armor Ca-Val*, geginient: I was part of support squadron which was based at Al Asad: To my best recollection the incident took place betWeen January or February 2004 It was sometime between 2100 and 2400 hours when a civilian sPOrtS utility. vehicle (SIM. drove up to the front of the hospital with in Iraqi national, I do not remember the make of the vehicle or a color at this time, all Iremeinber is that it was a medium size SOY. I remember that our front desk had •ome advance notice that this.patient Was .being transported to the hospital. I believe the ira.qi national had a detainee
number but I don't remember that number at this time The person who brought the patient also stated
that he was being interrogated so I. assumed the patient was a detainee: The patient was•-plaCed on a -
stretcher and.rought into the Trauma room, I noticed the patient had a braise approximately 4 centimeters in diameter on his fOrehead. The patient was•uncOnscious andhiS pupils were dilated:: His bloodpressurewas normal, his heart rate was stable ; and he had pending respiratory failure, . The anesthesiologist -• incubated the patient because of his condition, I did not notide•any blood on the patient's clothes and he did
not have any active bleeding, The patient's symptomS were consistent with an anoxic brain injury: . We did not have a CT scan available to us so we did not know what.was the underlying cause was I asked the person who brought the patient in what happened and he stated that he was being interrogated and thathe was sprayed with water on the face and that he thought the patient was a diabetic. The patient was placed ina ventilator and was under observation the entire night, We tried to Mecidevac hiM to the 21 CSH unit that
night bOught there was -some problemi with the weather or there was no available helicopter for the • transport The-patient was finally meddevac'ed in the morning. I docuMented all my observations on a SF 600 and had approximately 1 to 1 1/2 pages of notes : All the medical documents were sent with the patient

MEMORANDUM FOR RECORD
SUBJECT: Alleged homicide of Iraqi prisoner December, 2003
1. This memorandum records the details surrounding the death of an Iraqi prisoner in Balad, Iraq
in December, 2003, The patient is said to have been evacuated from the Abu Grath prison
facility and sent to the 21 st Combat Support Hospital (CSH) facility in Balad. This patient had
blunt trauma to the head manifested by severe bruising without lacerations. He also had
intraparenchymal hemorrhages in the brain demonstrated on his CT scam These hemorrhages are
pretty specific for blunt force injury, and are typical of blunt head trauma that could be sustained
in a beating. The patient was near death upon arrival and expired shortly after arrival at the CSH.

PT and MAJ were the physicians that bl c--3
-.
21st ' - 126-3

treated the patient at the 21 CSH. CPT s currently assigned to the hospital at Ft •
Leonard Wood, Missouri, and can be reached at MAJ is currently
assigned to Brooke Army Medical Center (BAMC) at Ft Sam Houston, TX,. although he is close
to a PCS move to Walter Reed Medical Center in Washington D.C. He may be reached at
..

• the Department of Medicine at BAMC, The patient was seen at the point of 64cl origin by MAJ Regimental Surgeon of the 3rd Armored 66-1 Cavalry Regiment MAJI Executive Officer of the 21 st CSH, saw the patient at arrival as well, and discussed the case with Dr.111.11111. MAJIIIIIMIIII may be
eached at_— The body was processed using normal procedures and released to the
family shortly after death. An autopsy was not performed, nor were there facilities to perform an
autopsy in the country at the time. The medical record is still at the hospital in Balad, in the
custody of the 31 st CSH.

2.
These events were reported to the CID unit at Balad, Iraq the next day. They were said to
have started an investigation but no final feedback was ever received by the CSH that the
investigation was concluded. Reasonable steps would seem to be 1) obtaining a sworn statement
from all four of the above individuals 2) finding the medical record of the prisoner, winch Will
entail a search of medical recordS for third country nationals at the hospital in Balad between I31 December, 2003. The record should be obvious to almost any examiner given the
circumstances detailed above:

3.
This report is prompted by the desire for completeness and closure in light of recent
revelations concerning deaths of Iraqi detainees while in custody.

I am the agent working this case. To give you a little b group info atio to help you out; we had an individual from the 21st Combat'Suppo Hospita repo t that \a detainee died at his hospital in Dec 03 or Jan 04., He said the etainee ca1te frot Al Aba , Abu Gh.reil;', or out west. So I researched med records of he 21st and tt,e o i y detai ee that
match the description of injuries for those time f' me S was EPW. hat's th4 number

21st assigned. Within Oliprecords was Detainee ...Mk treated at the Al Asad cctnbat
hospital. Al Asad stated he was dropped off at the front door by a U S. person' 'n
civilian clothe's. So naturally, I started with the 3rd ACR deteatio facility, hich. was
located in Al Asad at that time frame. Their records indicated

was MR
captured 22 Dec 03 which matches the time frame of the injuries pa.' our dead victim. The
kvonly records they had of him was an interrogation summary, completed 19 Jan 04 by SSG

1111110

mR,01111111110died on 4 Jan 04. First off, I guess it would be a good question to
ask if SSG SMOMMIPremembers the guy. I would like to know why he was captured 22 Dec and
. the Interrogation Summary completed on 19 Jan, Who was he interrogated by? Where did he
go after that? What was his condition when SSG 111111.10received him? Did he keep

arlYtD

other documentation on prisoners and where I could find it" Did he witness any abuse of -"OV

detainees? Does he know of any U.S. personnel who wear civilian clothes and drive a white
van? Who else kept prisoners at Al Asad? How did they assign detainee numbers? (I'm
afraid of the possibility that there are a million nut there) Did anyone ever ask
him to alter the Interrogation Summary? Did he alter the 'nterrogation summary? I know"
there is another person in his previous unit who is also der investigation for murder of
a detainee but for some reason still has access to detaine records and that's who we got

the interrogation summary from. (if that makes an sense?)

b(4,)...././ b(4)()...q

I think those are the important questions. I tried calling you bUt you didn't answer.

What is your fax #so I can send you my AIR, statement of CPT MONOW Death Certificate,
and the Interrogation Summary. Thank you for doing this interview for us. If you have
any further questions or need more paperwork, let me know.

6447Mr , thanks for the update. On another issue I have been given a SDF from SA
on etletainee death in Iraq that was reported to Fort Hood. We did a lot of activity on it and I went ahead and ROI'd it yesterday. SAIIIIIIIMInforrned me she had an RFA out to your office to interview a couple of folks (doctors I think) Your sequence was 204-04 (ours was 0374-04). Anyway,
-we have identified individuals that need to be interviewed or reinterviewPd. I'm unsure if you guys shut down the RFA or what, as we received the info report but the agent working it for us never contacted¦I¦about closing it down. Could be a miscommunication issue, I'm unsure, all I • know I have this ROI and I have some more leads for you guys. Also, could you give me your fax so I can send you some statements; Also, I'm required to report the status of all my CAT I cases every Monday On the attached RFA I have requested your office update me every Friday. The agent can just send me a quick email. Sorry for this, I wish this stuff would all go away. Thanks,

It would be a miracle if you can find him, If you have some dead time, no pun intended, and want to try the impossible, I was given this CAT 1 with unknown subject and unknown victim based on the 21st CS11 • commanders recollection when he returned to Hood: He says an Iraqi was brought in with closed head injuries in mid Dec 03, and subsequently died, Said he reported to CID but doesn't think they looked into it because OlD never interviewed his doctors, We were directed to open by higher. The COL also said only 10 to 15 deaths met the criteria from that time frame:
. . .

You would have to au l the SliRs and Death packets froth Mort Affairs and make sure CID investigated all the deaths with closed head injuries ., If one was not ROl'd it would be my guy. You may also open Pandora's box Ile lot were not looked at for some reason.
It would be a great help if you could look Jam talking with the former NCOIC this week here.

Hope you are doing well in the sand. Made it out of Korea, and to Ft Hood, Tx. Loving it.
This is a tough RFA. Everthing thing needed should be. in Baled at the 31st CSH and/or Mort
Aff. If someone can look at December 2003 SIRs maintained by the 31st CSH, and ensure all
deaths of Iraqi adult males (with closed head injuries) was investigated by CID, we're good to
go. If not, I need to ID who was not investigated. The former COL in charge of the CSH said
only 10 or so fit the criteria .• Let me know if you have any questions about the RFA.

Keep safe and let me knoW if you need anything at all.

Subject RE deceased detainee in Iraq Dec 03
I completely concur with getting these two Organizations together. (But ....I need to share something) • -• I don't know if everyone knows the following info, so I'm taking this opportunity to share this
, . The automated 54 log from Iraq that I reviewed with documents that the dead guy in Mosul. died from a heart attack on 9 Dec 03. Our dead guy in Baled had blunt force trauma to his head which lead to his demise, which tells to one of 2 things. •

a.
if the dead guy in Mosul is the same as the dead guy in Baled, there is a major cover up going Ori.

b.
they simply are not the same people

• Food for thought

Obviously they are not in Salad, this folks had searched their files and database twice and found nothing. The 21st and the 31st PAD need to get in line and come up with an answer for us,

we've identified another Dr Who needs to be interviewed. Dr (Maj) 3rd ACR, (who was actually identified in the MFR COL MN. provided and I spaced • . it out). According to COMM./ interview yesterday, the deceased Iraqi's point of origin (MEDVAC) was where doctor was located (from my understanding Dr 11111111111111111.was 3rd ARC and he was located in Mosul). He's currently at Ft

During a coordination yesterday with I found out there is an ROI pertaining to an Iraqi who died on 9 Dec 03 in Mosul.
This could possibly be the same case we're running 'leads on here in the States. So by connecting the dots I'm sure you guys can figure out if dead guy in Mosul is the same dead guy who was seen in Baled.

ICV.T11111Pcracle a number on this and get to the 31st CSH and see if they can track down. and medical records. I know therereally is not much to go on until we get a name. Have .see if he can track down all detainees sent from Abu to 21st ' CSH. THis is probably the best we can do. We really need to know how the medical report filing system is to know how to start looking for the records. •
