When Soldiers were attacked with small arms and an RPG several Iraqi nationals were taken in to custody; tried; and convicted of the offence. This CID report is the record of that judicial proceeding. One Iraqi was found guilty of attempted murder and not tried for hostile fire and received six years in jail. One person involved in the attack died from injuries received during the attack.

(OP) in Kirkuk, IZ, mY squad observed some'enemy movement in a

field outside of the windows of our OP. There were three Arabic
males, one carrYing a Rocket ProPelled Grenade Launcher (RPG),

and the other two carrYing what seemed to be AK-47 assault.
rifles. In accordance with our standard oPeration Procedures

(SOP), we engaged the three unknown males from. our OP. The' guy

with the RPG was hit and fell to the ground, and then theY.

• • e moved away from the windows and I rn°ved t° the doorwaY. I continued to laY down fire feb1W-the
doorway. A few moments into the firefight, I realized I had
been hit in the arm by something. At that point, I was already
on the ground. One of mY squad members, SPC applied

a tourniquet to mY arm. -I can't-remember exec Y everYthing

that happened, as things started to get kind of patchy and hazy.
My squad ended up calling for the Quick Reaction Force (QHF) te
get us out of there. I'm not sure how much time passed, but I

was-loaded into a vehicle with two of the enemy gumnen, who were
also being treated for their injuries. I was brought to a cache
unit, where I received initial treatment for my injuries. I was
taken to Landstuhl, GermanY soon after I left the cache unit,
then I was flown to Wahshington, D.C., then to California, then
I finally got b ck to Hawaii.

This investigation vvas initiated based upon notification by the 22nd Military
Police (MP) Battalion (F3N) Operation Officer that about 2245, 10 Apr 04, a
soldier was injured as a result of a small arms fire attack while manning an
Observation Point with his unit in Kirkuk, IZ.

About 1115, 12 Apr 04, SA oordinated with SSG 1111111111
11111Battle Nco 1/21st Infantry Battalion APO AE 09347 who provided the subjectS names, and basic information concerning this investigation.
About 114-5, 12 Apr 04, coordinated with SG4111111/11S-2 Section, 2d 13rigade, APO AE 0934.7, however, SG111111111.was 'unable th provide any additional information concerning this investigation

Additionally, SAIIIIMP coordinated with the local mortuary affairs office, which disclosed there where three local nationals in their office, one was confirmed not to be a subject of this investigation, and two unknown persons. -
