A detainee claims that he was in a vehicle with other Iraqi men who possessed AK-47s. The men attempted to avoid a road-side checkpoint and were stopped by US gunfire. While the men were detained at the roadside, several Iraqi civilians began to attack and accuse the men of rape and murder of an Iraqi woman. The US soldiers stopped this attack and questioned the men with the aid of an interpreter. The men denied the accusation. The men were then transported to an unknown location where they were they claim they subjected to disco-type music, and was told "The big Satan will beat you". The detainee and the other men were then transported (without incident) to Abu Ghraib prison where they again claim to have been abused. The investigation showed them men were under constant control during this time and there are no corroborating witnesses or medical evidence to substantiate their claims. The investigation determined the claims of abuse to be unfounded.

On 17 Dec 04, this investigation was closed Final (C), insufficient evidence to.prove or disprove the offenses occurred as alleged by MIMS IMMIN, ala or kl imme Interviews of the involved U.S. personnel and the detainees disclosed the

detainees sustained injuries during capture by Iraqi civilians present when they were apprehended. The Iraqi civilians accused the detainees of kidnapping and murdering their daughter.
(U) On 24 Mar 05, this office received information from the Operations Officer, 11 th Military Police Battalion (CID) (FWD), Camp Victory, Baghdad, IZ, reporting receipt of request for Correction. (RFC) (0154-05-CID001) from United States Army Criminal Investigation Command (USACIDC), which stated a review of this investigation had been conducted and determined there wereadministrative and investigative deficiencies.

vehicles waiting at a checkpoint: There were three AK-47 rifles in the vehicle and the occupants feared being detained because of the weapons: They attempted to turn the vehicle around in the street.. There was a shot fired and they stopped' the vehicle. The occupants were removed from the vehicle, bound with plastic restraints and laid on the side of the road.' An Iraqi and two Iraqi women arrived and the Iraqi man began punching the restrained men telling them "you killed her." When the Iraqi man finished hitting the restrained men, an American soldier dressed in the DCIJ to4 eacch`r n seParately to a farm bUilding located approximately 10 meters from the road. When
was taken to the farm, he was taken into a room where four American soldiers and one translator of unknown nationality were waiting: After he w p ce in the room, the five men began hitting him and telling him, "YOu are the killer." did not know who the woman was that they were talking -about and they did not tell him. : He was beaten for about 30 • minutes and was returned to the roadside. He could not provide any additional details pertaining to the descriptions of the room and the occupants. About 10 minutes later, he was blindfolded and placed into the back.of a HMMWV and was transported to an unknown locatiOn. He could not provide any details as to the direction or distance to this unknown location. He was given food, water and was allowed to sleep. At about noon the following day, he was blindfolded once again and taken to a second unknown lOcation. He could not provide any details as tá the direction or. distance to this unknown. location. At this location, he was blindfolded and bound with plastic restraints and punched, kicked and hit with chairs. He did not know how many people were assaulting him, but remembered they were playing disco-type music, He said at one point, the translator told hiM, "The big Satan will beat you" and partially removed the blindfold from his eyes and a man that he could not see hit hirn. Moments later, his blindfold was lifted again and he was shown a picture of an unknown woman and asked if he knew her and did he kill her He told them that he had never seen her before. He was beaten again and then transferred to a third locatfon with no incident. He could not prOvide any details as to the direction or distance to this unknown location. About 1225, 20 Aug 04, with the assistance of Mr. , interviewed
who stated he was captured by CoalitiOn Forces on 23 Jun 04 on Ibrahim al Ali roa inlaghdad, Iraq. He and four other detaineeSwere stopped in a line of vehicles waitit at a checkpoint. There were three AK-47 rifles in the vehicle and the occupants feared being detained because of the weapons. They attempted to turn the vehicle around in the street. There was a shot fired and they stopped the vehicle. The oCcupants were removed from the'vehicle, bound with plastic restraints, and laid on the side of the road ,. A vehicle drove up and an Iraqi man and two Iraqi women got out, there was a boy (about 13-14 years old) in the car. The man beat each of the five restrained men in succession and asked, "Where did you take the woman?" One of the women said to him ; . "They are not the men, they are five and there was only four. And their car has plates the other car did not have plates." The man told her, "This is not your business, go back to the car." This man and an American soldier in uniform took the first man to a farm located about 15 meters away from the road. He could hear each man screaming from the farm, and when he was returned, the next man was taken to the farm. He heard the screaming and he too was returned. The same happened to the third man, but when he, returned, all five men were blindfolded and placed in HMMWV's and taken to an unknown location. He could not provide any details as to the direction or distance to this unknown location. They were given orange/red jumpsuits and placed in separate cells. The following day they were all gathered into a single cell, blindfolded and transported to a second unknown location. He could not provide any details as to the directionor distance , to this unknown location. Upon arrival, he was interrogated by an American soldier in DCU's with the American flag. He described the man as tall thin, white male, clean-shaven, with light colored hair and did not wear glasses. The man told him a woman had been kidnapped and asked where she was. He told the man he did not know anything about the situation. The man became angry and he was sent to a room and he could hear the other detainees were also the room. He said he was beaten by a group of people of unknown size and nationality and he could hear the others being

beaten as well. He said he returned to the room with the interrogator and was asked again about the missing woman. He told the man he did not know anything and he was returned to the other room and beaten again until sunset. He could not provide any additional details pertaining to the descriptions of either room. He was then bound and blindfolded and taken , to a third unknown location and was placed in a single cell. He could not provide any details as to the direction or distance to this unknown location. He stayed there for seven to nine days and was interrogated three separate times on three separate days but was not beaten: He was then transported to AGI.
He said he was seen by a doctor at the third location but had not received any injuries and did not require any medical treatment.

The translator was an Iraqi manpearing civilian clothes and had a "pure" Iraqi accent. .He could not prbvide any detailS pertaining to the description of the room. When he was returned to the road, he remained there for approximately 10 minutes. He was given water byan American soldier and was then blindfolded and placed in the back of a HIV1MWV. He was transported to an unknown location. He was given an orangeked jumpsuit. He could not provide any details as to the direction or distance to this unknown location, He was given food and water and allowed to sleep. The following day he was blindfolded and transported to a second unknown location. He could not provide any details as to the direction or distance to this unknown location. The man asked him about the location of the missing woman. At one point the interpreter told him, "Raise your head, you are an Iraqi." He replied to him with "I do not have the honor -to be an Iraqi now." He could not describe the men because he was blindfolded during the interrogation and there was nothing distinct about their voices: He could not provide any details pertaining to the descriptions of either room. He was returned to the room with the other detainees and transported to a third unknown location. He could not provide any details as to the direction or distance to this unknown location. He `remained there for nine or ten days and was interrogated twice during that time He was then transported to AGI. He was seen by a doctor and received medication for ear pain, but did not receive any injuries as a result of the beatings.

An Iraqi man dressed in civilian clothes arrived at the checkpoint and approached the.men and he and another Iraqi man dressed in the DCU uniform kicked and punched the men while they were on the ground. Two soldiers took three of the men to a nearby building separately and he heard yelling and screaming. He was not taken to the building and did not see what the men looked like, he only saw the hands of the men as they were reaching down to grab the man next to him, and noticed one was black and the other was white. All of the men were picked up, blindfolded and walked over to the HMMWV's and put into the trunk. They were transported to an unknown I. location. One man pulled him out of the trunk and dropped him on the ground and he landed on his head, The man picked him up and walked him to a building or tent. As he was leading him by the
