On 9 Aug 04. this investigation was initiated upon receipt of Memorandum of Transmittal
(MOT) (012404CID25980294) from the 75 111 Military Police Detachment (CID). Baghdad

caused the entire convoy to be disruy .. soldiersW become totally disoriented. At the time of the attack, PFC Headquarters Service Battery, 1 st BN, 82 Field Artillery, FOB Cuervo, APO AE 0373, was in the gunner's hatch. The blast, which disoriented him also, engulfed his face in flames, blew his Interceptor Vest operl and shoulder guards off, and knocked him down into the vehicle. AE 09373 (FCAA). of his legal rights which he waived and provided a sworn statement detailing the details of his convoy. a VBIED on 29 Jul 04 while transporting detainees to Abu G. t: related after the explosion occurred he attempted to ki e ( whom was the detainee in his vehicle being transported. Basis of Investigation: On 29 Jul 04, this office was notified by the 391 st Military Police (MP) Battalion (BN) Opqratiqp§,,B,aghdad Central Confinement Facility (BCCF), Abu Ghraib, Iraq (AGI), that Detainee , Internment Serial Number (ISN) # alleged he was hit with

rifle, while being transported to BCCF.

who stated bruising was now present under Fight which would be consistant with a blow to
the eye a day prior. He stated the appearance of an infection could have been caused if the stock
of the rifle was dirty or if the detainee had a dirty cloth around his eyes. He stated it could have also
been cause by irritation from the detainee after the incident. DR. bstiuirs tated the bruising

About 1000, 29 Jul 04, SA with the assistance of Linguists/Er interviewed who stated he was captured on 17 Jul 04 in Baghdad, Iraq. He was detained at a US controlled facility he called Rostemia, near a Military College. He left enroute to BCCF sometime after lunch. He was riding in rear driver's side seat of what he thought was a four seat HMMWV. His hands were tied in the front and his eyes blind folded with a cloth tied around his head. He was unaware of which vehicle he was riding in. He could not describe the personnel who were transporting him, other than they were speaking English. He stated that while riding he heard a large explosion and then the vehicle stopped. He said about four minutes later someone opened the right rear door of the vehicle and hit him in the right eye with a hard object, he thought to be a "rifle butt". He said he
was then hit in the right thigh twice with the same object He said about 15 minutes later the vehicle
began to move and he soon arrived at BCCF He said he reported it to the soldier at the front

About 1040, 30 Jul 04, SA stated he was captured on 17 Jul 04 in Baghdad, Iraq. He was detained at a US controlled facility he called Rostemia, near a Military College. He left enroute to BCCF sometime after lunch. He was riding in rear driver's side seat of what he thought was a four seat HMMWV. His hands were tied in the front and his eyes blind folded with a cloth tied around his head. He stated he could partially see from under his blindfold. He stated he was riding in the middle vehicle, which was damaged by the explosion. He stated he could see the uniforms, which were the camouflage of the US Army. He said as they were traveling, the vehicle stopped. He heard what appeared to be a warning about a vehicle on the roadway. He said the vehicle started again and then he heard and felt a large explosion. He said the he heard someone say, "Go! Go! Go!" and then he saw and felt the soldier in the turret fall on him. The vehicle then stopped. He said he asked the soldier on top of him, "Mister, are you OK?" The soldier then said, "It's all because of you mother fuckers!" and began to punch him in the head. He said the soldier the got up and began to exit the turret, while kicking him in the head. He said what he believed was the same soldier open his door and "butt stroked" him in the left eye. He said his blindfold was still on but he could see the soldier's legs and the soldier holding a rifle. He said after the soldier hit him, he saw the soldier charge the rifle bolt. 1111•1111said some other soldiers then held the one soldier back. After a few minutes one soldier he was ok and then the vehicle began to move. He said they then arrived at BCCF.

Vehicle Born Improvised Explosive Device (VBIED). He stated the unit delivered three detainees, o which none made complaints to him about being hit. He further aclyised that it is pros ed to examine each detainee for bruising or scars. While examiningalill .he observed ight eye appeared to be irritated and he asked if his eye had any pain. desponded that it did not hurt. He further related no soldier from the escort team mentioned any incident involving the detainees. He stated that he took pictures of the vehicle and would provide them to this office. He also gave the name of the lieutenant in charge of the 1 st Cavalry convoy that transported the

428th MPAbout 1400, 31 Jul 04, SA interviewed MSG
Company, BCCF, AGI, who stated he was in the convoy which had stopped prior to the vehicle and
had sat up a protective perimeter. He was in the turret of the third vehicle, when he saw a convoy
stop at the lead vehicle and then begin to drive towards the suspect vehicle. He said he saw the
explosion but did not see any activity of the other convoy after the explosion, due to checking
soldiers in his convoy. He stated that no one from his convoy went to the location of the other
convoy and it's location was about 200 meters away. He stated that even if he was looking, he
could not have seen any activity in the other convoy.

About 1530, 31 Jul 04, SA interviewed CPT (DR) NW 785th Combat Stress Company, BCCF, AGI, who stated that during his conversation with PFC 41111111.he never mentioned anything about detainees, but did state that he was in the turret of the second vehicle in the convoy. THEIR DETENTION AT THE BCCF.

PRELIMINARY INVESTIGATION DISCLOSED MR allipAND MR 110110
ALLEGED THEY HAD BEEN ASSAULTED WHILE BEING TRANSPORTED BY

BORNE IMPROVISED

U.S. FORCES TO THE BCCF AFTER A VEHICLE
EXPLOSIVE DEVICE ATTACK (VBIED).

RELATED AN

ON 30 JUL 04, MR MOP WAS INTERVIEWED AND

SOLDIER HIT HIM IN THE FACE WITH A RIFLE BUTT.

UNKNOWN US

SUBSEQUENT MEDICAL EXAMINATION REVEALED THE INJURY TO MR

-EYE COULD BE CONSISTENT TO BEING STUCK WITH A RIFLE
BUTT AND THE INFECTION TO MR £ EYE COULD HAVE BEEN

CAUSED IF THE STOCK OF THE WEAPON HAD BEEN DIRTY AND OR THE
HAD A DIRTY CLOTH AROUND HIS EYES.

ON 30 JUL 04, MR.

UNKNOWN US SOLDIER HAD ASSAULTED HIM SHORTLY AFTER THE
VEHICLE HE WAS BEING TRANSPORTED IN HAD BEEN DAMAGED BY A
VBIED ATTACK. MR SIIIMPRELATED HIS HANDS WERE TIED IN FRONT
