CID Report regarding alleged riot at Abu Ghraib prison on June 13, 2003, during which one Iraqi detainee, Alla Jasin Hassan, was shot to death by Military Police (MP). Official investigation concludes that the shooting was a justified homicide, because Hassan allegedly "incited other detainees to riot by trying to overtake the Military Police (MP) guards inside of the compound utilizing rocks and tent poles, posing a credible threat to the MP guards." The riot allegedly ensued "after 14 other Iraqi detainees were released from the prison." Report includes several witness statements and sketches of the Abu Ghraib compound.

Ghraib Detention Facility, Camp Vigilant, Baghdad, Iraq.

Investigation established probable cause to believe Mr. HASSAN committed the offense of
Rioting, when he incited other detainees to riot by trying to overtake the Military Police (MP)
guards inside of the compound utilizing rocks and tent poles, posing a credible threat to the
guards. As a result, lethal force was justifiably used against Mr. HASSAN, which resulted i MP

BASIS FOR INVESTIGATION: On 12 Jul 04, SA' , this office, received a

AGENT'S COMMENT: A 15-6 investigation was conducted by the 400th Military Police (MP) Battalion (Bn),Baghdad, Iraq, however a CID investigation was never initiated to investigate this incident. Upon, further review of the report, a riot ensued after 14 other Iraqi detainees were released from the prison. During the riot, Mr. HASSAN and other Iraqi detainees, attempted to overtake the MP prison guards inside of the compound by

I eployed to Iraq about May of 2003. Our unit set up for our convoy to Baghdad from
Kuwait. I was a sergeant with the 72"d Military Police Company I was the 2"d Platoon
Third squad leader. When we first hit Abu graid pri

prison site. I was told by the First Sgt. 0111111/tnat we needed to set up the compound
to hold approximately 600 prisoners and that this night we were to receive approximately
100 prisoners. We didn't have proper tools or supply's to set up a complete compound. We
did the best we could using what we had. Most of the outside prison was made of tactical
wire only. We used two sides of the inter prison walls as part of the containment.
Because this was a previous prison we were able to use some of the prison towers as
elevated position over the compound. There was one "yard tower" that had the best view
over and into the compound. The prison was build into sections to segregate inmates.
Between the sections of the outside and inside compound we left a large walkways so to
keep distance from inmates and guards during feeding, during cimet•time, and gen. Watch.
At no time did we allow weapons other than MP batons into the 71Ter part of the prison.

This was to keep weapons away from inmates and allow assess

to guards an escape route in
case of a prison riot. Outside the compound we had roving guards armed with shotguns.
The towers were armed with M-16 rifle or shotgun. If something was to go off the inter
guard would alert with the sound of a whistle. Our commutation was limited to hand-held
radios that didn't always work: because we didn't always have batteraes. Our company was
tasks with many missions from convoy escort, prisoner transports and the fact we handle
our own perimeter force that keep us going and kept us apart for others platoon duties.
Our platoon handles the dayshift (0400-1600) while 1' and 3' platoon handle nightshift
(1600-0400). With heat, conditions, hours, and nightly mortars attacks soldiers sleep
and eating habits started to. run soldiers down. During the first two months most of the
problems dealing with inmates were because of lack of translators, running out of water,
lack of food, lack of shelter, no bathrooms or showers, no bedding and most of all
medical care. We try to keep them in line with what we had but we didn't have much. By
June of 2003 the heat and condition were affecting the inmates and the soldiers. On June
13'h 2003, about 1500 my squad and I were tasked with a mission to transport inmates to
Baghdad for release. We return to back to the prison after 1600. As I was turn off my
hummer it came a distress call from the radio I rush towards the compound with part of
my squad and other members of our platoon. I could hear multiple shots coming

On this date we didn t have much medical personnel to handle all Lhis so we relied on
soldiers with combat lifesaver training to help. We exit the first section of the compound
and line up again to extract the wounded inmates of the second section. This time some
of the inmates were faking injuries to get out, this cause us delays in extracting the real
wounded inmates. The entire group of wound were placed and cared for in anopen
compound some were then transport by truck to a medical. hard site. The First Sergeant
and myself called for the inter-guard to point out the inmate who had thrown the rock at
him. He stated he had a blue shirt we pulled out a couple hilt. thp a couldn't say witch
one it was. At this time I was handling the care of Spec, `ho was overcome by heat
and stress and having problems breathing andalpo I tpad ow injured my left knee
during this fight. After getting Spec.fOrAffititg ri ht rpaii who gave more care
relieved m was call over by my p a ' Oil Sgt. SFC.t 'Ho told me to gather my
squad for .Mier mission I was command to drive out to t e near by town to find the
police station and escort an ambulance back to the prison. The town was further then
expected and with out support it toke awhile to get back to the prison. The local's people
heard the shootings and had blocked the road with rocks and trash. We had to clear the
road for the ambulance while maintaining security. We enter the inter walls of the prison;
we were lend to b4J.y were using to work on vehicles. Inside was the body of a
male inmate. Lt. as in the building she asked us to unwrap the inmate from the
old piece of tent they wrap him up in. So that she could take pictures of the body the
wounds. He had two bullet entry points one in the chest and the other to his upper side.
We replaced him in to the old tent and put him into the ambulance. We then escorted the
ambulance the same town to a local medical clinic. At the clinic myself and an other Sgt.
went inside to locate the doctor. The doctor understood some English. We explained we
had the body of an inmate in the ambulance; we didn't have any name only the inmate
number given to him and his belt. The doctor became irate and started to cause a bad seen
as a crowd of locals watch over us. We escorted the body down the street to a large
refrigeration unit center being used for bodies. We left to the town back to the prison
when we arrived many soldiers were taken back from situations of the past few hours. I
could hear many discussions on how it was handle. Some soldier left their post in
disgusts and it was already causing problems among the platoons. The commander stated
that they would start an investigation. They pick only a few soldiers to write up
statements and within a week the Company Commander was informing that the shooting
was justified and they were notified that the inmate was a past murder. I don't how they
came across this information. I have the understanding that on this day many of the
towers open fire inside the compound. I can't state what, who or why they were shooting
since the injured inter guard was already exiting the inter compound. I was told later that
the command to shoot was given from SFC. from the yard tower. After that many
towers open fired. I was told this information from a few soldiers in our company. I can't
say who was in the toviar_9t we did keep a daily log in the command post. Later I hear
from Spec iiimprvho recalls what she sawhefore_leayina herpost. I heard bits and
piece of what happen from the towers but it was hard to believe any of it. This experience
has shown me the importance of advance training and the need for proper supplies and
guidance from leadership. I glad that many of the National Guard soldiers like myself
came with training and experience from their civilian employment, it help solve many
problems like this one before they started.

: No lethal or non-lethal weapons were used. The prisoners were over

manned and taken to the ground using body to body contact. Then the prisoners were cuffed, carried back, and placed with the other prisoners.
Q: Did you ever see any excessive force used by members of your unit, against the etainees?
•Only on June 13 th 2003 when the towers opened fire on the inmates.

No, it wasn't until I turned off my HIJMVEE, and got a distress call over the radio to return to the yard.

. : Approximately 30 seconds.

• : There is only one yard tower, the rest are perimeter towers that overlook the

A: Yes.
Q: Were you given any specific orders when you were called to react to the riots on 13 .June 04? : No.
: What were your reactions when you entered the prison compound? .A: We assessed that the there was a detainee down and bleeding in the first section of the compound. I lined up a group of soldiers that were standing by, none of them were armed, opened the gate to the compound, and advanced towards the detainees. We pushed them back with our hands towards the back of the compound, and another group began picking up the wounded detainees and pulling them out of the compound.

A: Yes, if I were to see rocks and sharpened tent poles being thrown at a soldier, I may easily perceive it as life threatening, and use deadly force, especially in a combat environment where there are a few hundred detainees being guarded by less than ten soldiers pulling interior guard.

A: I don't know. I was firing shotgun buckshot from about 60 yards. There was
so much going on, that I don't know if the detainee went down from my shot or
from someone else's. I know that he got up on his own power and fled to a tent.

Q: Were the rules of engagement posted anywhere?

A: No, but I carried a copy in my pocket. I don't know when they were drafted.

Q: Did the facility itself have a Standard Operating Procedure (SOP) for firing
weapons?

A: It was the same thing as the rules of engagement. It was the same rules for
combat. I don't think they were designed for containment facilities.

The MPs on duty attempted to do. a count and =sure alldetainees were accounted for. The detainees refused to cooperate and QRF was dispatched to the yard andthe count was conducted_ A short while later, QRF was dispatched again, when I heard the QRF beingdispatched I proceed to the yard. Before I got to the yard I heard gunshots. When I got to the yard, otherdetainees were moving the, wounded detainees to tents. The QRF entered the yard and moved the woundeddetainees to the medical area of the compound. I assessed the situation and attempted to determine whatoccurred. The soldiers involved in the shooting were elieved from the towers and we began to investigate the shooti . After m ituti l assessment, ISG conducted an investigation into the shooting.

I thought the detainee tried to dive for a tent after he threw the spear, but he must have fallen from getting shot. After the detainee with the tent pole went down ; the other detainees
stopped thro d the MPs regained control.

. WANT TO MAKE THE FOLLOWING STATEMENT UNDER OATH: I * - statione• with ihet " MP Company in Iraq. I was in Iraq from about 21 May 03 until October 03. I worked at the Abu Ghraib confinement facility. 1 was a platoon leader there. My daily duties included
being in charge of the night shift. which entailed the prisoners out in the yard as well as in the hard site. I
primarily worked at night, but I had other duties as well. On approximately 13 Jun 03, at about 1530,1 was at the Baghdad International Airport. I was in line to buy some items for our Company Post Exchange. I heard radio traffic that said something about me having to return to the confinement facility_ because of a riot that was going on. I then retailed to the confinement facility which took about 40 minutes. Upon my
arrival there everything was over. I was told by some soldiers that the inmates had began throwing rocks and loosened up tent poles and attempted W use them against the Military Police (MP) that were inside the yard. I was walking around with ISGIONOPIN and they were making preparations for the body to be picked up. After that an ambulance came and some soldiers were sent with the body. I think after that they
had the personnel involved in the shooting provide some sworn statements about what happened. Also I remember them keeping the weapons that were involved in the shooting away from the soldiers involved. I remember seeing one of the soldiers that had been hit with a rock at medic station being treated by the medics. He had a huae welt on one of his shoulders.

A: That was the first time that I recall.

A: Someone was guarding the body. I don't remember who. we asked them to unwrap the body so that we could take pictures of the entrance and exit wounds. We took some photographs. I don't remember how many and they wrapped the •body back up and we left. Shortly after that. the ambulance arrived.

A: I think they were provided to the battalion so they could conduct an investigation.

Was stationed in Iraq from about March 03 until October 03. I worked at the Abu Ghraib confinement facility. My daily duties were to guard prisoners. On about 13 Jun,twas,on„the,Quick Reaction Force (QRF). I was informed that a prisoner had escaped. Me and SOT IMINXIMMran him ,down and brought him back to the tent. About 20 minutes later. we heard over the radio that a riot was occurring. We staged ourselves just outside the confinement area. I saw a bunch of rock being thrown by the prisoners at the guards. I ran to the entrance to the compound and motioned for the guards inside to come to me and get out of there. The last guard that was coming hid behind a generator. I told him to get out of there. As he took off, a prisoner cocked back with a tent pole as if he was going to throw it at the guard. When he did this, shots rang out from three towers and the prisoner ran back into a tent. After that, we got the entire QRF and-we stopped the riot and started first aid on some of the wounded detainees.

I was stationed in Iraq from about March 03 until October 03. I worked at the Abu Ghraib confinement facility. My daily duties were to guard prisoners. On the day of the riot. 13 Jun 03, I was working on the day shift, which was from 0400 to 1600. We ‘Aere relaxing inside of the main structure that we used as living quarters. Suddenly I heard shotgun blasts. Then radio traffic stated a prisoner riot in the yard was
2 and QRF was needed. So we geared up and exited out the back doof into the yard and staged at the "Sally Ron -. We were standing bye waiting for yard personnel to give us guidance. In the meantime. I personally saw a lot of commotion, but I didn't see anythina that had to do with prisoners being out of control. Finally we go in and we saw that there were some detaineesthat had wounds. We observed one that appeared to be a fatality. The QRF then'assisted in getting wounded prisoners out of the compound and to attempt to locate the prisoners who had started the riot. After that we got the wounded prisoners out and separated the prisoners who were still acting aggressive. Approximately 30niinutes later, I was guarding a guy who had received some minor shotgun injuries, but was okay. Once he was taken, I sat down and started looking at the overall situation. All of the sudden, I'm sitting there and it seemed as though the volume in my ears felt like it was turned down. My hearing was diminishing. 1 thought maybe I had been struck up side the head, but did not recall being touched at all. I thought I should get up and leave and I attempted to get u and all the muscles in my legs felt like rubber and I couldn't get up. Not being able to stand up, SGT came around and asked me if I was alright. 1 told him that I couldn't stand up. I was placed on a litter and taken inside. Once inside, I was laying there and felt as if I was in a dream. I was so relaxed and couldn't feel anything. 1 wanted to go to sleep. I remember telling SGT 1111111111.that I wanted to go-to steep. I could hear S.-GT.1111.sayiniz that I couldn't go to sleep because if I went to work, I may not be able to get up. He told me to talk to him. I sensed desperation in his voice. I guess 1 was really dehydrated. 1 was laying there and I could hear SGT AIMbut I couldn't move any part of my body. I was told that I was dehydrated and they wanted to start an IV. I told them no because I hated needles. I was told that I had to have an IV. I was given two IV bags and I then started to feel better.

A: I don't know. I was just generally concerned.
