This CID investigation concerns allegations of detainee abuse at Abu Ghraib in supposedly taking place in November 2003 by members of the 519th Military Intelligence Battalion following a mortar attack that killed or injured members of that Company. An investigation that included review of records, taking sworn statements, personal interviews and review of medical records led to the investigator(s) to determine that no abuse had taken place, and the matter was closed as unfounded with no further activity on the matter anticipated.

This investigation was initiated upon receipt of a Request for Investigation (0272-04-CID001)
from HQ USACIDC, Fort Belvoir, VA 22060-5506 (FBVA), which reflected that on 9 Jun 04, ,. )e 440

during a review of the MG saill1111111i port by the Detainee Assessment Task Force (DATF), USACIDC, FBVA, it was discovered there were allegations of detainee abuse by members of the 519th Military Intelligence Battalion, Ft Bragg, NC (FBNC) 28310. The incidents allegedly took place in Nov 03, after several soldiers from 519th MI Bn were injured or killed during a mortar attack at the Abu Ghraib Prison (AGP), Abu Ghraib, Iraq.
Investigation established the offense of detainee abuse did not occur as alleged by members of the 229th Military Police Company, Virginia Beach, VA.

There has been some confusion regarding the above RFI, and rightly so.
The original information came from a Taguba report review of three

on 10 Jun, it was reflected, briefly, what each said in their statements.
The basic allegation was soldiers from the 519th MI Bn abused detainees due
to a mortar attack which killed/injured MI soldiers. This abuse was

incident concerning a CPT with short blonde hair. Based on that
description, the Taguba team identified seven CPT's who they believed to be

I have reviewed all three statements (they are now attached to this email).
It is NOT clear if these soldiers are talking about one incident or not and
not clear if the CPT was an MI CPT or not either. I do not know and cannot

their accuracy that one of these 7 CPT's is the CPT as described above.

As such, request the following action be accomplished by Ft Bragg:
1.
Initiate an ROI on the allegations of detainee abuse by the 519th MI BN.

2.
Forward a lead to VA Beach (current location of the above three
soldiers) and have them interviewed. Determine from them the details of the
incident which they describe 519th MI Bn abusing detainees. Determine if
the CPT they describe is an MI CPT or not. Show the previously sent

Synopsis: This investigation was initiated upon notification from CID COMMAND that on 9 Jun 04, during a

1e,h6 review of the MG _report by the Detainee Assessment Task Force, USACIDC, it was 11' discovered there were additional allegations of detainee abuse by members of the 519 th MI Bn, Ft Bragg, NC. The incidents allegedly took place in Nov 03, after several soldiers from 519 th MI Bn were injured/killed during a mortar attack.
8. Status: Requests For Assistance were sent to Fort Lee and Fort Eustis to interview the complainants (SFC
SGT41.11111and SPC.111111, SGTOMpas already been interviewed by the Detainee Assessment Task Force (pending receipt of his Sworn Statement from that office) and completion of the interviews of11111111LndallM1SGEMBROIMMIES A Co,iu•-sth MI BN, FBNC, was telephonic4yinterviewed (due to him being in a Language class) about his knowledge of the alleged abuse. 1SG WM related he had just gotten back from a sub-committee in Washington, D.0 and provided all the information to a MGM. (NFI). 1 SG further related everyone involved in the incident he witnessed had made Sworn Statements the ni ht it occurred, which he assembled into a packet and given to COL
(NFI). 1SG stated on the night in question several MP and MI soldiers were assembled ror
igit, prison after catchin two persons suspected of firing mortars into the prison compound. According to 1SGMNINII SGTv(NFI) picked up one of the detainees and placed in him in the back of a vehicle after the detainee refused to get up from the ground. RFA sent to Fort Huachuca to locate, Id and interview CPTeali in reference to what she saw on the night in question. Pending the identification and location of the numerous other person mentioned in the RFI as they are not at currently at Fort Bragg.

As such, request the following action be accomplished by Ft Bragg:

soldiers) and have them interviewed. Determine from them the details of the
incident which they describe 519th MI Bn abusing detainees. Determine if
the CPT they describe is an MI CPT or not. Show the previously sent
photographs of the CPT's to determine if they recognize any of them as the

CPT abusing a detainee.
If the CPT is identified, and not as belonging to the 519th MI Bn, request
separate sworn statements be obtained, detailing this information. Request
this headquarters be notified and provided those statements for forwarding
to the appropriate CID office for further investigation.

If the CPT is identified as assigned with the 519th MI or involved in the
same incident as the 519th MI Bn, request that information be
integrated/added into a status report of the ROI of Ft Bragg.

ROI. Yes, ROI because no ROI has been initiated on allegations of abuse by the 519th MI

However, even though this guy has been interviewed, we will still need to have him
interviewed and in all likelihood, two separate statements obtained. One for the detainee
abuse by 519th MI Bn and another one fox the CPT he was able to (reportedly) identify.

telephone calls at their homes from a New York Times reporter (Andrea
Elliot), who tries to get the Soldiers to make statements about what

know, or saw, of feel about the detainee abuse allegations at Abu

Ghraib.
When asked, the reporter claims that CID released the various Soldier's
home

phone numbers.

as a
method to get the Soldiers to talk to her. However, they are concerned

with the reporter and find out what is going on and ask her to stop

I don't think that any one of our agents would release the home phone

of another Soldier to a reporter, but she may have used an elicitation

71 The original information came from a Taguba report review of three statements
SPAM. and SGT ./M. In the original RFI sent on 10 Jun, it was reflected,
*briefly, what each said in their statements.
The basic allegation was soldiers from the 519th MI Bn abused detainees due to a mortar

j attack which killed/injured MI soldiers. This abuse was witnessed by the above three. In
that email, they further describe an incident concerning a CPT with short blonde hair.
Based on that description, the Taguba team identified seven CPT's who they believed to be
the person described bye., and el.'" However, as SAM.. observed, those CPT's
all were from an MP unit and not from 519th MI..

I have reviewed all three statements (they are now attached to this email).
It is NOT clear if these soldiers are talking about one incident or not and not clear if
the CPT was an MI CPT or not either. I do not know and cannot speak for the Taguba team
and neither can the detainee task force as to their accuracy that one of these 7 CPT's is
the CPT as described above.

As such, request the following action be accomplished by Ft Bragg:

1.
Initiate an ROI on the allegations of detainee abuse by the 519th MI BN.

2.
Forward a lead to VA Beach (current location of the above three
soldiers) and have them interviewed. Determine from them the details of the incident
which they describe 519th MI Bn abusing detainees. Determine if the CPT they describe is
an MI CPT or not. Show the previously sent photographs of the CPT's to determine if they
recognize any of them as the CPT abusing a detainee.

If the CPT is identified, and not as belonging to the 519th MI Bn, request separate sworn
statements be obtained, detailing this information.
Request

this headquarters be notified and provided those statements for forwarding to the
appropriate CID office for further investigation.

If the CPT is identified as assigned with the 519th MI or involved in the same incident as
the 519th MI Bn, request that information be integrated/added into a status report of the
ROI of Ft Bragg.

If there are questions/concerns on this guidance, please call.

Harman appears in two photogr .that military prosecutors are using a; idence against her,
including one in which she is smiling and giving the thumbs-up with the corpse in the shower room.
The Army has accused her of taking photographs of a pyramid of naked detainees and photographing
and videotaping detainees who were ordered to strip and masturbate in front of other prisoners and
soldiers, according to her charge sheet. She is also charged with jumping on several prisoners as they lay
in a pile; with writing "rapeist" on a prisoner's leg; and with attaching wires to a prisoner's hands while
he stood on a box with his head covered. She told him he would be electrocuted if he fell off the box, the
documents allege.
A former pizza shop assistant manager from Alexandria, Harman, 26, told The Washington Post last
month that members of her military police unit took direction from Anny military intelligence officers,
Central Intelligence Agency operatives and civilian contractors who conducted interrogations at the
prison.
She was not called to testify on Thursday, but Reese said military intelligence clearly controlled the
cellblock where Harman and other members of her military police platoon worked the night shift.
"My MPs, they were directed by the MI people for what they wanted and how they wanted it," he said.
Earlier this week, a U.S. Army judge accepted a request by attorneys of three other soldiers charged in
the Abu Ghraib case to question the top commanders in Iraq and their subordinates. The judge issued the
rulings at pretrial hearings for Sgt. Javal S. Davis, Cpl. Charles A. Graner Jr. and Staff Sgt. Ivan L.
"Chip" Frederick.
Spec. Jeremy C. Sivits, the first soldier to face a court-martial, pleaded guilty last month and was
sentenced to a year in prison.
Defense witnesses testified that Harman was a good soldier, quiet and well liked by the Iraqis she
encountered when the 372nd was based in Huila, south of Baghdad, before being transferred to the
prison.
"She was very friendly," Sgt. 1st Class Shannon Snider testified at the Article 32 hearing, the military equivalent of a preliminary hearing to determine whether there is enough evidence to convene a court­martial. "Anytime we were out on the streets in al•Hilla, people would ask, 'Where's Sabrina? Where's
Sabrina?' "
Reese said he never had a problem with Harman. "She did a good job," he said. "I never witnessed anything hostile. I never saw any show of force."
Harman's hearing was held in a small courtroom at Camp Victory, a U.S. Army base near Baghdad International Airport. Harman, petite with her brown hair pulled back into a tight bun, listened quietly as the charges against her were read. When the investigating officer asked her a question, she answered, "Yes, sir," barely above a whisper. Throughout the hearing, she scribbled notes on a white legal pad. Graner and Spec. Megan Ambuhl, also charged with abuse, sat in a corner at the back of the courtroom.
Two other soldiers testified that they saw detainees being abused but only one reported it to a superior. Both said Harman was present the nights they saw detainees being mistreated.
Spec. Matthew Wisdom, a military policeman, said he saw Frederick strike a detainee in the chest. .1

MP Says Prison's Top Intelligence Officer Saw Dead Detainee

BAGHDAD, June 24 -- The company commander of the U.S. soldiers charged with abusing detainees at
Abu Ghraib prison testified Thursday that the top military intelligence commander at the prison was
present the night a detainee died during an interrogation and that efforts were made to conceal the details
of the detainee's death.

Capt. Donald J. Reese, commander of the 372nd Military Police Company, said he was summoned one
night in November to a shower room in a cellblock at the prison, where he discovered the body of a
bloodied detainee on the floor. A group of intelligence personnel was standing around the body,
discussing what to do, and Col. Thomas M. Pappas, commander of military intelligence at the prison,
was among them, Reese said.
Reese said an Army colonel named Jordan sent a soldier to the prison mess hall for ice to preserve the
body overnight. Lt. Col. Steven L. Jordan was head of the interrogation center at the prison, but it was
unclear whether he was the officer to whom Reese referred.
No medics were called, Reese said, and the detainee's identification was never recorded.
Reese testified that he heard Pappas say at one point, "I'm not going down for this alone."
An autopsy the next day determined that the man's death was caused by a blood clot resulting from a
blow to the head, and the body subsequently was hooked up to an intravenous drip, as if the detainee
was still alive, and taken out of the prison, Reese recalled. There is no known record of what happened to the body after that.
Reese's testimony came during the first day of an investigative hearing for Spec. Sabrina Harman, one of seven Army reservists from the 372nd charged with abusing detainees at the prison late last year.
During investigations of alleged abuse at Abu Ghraib, statements by other witnesses have described the death of the detainee, and the corpse appears in photographs documenting abuse at the prison. But no testimony or evidence had previously indicated Pappas was in the shower room on the night the detainee died.
During an earlier hearing for another soldier in the 372nd, Spec. Jason A. Kenner testified that a Navy SEAL team and officers from other government agencies -- referred to as OGA, a common designation for CIA operatives -- brought the detainee in alive with a bag over his head. Kenner said he later saw that the man had been severely beaten on his face.
Intelligence officers took the detainee to a shower room used for interrogations, Kenner said, and shackled him to a wall. "About an hour later, he died on them," Kenner testified. "They decided to put him on ice. There was a battle between [OGA] and MI [military intelligence] as to who was going to take care of the body. A couple days later, he was finally disposed of."
