Investigation into the death of Yasiree Ahmes Al-Haddii, an enemy prisoner of war at Camp Bucca, Um Qasr, Iraq. Yasiree was found to have committed the offenses of attempted murder, rioting, and aggravated assault prior to his death. Two U.S. soldiers were ordered to fire on Mr. Yasiree and he died as a result. Investigation revealed that both soldiers did not commit any offense as they were ordered to fire on Mr. Yasiree and were within the Rules of Engagement.

223rd EG NCOIC, 314th NCOIC, and Contract Interrogator witnessed numerous 320th MP BN mp's that were on the escort guard mission of 44 EPW/CI from Tallil to Camp Bucca on 12 May 2003, mistreating the EPW/CI while at Camp Bucca reception point. A 15-6 was initiated on 13 May 2003 and subsequently turned over to CID on 14 May 2003. All EPW have been interviewed once and will be re-interviewed ASAP due to conflicting information pertaining to the number of victims.

Comments Question: Was the amount of force used appropriate for the situation? Answer: No. EPW were docile and did not provoke any of the alleged assaults. Question: Was medical treatment provided? Answer: Yes. The BN Ai e Station is consolidating this information.

DELAY IN DISPATCHING THIS REPORT WAS DUE TO THE LACK OF
SECURE COMMUNICATIONS CAPABILITIES FOR CID AT THE EPW CAMP.

LTHIS INVESTIGATION WAS INITIATED WHEN MAJ

V1V401111111. DEPUTY STAFF JUDGE ADVOCATE, 800TH MILITARY POLICE
BRIGADE, CAMP BUCCA, UM QASR, IRAQ NOTIFIED THIS OFFICE OF
THE SHOOTING OF AN ENEMY PRISONER OF WAR (EPW) BY A SENTRY.

PRELIMINARY INVESTIGATION REVEALED MR YASIREE INCITED A RIOT
BY ATTACKING THE MILITARY POLICE FEEDING TEAM AND INCITING
THE CROWD TO DO THE SAME AND WAS SHOT BY A SENTRY WHEN HE
SWUNG A LARGE METAL POLE AT THE MILITARY POLICE.

THROUGH THE CONDUCT OF WITNESS AND CANVASS INTERVIEWS IT WAS

Rioting and Aggravated Assault when he .incited the crowd to riot then swung and missed hitting SSG 1111111111111111 and
the feed team with the four-foot pipe LTC
opined Mr allillwas the victim of a Gun Shot Wound (GSW)
however. there was no subject as Mrd received the GSW due to Mr YASIREE s actions and since the projectile
could not be recovered it could n e ruled out that he was hit by the ricocheting round that exited Mr YASIREE LTC
stated both SPC and SPC acted within the ROE and that Mr YASIREE s shooting was a
Justifiable Homicide by SPC II LTC;stated all parties involved were well within the guidelines of the ROE
LTCallilla provided this opinion after a thorough review of all statements and related documents

Iraq on all aspects of this investigation ;OL;stated the International Committee-of th Red Cross (ICRC) was inquiring about the shooting and had requested that his medical personnel be authorized to bury the deceased before sun down in accordance with Muslim Law SA nagiallptated as the crime scene processing is still pending the investigation was not completed however. witness interviews appeared to sustain that the shooting was within the Rules of Engagement (ROE) and it was his decision as Camp Commander to bury the deceased COL tated since the ROE's were followed and it appeared to be a Justifiable Homicide he was going to bury the deceased on grounds at Camp Bucca

and one smaller tent (in the southeast corner of Compound #1). A 7' deep
dry mote surrounded the compound.

Condition of Scene: The two large tents were approximately 100' long by
30' wide. The smaller tent was approximately 20' long by 10' wide. A slit
trench latrine facility was in the northwest corner of Compound #1. The
water point was in the northeast corner. The mote was bordered by a
double-strand of concertina wire towards the interior of the compound and a
second double-stranded concertina wire on the other side of the mote. One
light stand was positioned at each of the four corners of the exterior of
the compound. The lights were_pot turned on when this Death Scene

Examination was conduted.

The incident occurred in the open area north of the southwtrttern most large
tent. SPC NG was approximately 25' from his targets. SPC mm111100 was
approximately 33' from the targets. Blood, bullet fragments, expended
shell casings, and gunshot impact craters were not discovered during the
conduct of the Death Scene Examination. The desert sand had a tendency to
cover evidence in a short period of time. A metal detector and luminol
were not available for the examination (See AIR of SA

Environmental Conditions: The temperature was approximately 98 degrees

Fahrenheit.

Factors Pertinent to Entry/Exit: Entry to Compound #1 could be gained
through a metal gate in the center of the north end of Compound #1. The
gate could only be secured with a thin metal wire to prevent the gate from
swinging. There was no locking device on the gate. In addition, Compound
#1 could be breached with an object and/or EPW being thrown on the
concertina wire so as to allow passage over the wire.

utilizing a digital camera with built-in flash and memory card. The

provided a Sworn Statement, wherein he stated he fired a single warning shot from his assigned 9mm Beretta pistol, in defense of the Feed Team. SPC MOMOMin stated he did not have a clear shot at the EPWs assaulting the Feed Team, so he fired into the trench surrounding the compound (in between the two sections of double-stranded concertina A wire) attempting to disperse the crowd. The shot did not have any
affect. He then observed SPC41111fire at Mr. YASIREE as he swung the pole

Characteristics of Scene: The death scene was contained within EPW
Compound #1, which was at the southwest corner of the EPW compound. EPW
Compound #1 was primarily used as an internment facility for Iraqi EPWs.
The compound was approximately 100 yards long by 50' wide. The base of the
compound was fine, soft-packed, desert sand. The compound contained over
700 EPWs/DCIs housed in two lar.e tents toward the south of Com ound #1

stated he was shot with the first shot, but later identified it as the
second one. He stated the first shot was a warning shot into the air.

He did not.see the decedent get shot.

exited through the approximate center of his abdomen. A circumferential
entrance wound was observed on Mr. YASIREE's back. It was approximately
1/4" in diameter. There did not appear to be any stippling or powder
tattooing around the entrance wound. It appeared to be a distant range
gunshot. The exit wound might have severed Mr. YASIREE's aorta. It was
approximately 1 1/4" long by 1" wide. No defense wounds were apparent on
the decedent's arms or legs. A corresponding entrance wound was not
apparent on Mr. YASIREE's clothing. A corresponding exit wound was
observed on the decedent's tee shirt.

a U.S. Soldier Bn Aid Station native Spanish Speaker (NFI). CPT 76V4,4
provided lifesaving measures to Mr. YASIREE. CPT MIMMI stated Mr.
YASIREE was alive and breathing when he was transported to the clinic.
Mr. YASIREE was in shock. He stopped breathing twice. Cardiopulmonary
resuscitation was conducted and Mr. YASIREE was intubated with a naso­gastric tube, prior to finally expiring within approximately fifteen
minutes after arrival. CPT 11111111MIM did not observe any other injuries

the identities of the interviewers and the purpose of this investigation.

He was informed he did not have to answer any questions. He was provided
a cigarette and a shaded area for the interview. Mr. 111111011stated he67tb44_
ran away from his National service commitment. He spent the last nine

years in Jordan. On 13 Mar 03, he returned to Iraq because he was
worried about his family, but felt comfortable because of the presence of
coalition forces.

witnessed two EPWs engage in a verbal altercation in Compound #1 that
turned physical when one assaulted the other with a metal cup. When the
MP Feed Team separated the combatants, they conferred and decided to exit
the compound. However, about 75-100 EPWs surrounded the MPs. The Feed
Team ordered the EPWs to sit. The EPW (later identified as Mr. Ahmed

Haddi YASIREE, Internment Serial Number 017251, 1 Jan 78, Samawa, Iraq)
that assaulted the other EPW, ran into his tent and returned with a metal
pole. This Mr. YASIREE assaulted SSG IMMOOMPwith the pole, but did not
strike him. The attack forced the MPs back into the compound's
concertina wire fence. SFC ULM heard a warning shot fired by an MP 4-
(later identified as SPC111111111111111MINOMMIMOMMIRIP, 314th MP Co) on

the outside of the compound. Another MP Guard (later identified as SPC

continued their advance. SPC NG then fired the third shot that struck
Mr. YASIREE as he swung the nole (See Sworn Statement).
