Investigation into death of an Iraqi male who was killed in Iraq by an American soldier. The investigation determined that the Sergeant who killed the Iraqi not commit the offense of murder and the offense of murder was not committed as initially alleged. Subsequent to the cease fire, one of the Iraqi soldiers exited the building from which hostilities were coming from and presented a white flag at the end of his rifle with the muzzle pointed in the air, as if he were surrendering. The Iraqi appeared to be in surrender status. Subsequent to the surrender process the Iraqi lowered his weapon and fired upon the soldiers. Several soldiers returned fire, killing the Iraqi. This incident was within the US Central Command's rules of engagement policy.

• About 1000, 11 Aug 04, this office was notified by Military Police Investigations (MPI), Office of the Provost Marshal, Fort Carson, CO (FCCO) 80913, of an undetermined death of an Iraqi male who was killed in Iraq by an American soldier. The Iraqi was in surrender status.

lawful hostile engagement.
Investigation established that on 11 Apr 04, the 706th TC, deployed to Taji, Iraq, where they
were involved in a hostile engagement when an Iraqi insurgent force ambushed the 706th TC's
convoy. The convoy members engaged the Iraqi force wherein all Iraqi's were killed except a
small force who barricaded themselves inside a buildingbunker.

Subsequent to the cease fire, one of the Iraqi soldiers exited the building and presented a white

members. Several memners of the convoy then returned Killing the Iraqi.
The investigation also disclosed upon several interviews of the convoy members that SSG / 7 ccr. ‘4°S-AlminiND did not engage the surrendering Iraqi as his weapon had malfunctioned. 12 ­
Further investigation also established that 1st Calvary Division responded to this incident to
assist the 706th TC and captured two Iraqi's who were released to the Prisoner of War (POW)
collection point.

On 28 Oct 04, SSG as interviewed wherein he denied he had shot at or killed
the above surrendering Iraqi. He related his unit engaged the Iraqi force when his unit was
ambushed during a convoy.

Between 20 - 24 Apr 04, the 593rd Corps Support Group conducted a commander's inquiry
regarding this incident confirming the above events. -
Further, on 20 Jun 05, during an administrative review of this file, it was disclosed the synopsis s, .„$-of this report did not fully explain why SSG i
