A detainee claims that after he was apprehended, but before being detained at Abu Ghraib prison, he was brought to an unknown facility (presumably the Baghdad International Airport), interrogated and beaten. The report confirmed the detainee was picked-up on July 6, 2004, but the personnel involved were found and denied abusing the detainee. In addition, the injuries the detainee claims to have sustained, i.e. a bleeding rectum due to being kicked, was not complained of nor discovered at the medical screening upon entry to Abu Ghraib prison. Therefore, the report concluded there was no probable cause to believe the offenses occurred as alleged.

also claims he was forced to clean the toilets with his bare hands and was denied t oppo imity to wash his hands after accoMplishing this aisignment. According to Detainee the translator told hirri that lie was mistranslating his responses because he (the translator) was a Shiite and lie (the detainee) was Sunni.
Detainee described the interpreter as a male mid-eastern, aPproximately 35 years of age, 6'0", 180, medium build, black hair, dark eyes, with a full , black beard and moustache. Further he said the interpreter always worn civilian clothes with standard, DCU combat boots. Detainee

stated the interpreter spoke Arabic with an Iraqi accent. He said he believed he could identify him if seen again.
Detaineelli stated he had not been abused since arriving at BCCF. He did i

I left Fort Bragg on 10 Jul 04, flying out of Pope and stopping in Germany over night I arrived at Ba I ,
Ai ' O " 12 -Sul 04 and Werglg, the facility which was right near the tarmac. I remember Mr
I interviewed Mi I about ten times when he was at the facility. Every time I interviewed him an interpreter
was present All questions Were asked in English and translated into Arabic and all answers were translated from Arabic
to English. All interrogations consisted of one interpreter and one interrogator in the room. There was a second .
interrogator either in the room or monitoring the cameras from another rooin. -Interrogators and translators were not
permitted to touch the detainee in any way as per SOP. They were escorted to and from the interrogation room by the
guard force. The detainees were brought to the interrogation room for us. II physical and biological-needs_weeMINF
pertaining to the detainees were taken care of by the guard force. Mi as made to clean the bathroom after he
had urinated on the floor and seat He was given gloves and cleaning supplies and allowed to clean himself up
afterwards. There was a sink and hand soap present and the guard insured the detainees wash their hands after using
the latrine. The individual cells did not have latrines : There was one centralized latrine for detainees and if they
messed it up they had to clean it up. Routine maintenance of the latrine was done by the guards. Detainees were
informed that if they messed up the latrine they would have to clean it I never saw any type of physical contact between
an eter or interrogator and Mr41111111, There were severalailop interpreters to chose from and each time I interrogated

M had a different interpreter in the room with me..I speak fluent Arabic and at no time did the Interpreters
deli erately miss-translate vagap I was conducting an inteusgation. SOP mandateakat I utilized the translator for my,

A:I could not say. I did not have a specific interpreter for my interrogatiOns. There were no rec ds kept as to whichinterpreter assisted in the interrogations. Only the guards who moved the detainee and the interrogator were annotated on the detainee's log. Each detainee had their own log on the outside of their cell door, which reflected each time theywere talked to by an interrogator or guard and each time they were fed, mOved, or went to the bathroom. I do not know what happens to the list after the detainee leaves the facility.

A: It could have been anyone on the shift.

Interrogators and interpreters have been interviewed and denied any abuses occurred during any of the interrogations.

Medical records do not reflect any unusual injuries or issuance of medications as detainee claims. Medical reports clearly indicate healthy with. no existing medical conditions requiring follow-up

4.
Review of guard logs and statements indicate detainee was an unruly detainee who was constantly trying to provoke guards and causing problems. There were numerous false medical claims wherein the detainee would request to see a doctor to avoid additional interrogations. Statements indicate medical personnel checked all prisoners nightly and continually cleared this detainee for further interrogations.

5.
Based on statements, logs and medical reports, there appears to sufficient supporting evidence that the assaults did not occur as the detainee claims. Recommend closing this investigation as there is a documented history of this detainee making false claim of medical problems and provoking guards.

Any criminal investigation where the remaining leads to be completed are best conducted by another criminal investigative unit, office or organization will have 2 nd Status Reports completed referring the investigation to HQUSAClDC. After the 2 nd Status Report is dispatched the investigation will be written Final Referred, reviewed by the Team Chief, Special Agent in Charge and Detachment Commander, before being closed and sent the HQUSACIDC. Once received by HQUSACIDC it will be determined which investigative agency is best suited for completing the investigation (i.e., and the investigation will be forwarded to them.

2. This office is currently conducting an investigation of Aggravated Assault and Cruelty and Maltreatment. Between 18 Jul 04 — 10 Aug 04, this office received Memorandums of Transmittal 0082-04-C10789 and 0126-04-C10789, from the Prisoner Interview/Interrogation Team (PIT), 75 th MP Det (CID), Ba dad. Central Confinement Facility (BCCF), Abu Ghraib,
)C 7)a)-9 IZ, regarding allegations Mr and Mr. were abused by U.S. Forces while ciociyo-9, (Oa. )te they were detained at Baghdad International Airport (BIAP).
3. Preliminary investigation. revealed coalition forCes captured Mr..11111111fon 17 Apr 04, and detain "in for approximately 14 days in the Peyala Province. After whic
was transferred to an unidentified detention facility at BIAP. Mr. alleged during his four days at BIAP, he was not allowed to utilize the restroom at his convenience and had to urinate on himself. Mr111111111111/alleged sometimes two people (NFT) would come to his cell and push him against the wall and strike him in the shoulder. Finally, Mraillatalleged the restraints placed on wrists caused his wrists to bleed.
4.Preliminary investigation revealed coalition forces captured Mrillilori 6 Jul 04, and transported him to an unknown location, which he believed to be BIAP, w -- alleges he was 047)&4kicked and punched during interrogations by an interpreter/translator.
