An investigation into the February 28, 2004 shooting of Muhamad Husain Kadir, an Iraqi cow herder who was flex-cuffed, by PFC Edward L. Richmond (name disclosed in later-produced court-martial records). &nbsp;The platoon stationed at Taal Al Jal got instructions to shoot anyone fleeing the village. A PFC &quot;noticed an Iraqi male walking his cattle away from the village [and] asked if I should shoot the farmer because he was leaving the village. I was told by SGT not [to] shoot him.&quot; &nbsp;The PFC then got instructions that all males in the area should be arrested. One squad member stated: &quot;We began to see local Iraqi nationals walking around in the fields herding their cows and sheep. There was never a reason given to why these Iraqis are being detained.&quot; &nbsp;A SGT and PFC entered the field and cuffed Iraqis. PFC Richmond fired one round at a cuffed detainee, later claiming that detainee lunged at the SGT: &quot;SGT then stated to me 'place my weapon on his head and if he so much as moves shoot him,' which I did.&quot; In a later statement, the PFC stated that &quot;[L]ooking back on it now, I don't think the Iraqi actually lunged. What happened is [SGT] turned him to walk away; however, because of the adrenaline, when [SGT] moved the Iraqi out of my sight picture, I just reacted by shooting him.&quot; SGT states that detainee had been flexi-cuffed and did not lunge. Squad-member interviewed about incident states that accused soldier &quot;would always see any Iraqi and ask if he could shoot them.&quot; Investigation found probable cause to believe that the shooting was a murder and that PFC Richmond made a false statement. &nbsp;PFC Richmond was later convicted by court martialed (ACLU-RDI 1751, see link at right) of voluntary manslaughter and sentenced to, among others things, three years in prison.</p>

Looking back on the entire situation, I would like to make some corrections to that statement at this time. Prior to the raid, the rules of engagement were put out that if anyone tried to flee the villiage, we were to shoot them. After arriving to the villiage and setting up, I could hear some shotgun blasts going off in the village where the raid was taking place. I theft noticed an Iraqi male walking his cattle away from the villiage. Since the rules of engagement were put out that we were to shoot anyone fleeing the villiage, I asked if I should shoot the farmer because he was leasing the village. I was told by SGT.not shoot him. About an hour later, someone. maybe CPT.ut out over e radio to apprehend all males leaving the m villiage. At that time, we e e to apprehend the farmer. Myself and machd a set of flexicuffs and began walking into the field where the farmer was still wit s .e. My. W'‘ adrenaline was already pumping because of the raid and then even more so as we approached the farmer to apprehend him. Myself and .cided that.would place the.4/5(9S-flexicuffs on the farmer, while I stood gu .le farmer seemed to.ecting our attention to something else as we approached him, and then as SGT .egan placing the flexicuffs on him, he started resisting. Already at that point I had a lot of adrena me going through my system and.outed at me to point my rifle at the Iraqi's head. I then pointed my rifle at his head and he opped resisting. In my previous statement I put in that I did not realize the Iraqi was wearing flexicuffs when I shot him. Looking back now, I think it would be more accurate to say that I did not register in my mind that he was w' flexicuffs. The adrenaline was affecting my perception of the situation. I remember seeing.putting flexicuffs on him and I saw him with his arms behind his back as I pointed my rifle at his head. I had to know he had on flexicuffs before I shot him, but it just did not re ster in my mind at the time. Also in my previous statement, I said that the Iraqi lunged at .Again, looking back on it now, I don't think the Iraqi actually lunged. What ha ened is.irned him to walk away; however, because of the adrenaline, when.oved the Iraqi out of my sight pidice, I just reacted by shooting him. I would have never shot that man had I been thinking clearly. I would never shoot someone who was wearing flexicuffs if I registered in my mind that they were wearing them.
