CID Report: 0374-04-CID093-65446

A Colonel new to a military Company found movie entitled “Ramadi Madness” on the hard drive of the combat Company’s computer in the Company’s facilities in St. Augustine, Florida and reported the matter to CID. The movie was a composite of several video clips of wounded enemy prisoners of war (EPW) flexi-cuffed on the ground; a soldier kicking a prisoner in the face; a flexi-cuffed EPW being interrogated; and a soldier holding prisoner as he struck him in head with rifle butt. A sergeant admitted to compiling the video in January 2004. The Colonel, who reported the discovery of the video tape, had only recently taken command of the Company, and was not part of the Company when the video was made. The investigating CID officer determined that the video contained “inappropriate rather than criminal behavior”, and the investigation was terminated because there “would be of little or no value or leads remaining to be developed [that] are…significant” in part because the personnel who would be criminally implicated are no longer in the military, and only federal, not military, charges would be applicable and/or pursued against them now that they are civilians.

Q-When viewing the video, do you recall approximately how many separate segments there were during the
time you watched it?
A-I saw three titles, the editor put titles at the beginning of each segment there was a title in big blue headlines,
then it would fade out and the footage would begin. I know I saw three or four titles. The person who edited
this put a lot of work into it.
Q-Have you ever viewed or heard of other video media of the same type within this unit?
A-No, as a matter of fact I believe that the guidance or directive from Public Affairs pertaining to this type of
footage was if soldiers took cameras overseas while deployed, the footage would be Government property,
Q-Did it appear the footage you viewed had been recorded by the same person?
A-Yes, the soldiers that were showing it, SSG =and SFC=tated the person was in their unit.
Q-Were any of the individuals depicted in the footage familiar to you? =/,=b(7)(.4)41,
A-Not to me. I only know the Commander and ISG of the unit; in the video I saw, neither of those two
appeared. It looked like Squad/Platoon level activities.
Q-Were any of the individuals who were watching the video actually in the video segments you saw?

4 A-I could not tell. I don't know them well enough. About half of the video seemed to be shot at night and I wasn't able to make out all of the people in the video. I wasn't close enough to the screen to see the name tags
)
,nand faces. BothaMli, 41011110 andalleallielwere in theater during that time because they were talking about "when we did this" and "when we did that". Q-Who is the highest ranking person within the unit that you know of that is aware of this video? A-SFCalMillas the highest that I know of in the unit. MAT 41.1111111110is part of the Air Defense Artillery so isn't in their unit, but he was there and knows of it. =,
b (4)16 6tr)Cc.-) Li) 5""
=Q-Does the Battalion Commander know of it's existence? A-Not that I'm aware of. I can't be certain, but the day before, SFC.Mailb stated "don't mention COL
41.10118.1 name around here, you won't get any cooperation by saying that name". Q-Knowing the position you hold in Public Affairs, weren't any of the individuals showing the video somewhat apprehensive about watching it in your presence? =bb, 5-b&) (G)5 A-They knewas retired Army and had been in the Gulf War, SFC1111.1111111becarne apprehensive but S SG didn't seem apprehensive at all. Q-Did you observe a time/date stamp anywhere on the screen while viewing the footage? A-One of the segments showed October 2003, but I didn't see it on the other segments; either the guy who filmed it took it out or never had it there to begin with. Q-Was the audio on the tape over-dubbed or was it real-time with the footage? A-It was all from the event. The person who was taking the video would often comment, narrate or even ask the people in the video to do things. Q-Did anyone mention where it was filmed? A-Yes, the people were reminiscing when they were watching it and would tell each other where it was. I don't really recall any of the places they were speaking of because f wasn't there (where the video footage was taken) and was only in the room a short time. Q-Please describe the computer you viewed the footage on. A-It was an off-white, older computer, had a large monitor. Had a tower on the floor against the wall. It's the computer assigned to SS

Q-What type of computer program did the video appear to be playing on?
A-Windows Media Player possibly, There was no frame around the picture as it was set up for full-screen.
Q-Were the images clear on the screen or kind of fuzzy?
A-The daytime footage was very clear. The night-time footage was a little fuzzy. Whoever did this knew what
they were doing.
Q-Did the titles between segments mention any names? =b(')S; be-i26-) 5-
A-No, they were all kind of irreverent phrases of what was to come. It was all dark-humor.
Q-In your handwritten portion, you mentioned that SFOOMIMMINImentioned while watching the video that
the wounded man eventually died and "we weren't in any hurry to call the medics." Did he indicate to you that
he was physically present during the incident that was captured on the video?
A-I got the impression that he had been there. He may have also been referring to it as though that was the
standard way of doing business in that type of situation.
Q-To reiterate, please list all of the people present when you were viewing the video of the alleged abuse.
A-The video was initiated by SSG.11111111, SSG1111.11111111111 who was in PT clothes, SFC =sat in
the chair and explained to MAJ alionewhat !was going on in the video,=ba)41,,, .5-

Readiness NCO/Platoon Sergeant, B Company, 1st
On 23 Jul 04, YA terviewed SEC= Battalion, 124th Infantry Regiment, 53d Infantry Brigade, Florida Army National Guard (FLARNG), 3193 Gun Club Rd., West Palm Beach, FL 33405. SFC.1111111111advised that at the end of the unit's drill in July, he could not remember the exact date, he observed SSG ,5 (NFI), B Company administration NCO, MAIMININI, (NFl), the reserve center facility manager and Mr. =(NFl), FLARNG k Public Affairs Office, were watching a video on SSGaillioffice computer. SFC410.111110stated the video was a collection of vario
' events that had been filmed by various unit members during the unit's deployment in Operation Iraqi Freedom. SFC stated he watched only a couple of the episodes on the video and did not watch the entire video, as he was answering telephone calls and conducting bther end-of-drill business during the same time. SFC1.1111110 stated he did explain for the benefit of MAJOINIIIIIIand Mr. one episode on the video that depicted a raid that his asisio platoon conducted, during which an Iraqi civilian was shot and only
further stated that he did make the comment that they had not been in any hurry to obtain medical aid for the injure
)' injured. SF(=
Iraqi; however, he was not serious and, in fact, the video showed the platoon medic, SG1111111.11111(NFT) evaluating the Iraqi's injury. SFC=stated he did not have a copy of the video and as far as he knew the video was still on SSG elraiaoffice computer. See sworn statement of SF =for additional details.
& (4)1 / q,5-bC7)(6) ij 4 SA.11.110and SFC1111./111. subsequently viewed the video on SSG eallialcomputer and SFC amilli identified the person taping the video as SGT = (NFI). SFCSINSMIlidentified others in the video as himself 1SGOIllilanla (NFl),
SPC 1.111111111(NFI), SSG =SGTIONINIS SPC11011.(NFI), SPC1111/1.11 (NFI), SPCOMIlla(NFI), SPC
dposioNFI) and SPC/11.110(NFD. During the episode a soldier kicks the Iraqi that had been shot, as the Iraqi is lying on the ground handcuffed. The face of the soldier kicking the Iraqi is not visible; however, from the appearance of the gear (in particular a non-iss u type of rifle sling) worn by SFC.1111111011116 a frame a few seconds before the kicking occurred (where SFC =able to clearly identify himself), it appeared that SFC was the soldier who kicked the Iraqi. At that point, SF =was advised of his rights, which he waived, and stated that he agreed that it appeared that he was the soldier who kicked the Iraqi; however, he did not remembe doing so. SF !further stated he did remember being annoyed by the Iraqi's continual loud moaning and telling the man to be quiet. SFC=stated the rifle sling visible on the soldier doing the kickingwas unique to him and SOTIMININIand SGT
=111
as doing the filming; therefore, it could not have been SGT =
'eking the Iraqi. See sworn statement of SFC or additional details.=b14) --.5 b(7)Cc-) Li 5-'
