About 1640, 31 Jan 04, the 10 thMP BN (CID) reported, via Serious Incident Report (SIR), a detainee died while in the custody of U.S. Forces at the 28 th CSH.
Investigation disclosed that about 0700, 25 Apr 03, 1111111.11as detained by Coalition Forces for reasons unknown and detained at Camp Cropper. On 26 Jan 04,01 was treated by the 744 th Military Police (MP) Battalion (BN) for -a minor injury

complained of dizziness, headaches and chest pains.

was air evacuated to the Intensive Care Unit (ICU), 28 CSH for observation and treatment On 26 Jan 2004, while in the ICU, fell out of his bed and sustained a severe head injury. Between 26-31 Jan 2004 condition worsened and a CT scan disclosed hemorrhaging to the brain. Surgery of disclosed hemorrhaging to the brain from the fall from the bed however a second brain hemorrhage, estimated 3-4 weeks old was also found.

Originally it was believed an autopsy o was not conducted and the Death Certificate prepared by U.S. Forces only listed a cause of death, which was "Brainstem Compression" due to "Intracramal hemorrhage and Coagulpattry" The manner of death
was undetermined.
On 3 Mar 05, this office received-Request for Correction (RFC) 0136-05-CID001 from
HQUSACIJOC, reporting there were Investigative and Administrative deficiencies and
requested this investigation be re-opened to conduct additional investigative activity and
obtain additional documentation.

This is an Operation Iraqi Freedo investigation.
On 31 Jan 04, this office was notified by the 10 th Military olice Battalion (CID)(FWD),

Baghdad, Iraq, of the receipt of a Serious Incident Repo regarding the death of a

prisoner at Ca p Cropper, BIAP, APO AE 09335. Investigation established probable cause to believe .ied after sustaining head injuries fro a reported fall while ad itted to the 28 Co bat Support Hospital (CSH), Baghdad, Iraq, for self-proclai ed chest pain. No autopsy was perfor ed, as the body was released by the 28th CSH to the International Red Cross, Baghdad, Iraq.

CHARACTER'S ICS OF SCENE: Mt. Confinement cell was
approximately 9 feet by 9 feet by 12 feet high and was made of concrete
with gray in color walls. The entrance/exit way was located on the north
wall and was about 3 feet wide.' There were no windows present.

CONDITION OF SCENE: Upon entering the room, the light was on and the door
was locked. On the east wall was a red in color plastic bucket containing
what appeared to be urine, two pink in color plastic buckets, and various
hygiene items. On• the south wall were two Meals, Ready to Eat (MRE)
packages containing what apPeared to be laundry detergent, one red in
color plastic chair, one cardboard box containing various clothing, and
two cardboard MRE boxes containing several various items. One of the MRE
boxes contained a small plastic bag of medicatiOn in tablet form. The
plastic bags bore English handwriting indicative of a prescription from
the camp medical clinic. Along the west wall was one metal bed frame
approximately 4 feetlWide by 7 feet longcontaining one mattress and
several blankets with the bed running north, and south. On the north wall

temPerture -was approximately 55 degrees and the inside temperature was

factor.

box in the decedent's cell. LTC related the medication was both
Mylanta and Motrin, as prescribed by the camp medical clinic, and was a
routine and documented prescription. He related the medication would not

the 79th MP Company. SSG related he recalled the incident where
Mr. 11111111111111 fell from his hospital bed; however, he (SSGallnill did
not physically observe this fall. He stated SPC was working in
the ICW at the time and possibly had better information about the
incident. SSG did not suspect any wrong doing associated with
Mr. fall other than his (SSG speculation that Mr.

Neurosurgeon, 20T Neuro Team, 28th CSH, Baghdad, Iraq who related
Mr. condition worsened after falling from his bed and
underwent a cat scan. LTC related he reviewed the CAT scan and
discovered a severe hemorange in the brain and preformed emergency brain
surgery. on Mr-LTC related, during Surgery he discovered
a chronic brain hemoran e that occurred a minimum of 3-4 weeks prior. LTC

related Mr. cause of death was a bleeding disorder
sustained by a hemorange of ,the brain:

About 1330, 4 Feb 04, SA re-interviewed LTC who related Mr.
had a chronic hemorange that was a minimum of 3 -4 weeks old and
wou ave become fatal if untreated.

AGENTS COMMENT: LTA.= related the chronic hemorange could have been
caused by a minor trauma to the head.

About 1356, 4 Feb 04, SA conducted telephonic interview of Drill.

(NFI), who arranged for Mr. body to be removed from the 28 TH
CSH. Dr. acted the Red Crescent and had Mr. 11111,

related Mr. became incoherent and did not respond to
questions asked of him. SGT /elated Mr. was given a CAT

Prisoner Interrogation Team pertaining to coordinations with the Baghdad
Central Confinement Facility, Abu Ghraib, IZ. (See AIR of SAIMIll

About 1120,, 4 Jun 04, the undersigned received a 1 st Information Report
from the Ft Riley Resident Agency, who reported attempts to contact Dr

Allill on-104met with negative results. Contact was made with the
Pennington County Sheriff's Office, Rapid City, SD, who reported Dr
residence appeared vacant. Neighbors reported Dr had not
been seen in weeks and a check of one of Dr previous ospital
employers disclosed he did not work at the hospital in years. On 4 Jun 04,
coordination with the local U.S. Postal Service disclosed no mail hold or
forwarding for DAMN. Coordination with Driaillar National Guard
unit disclosed no detainee medical records were returned to CONUS when the
unit re-deployed-and there was no known contact number for DAMN

On 8 Jun 04, the undersigned received an Information Report from the Ft
Riley Resident Agency, who reported Dr was located and an interview
scheduled for 9 Jun 04.

About 1400, 16 Jun 04, SA this office, coordinated with Dr (LTC) , Executive Officer and Dr (COL) Commander, 31st Combat Support Hospital (CSH), Ibn Sina Hospital, Baghdad, IZ. Dr related that Dr and SGT , both formerly 31st CSH, were no longer assigned to the unit and re-deployed to their CONUS home station. Drill. 'Stated that he was previously interviewed b SA

admitted into the hospital. He said there were some problems controlling

and attempted to get out of bed and then fell out of the bed on the side he

Resident Agency to locate and interview SGT

About 0820, 28 Jun 04, SA this office, sent a request for medical advice to the Armed Forces Institute of Pathology pertaining to the death of detainee Dr (CDR) Chief Deputy Medical Examiner, Office of the Armed Forces Me ica . Examiner related the USACIDC did not possess enough information on detainee brain hemorrhage to make any determination. Dr... related that while detainee ...II could have had a clotting disorder, some disorders make people prone to clots and others to bleeding. Detainee 11111111111, may haveused enough ETOH over the ears or be old enough to predispose himself to the brain hemorrhage. Dr related the Intra-operative dating of a brain hemorrhage is hard unless reviewed by a pathologist. D4IIIIIIII related the brain hemorrhage could have been very old, possibly years, from a previous scuffle. Dr11.11related it was doubtful detainee thrombosis was occurring in the brain. They were probably in the extremities and clots were breaking free and proceeding to the heart

About 2100, 8 Jul 04, the undersigned received medical consult information

from Drain who related that after review of Detainee
surgical me ical records, many details pertaining to his previous health

history were missin Dr related there was no documentation as to

how detainee all of t e sudden ended up with a head injury.

Detainee was admitted for heart problems and had a terrible

baseline health status (Arterial Sclerosis Cardio Vascular Disease,

diabetes and other health issues). Drill'Illirelated the death certificate

attributes death to low platelets, causing a bleed. Dr related not

all platelet counts were legible in detainee medical records,

but the ones he could discern demonstrated a downward trend between 27-28

Jan 04 and then' back up with the lowest platelet count being 49,000. Dr

did not concur with the Neurosurgeon, 28 th CSH, that a platelet
count of 49,000 was not low enou h to typically cause spontaneous bleeds.

Factors such as detainee clottin status may have been

involved. Dr related detainee may have been transfused

and his platelet count could have dipped lower then reported, but he did

not have the reports for review. Dr 4111111could not determine the cause

About 2320, 9 Jun 04, the undersigned interviewed SGT who related that on the night detainee fell from his bed, he was walking out of a patients room when he hear a oud thud. SGT alked into detainee room and found him lying on the floor. Detainee.. 1111111Ippeared to ave injuries; therefore, SGT 11111111111called for the Military Police to release detainee 111111111111from his constraints and for 1LT Charge Nurse, 31't CSH. stay on the floor until assistance could be obtained. A Doctor was called

and the Doctor ordered a CT scan for detainee1111111111, After the CT Scan
was completed, detainee was placed back in his bed and

restrained. SGT related detainee MEM as result of his

injuries was bleeding from the left e ebrow and mouthand there was blood

on the _floor of the roam. SGT did not know the results of the CT
scan. SGT said detainee never said why he was
attempting to get out of the bed from which he fell. When an Interpreter
was brought into the hospital to translate for detaine11111111111, the

Interpreter stated detainee was speaking in broken sentences,

which did not make sense. SGT related detainee after

the fall seemed disoriented and confused. Detainee wa not SGT
patient; therefore, he had no knowled e what detainee was being treated for, did not know why detainee was in t e hospital, saw no monitors attached to detainee and he was not receiving any type of fluids. SGT elated the fall incident was the first interaction he had with detainee After the fall, detainee was moved via stretcher because he was disoriented and confused. SGT related detainee ould not follow hospital guidande becauSe detainee Continuously tried to sit or get up when instructed to lie down, SGT could:add nothing further to the investigation. SGT related he did not notice any signs of abuse on detaineeTiOWeVef, he was riot- looking either.

About 1515, 10 Jul G4, the undersi ned interviewed 1LT111111 who related
that after she received detainee in the Immediate` Care Ward from
the ICU, she noted detainee enzymes appeared normal. He had no
disorientation and he walked from the ICU to the ICW. 1LT related
detainee continuously showed signs of agitation and bei -antsy,
as he always wanted to sit up in bed or go to the bathroom. 1LT
stated that when she examined detainee she noted no signs of
abuse. 1LTIIIIrelated that when detainee was transferred to
her care, she did not use an interpreter because he spoke some English.
While speaking with detainee he never spoke of abuse. 11,111/
related detainee appeared in good health when examined. He did
not request any food, as she didnot have him long enough to get food for

him. He fell maybe 5-10 minutes after arriving to his room. 1LT111111
related there was nothing out of the ordinary noted during the initial
treatment of detainee1111.111during his time in the hospital.

About 1645, 11 Jul 04 the undersigned interviewed Dr (MAJ) 11111111

31st CSH, who related he was called to assist in
the treatment of detainee 1111111111.after he fell from his bed. Detainee

was received by the Immediate Care Ward from the ICU, and
approximately 5-10 minutes after receipt, was found after falling from his
bed. Detainee was immediatel treated and then taken for a CT
Scan. After the CT Scan, detainee went into surgery and Dr

ad no further contact with him. Dr related detainee

did speak some English and understood English. Detainee 4111,
de no allegations of abuse while in Dr presence. Dr

could add nothing further to assist in the investigation.

About 1710, 11 Jul 04, the undersigned interviewed Dr (MAJ)111.1111111.11111

31st CSH, who related detainee was adritITT777777177—w

treated with medications and appeared to get much better. On t e evening
of detainee all, he was to be discharged from the hospital,
but due to convoy difficulties was transferred from the ICU to the ICW to

On 22 Jul 04, the undersigned received an information paper from the DCG,
Detainee Operations pertainin to detainee The information
paper related detainee had not complained of any headaches or
head injuries prior to admission into the 28th CSH. (See Information Paper)

On 24 Jul 04, the undersigned received authorization from the DCG, Detainee
operations to Pnter Camp Cropper and rondnot investigative acttvity as
necessary.

About 0827, 26 Jul 04-, the undersigned received an In ormation Report from

the Ft McCoy Branch Office, USACIDC who reported SPC and SSG
111111111 .were interviewed. SPC was on leave and his interview

would be completed upon return.

On 28 Jul 04, the undersigned coordinated with the 89th MP BDE, Camp

Cropper, Baghdad International Airport, and obtained the detainee file and

medical records pertaining to detainee . (See Detainee File and

About 1033, 29 Jul 04, the undersigned received a detainee interrogation
matrix noting the dates detainee was interviewed/interrogated
while in custody. Detainee last interview/interrogation date
was 29 Dec 03. Detainee was removed from Camp Cropper and
transported to Camp Slayer, Baghdad, IZ, between 8-11 Jan 04 and allowed to
visit with his family on 11 Jan 04. (See Matrix)

About 1900, 1 Aug 04, the undersigned interviewed 1LT

31st CSH, who related that while in the hospital, detainee

appeared to be in good spirits and he was very polite. While 1LT

poke with detainee he never mentioned maltreatment and

during examination there were no signs of maltreatment. Detainee ¦
came to the hospital for chest pains, but claimed his heart was not

heart condition. 1LT related that he was the nursing care provider
for detainee in the ICU and when detainee...Ill/was screened,
detainee was alert, oriented and possessed all mental faculties.
1LT related that while in the hospital, detainee flipped
through magazines and he would not be expected to have such good motor
skills with a recent head injury. 1LT related detainee
was fine until transferred to the ICU.

On 3 Aug 04, the undersigned reviewed the detainee file of detainee..

which disclosed a Hospital Report of Death dated 31 Jan 04
reporting Dr pronounced detainee deceased at 0156, 31 Jan
04 and the cause of death was Brainstem Compression 72 degrees,
Intracranial Hemorrhage 72 degrees, Coagulpattry 48 degrees and
Thrombocytoperia 72 degrees.

On 7 Aug 04, the undersigned reviewed the medical records of detaineeilli,

which disclosed that on 18 Oct 03, detainee was treated
with Nitro tabs for chest pains; 26 Dec 03, seen for suspected high blood
sugar; 15 Dec 03, seen for blood coming from nose over several days; 19 Nov
03, for heart murmur; on 18 Oct 03, detaineelMillicomplained of chest
pains, extreme headaches and was found crying in his cell clutching head
and chest. He was not alert as normal, had dry heaves the day prior.
Detainee had numerous other medical visits, which need AFIP
consult for etermination if the poor health of detainee was a
contributor in his death.

On 9 Aug 04, the medical records of detaineellinallwere. submitted for
Consult by AFIP.

About 1015, 23 Aug 04, the undersigned received, an Information Report from

the Ft McCoy Branch Office, who reported the. interview of SPC was

scheduled for 24 Aug 04.

Remarks: . tiny! ed on 26Jan04 of chest pain while at Camp Cropper. MEDEVAC to
the 28!'' CSH sa da —1600. Cardiac event was ruled out and was rnonitored for 24hrs.
Subsequently stained head injury secondary to fall while at CSH. CAT Scan revealed
massive cerebra eecl with brain shift. Neurosurgery was performed decompressing bleed
without decompression of brain. An old bleed, 3-4 weeks old, was found on top of the new injury.
All these factors would leave the patient in a vegetative state: LTC neurosurgeon,
estimated hot longer than 72 hour life expectancy.
Note: Medical Records show he was seen at least 8x since 16 J 04 for toe wound and no


ddcurnented complaints of headache or visual disturbance. Tlyughout entire records no head


trauma has been recorded. Oct 03 has recorded of severe hqadache but no trauma and no signs of intra-cranial pressure.

want to make the following statement under oath: On 5 April 2003, I arrived at Talil Air Base, Nasariyah and my assigned duties were a prison guard for the comPound- We were a central hub between Camp Bucca and Camp
Cropper in Baghdad. Any prison going north and south would have to come through our system. 10 Nov 03, I moved to Camp Cropper with the advance party to get things setup in the facility. I eventually moved into the S-3 about 15 Dec 03. I was the liaison between the S-3 and the prison facility. I also handle the training of the new soldiers that were replacing the 7441 MP's as the facility guards, I also arranged transportation of the

A: I do recall arranging the evacuation ofallinillin late Jan 04, but I do not recall
the circumstances surrounding his death. I do recall him expiring while in the 28 th CSH.

Did they tell you why he was being meclivaced from the facility?
A I do not recall, .I onl et instructed to arrange the medical evacuation transportation.

Had Detainee been medivaced before?

A: Most of them had been seen before by the Physician Assistant (PA), for problems, but
I do not recall him being sent out for any. injuries a....

Q: Do you know who questioned or interrogated
A: I do not know them by name, there were so many of them coming in an out, but the
ISG would be able to tell who the specific handlers were. It was their job to authorize
those visits.

Q: Do you have any knowledge of icing abused or claiming to be abused
by anyone?

A: Not while my guards were there, if it had happened it would have came forward and
been reported.

Q: Do you know of the care and treatment thaillilligreceived prior to his death?
A: I do not recall any specific care of treatment that he received. Many of them did
require treatment. There was no need to let the S-3 unless the detainee required medical
evacuation.

Q: What training the guards have handling detainees?

About 1330, 3 Jun 04, S this office, conducted a check of the DOD Employee
Interactive tYata System (DIEDS) for LTC hich confirmed the address of
Rapid City, SD, 57069-0434 (RCSD) as being his hOn16 of record. (See DIEDS report)

About 1530, 3 June 04, SA this office, coordinated with Deputy Pennington Coun Sheriffs Office (PCSO), Rapid City, sb, 57702-0434 (RCSD) to deliver a courtesy message to Dr. (LTC) and provide contact information for this office.
AGENTS COMMENT: Numerous attempts to telephonically contact LTC imillby this office met with negative results.

his arm and one on his leg. I undid the restraint so that the medical staff could treat Detainee I don't remember if I undid one and the nurse undid the other or if I undid both restraints. Detaine was laying face down when I first saw him, I noticed a small was rr. ig to swell. He was also kind of dry heaving not really throwing up, just like he was trying to. I walked out of the room at that point.

On 25 May 05, this office received Request for Correction (RFC) 0136-05-CID001 from Headquarters US Army Criminal Investigation Command (USACIDC), to conduct additional investigative activity and obtain
additional documentation.
About 1415, 1 Jun 05 SAME coordinated with Dr. Colonel, US
Air Force (USAF), US Central Command, Command Surgeon's Office, Chief, Medical Security Assistance
Branch, US Embassy, Baghdad, IZ, and US liaison to the Medico Legal Institute. Baghdad, IZ. Dr. provided the Final Autopsy Examination Report, Request for an Autopsy, and Death Certificate o
age 65. The Final Autopsy Examination Report and Request for an Autopsy were written in Arabic. The CertHicate of Death was issued by LTC MD, lba Sivan Hospital, Baghdad, IZ. Dr. advised he could translate the examination report and request if necessary.
About 1700 1 Jun, 05, SA provided the Final Autopsy Examination Report and Request for an Auto t Ih Mr. prepare e trans ation but due to the medical terminology we requested D verify the translation.
On 5 Jun 05 SA forwarded a translation of the documents to Dr. about 2000, 7 Jun 05, Dr. replied back indicating his receipt of the translated documents and would respond back when he could, considering he was traveling to another forward operating base.

iiii6Mr.1111 IIIIIIII Dr s oke little English so Dr. acted as translator for him. D related the body of Mr was brought to the Medico Legal Institute on 18 Feb 04. A request for autopsy was submitted by the Iraqi Police, Al Juaifir Police Office. The autopsy was performed on 19 Feb 04. Dr.
related his office did not receive any documentation pertaining to the circumstances of Mr
death except for the Death Certificate completed by U.S. Coalition Force's. Dr related there were no injuries on Mr. iody that were consistent with being beaten or abused. The only noted injuries were those annotate
anrotáted on the autopsy report and those "injuries" were primarily the surgical incisions to the head as a result of the surgical procedures performed in an attettpt to save his life. The only unexplained injuries were the bruises noted. on the right cheek, nose and left temple. Neither Dr. nor Dr was familiar with Mr revious medical history or any of the circumstances surrounding Ins death. Dr. related they ha no previous medical documents or treatment history concerning Mr. nor were they provided with any report describing the circumstances of his death. The undersigned bne the doctors on the fact that Mr. was being treated for hypertension, diabetes, and was taking blood thinners and aspirin prior to being medical evacuated to the Combat Support Hospital (CSH) because he complained of chest pains and was believed to be having a heart

Around 1215, 12 Sep 05, this case was coordinated with CPT Office of Staff Judge
Advocate (OSJA), Multi National Corps-Iraq (MNC-I), Camp Victory, IZ, whO opined there was no evidence
to believe a criminal offense was committed.
AGENT'S COMMENT: Although all vailable evidence indicates Mr death was an accident, neither the attending physician nor Dr listed a Manner of Death; therefore, the Manner of Death will remain as undetermined. ///LAST ITEM//I

INVESTIGATION DISCLOSED ON 28 JAN 04, MR. COMPLAINED OF CHEST PAIN TO THE CAMP CROPPER MEDICAL PERSONNEL, AFTERWHICH HE WAS AIR EVACUATED TO THE INTENSIVE CARE UNIT (ICU), 28 TH CSH, BAGHDAD, IRAQ. SUBSEQUENT EXAMINATION DID NOT REVEAL ANY CAUSE OR AFFECT FROM HIS COMPLAINT. WHILE AT THE 28 TH CSH, MR. FELL FROM HIS HOSPITAL BED AND STRUCK HIS HEAD ON THE FLOOR._ THIS INJURY AND SUBSEQUENT CONDITION WORSENED TO WHERE MR BECAME COMATOSE. A CAT SCAN REVEALED INTERCRANIAL BLEEDING AND MR IIIIIIMUNDERWENT IMMEDIATE SURGERY. THE SURGERY REVEALED A SUBSTANTIAL B MMORHAGE, WITH EVIDENCE OF BOTH OLD AND NEW

the 10 th Military Police Battalion (CID) (ABN)
(FWD), Baghdad, Iraq, regarding the death of a

prisoner from Camp Cropper, Baghdad International

Airport (BIAP), Baghdad, Iraq, while being treated

at the 28TH Combat Support Hospital (CSH), Baghdad,

Iraq APO AE 09335.

28th CSH for further treatment and observation.

was a diabetic and was being treated for high blood
pressure.

About 1830, 31 Jan 04, SAIIIIIlland SA

conducted an examination of Mr.

confinement cell, at Camp Cropper, BIAP.

CHARACTERISTICS OF SCENE: Mr.

confinement cell was approximately 9 feet by 9 feet

by 12 feet high and was made of concrete with gray
-in col-or walls-r -The-entrancelexit way was located-

on the north wall and was about 3 feet wide. There

were no windows present.

CONDITION OF SCENE: Upon entering the room, the

light was on and the door was locked. On the east

wall was a red in color plastic bucket containing

what appeared to be urine, two pink in color

plastic buckets, and various hygiene items. On the

south wall were two Meals, Ready to Eat (MRE)

packages containing what appeared to be laundry

detergent, one red in color plastic chair, one

cardboard box containing various clothing, and two

cardboard MRE boxes containing several various

items. One of the MRE boxes contained a small

plastic bag of medication in tablet form. The
plastic bags bore English handwriting indicative of
a prescription from the camp medical clinic. Along
the west wall was one metal bed frame approximately
4 feet wide by 7 feet long containing one mattress
and several blankets with the bed running, north and
south. On the' north wall

ENVIRONMENTAL CONDITIONS: At the time of the
examination, the outside temperature was
approximately 55 degrees and the inside temperature
was approximately 50 degrees. There were no odors
present and a mild wind factor.

FACTORS PERTINENT TO ENTRY/EXIT (E/E): Entry to the cell could only be made through the north E/E.
SCENE DOCUMENTATION: Photographs were exposed by
a Sony Cyber Shot digital camera
and a rough crime scene sketch was completed.

COLLECTION OF CRIME SCENE EVIDENCE: There was no
evidence. collected.

SEARCH FOR LATENT IMPRESSIONS: A search for latent
prints was not conducted due to the circumstances
of this investigation.

SEARCH. BEYOND THE SCENE: A search beyond the scene
was conducted which resulted in negative evidence.

18 Oct 03, detainee was treated with Nitro
tabs for chest pains; 26 Dec 03, seen for suspected
high blood sugar; 15 Dec 03, seen for blood coming
from nose over several days; 19 Nov 03, for heart
murmur; on 18 Oct 03, detainee complained of
chest pains, extreme headaches and was round crying in
his cell clutching head and chest. He was not alert
