Report of investigation of detainee’s allegation that a male U.S. soldier had slapped him across the face, causing him to bleed from the nose or the mouth and pushing him into concertina wire at the base of a chain link fence, causing the detainee to cut his left ring finger. The assault occurred after a female U.S. soldier at Abu Ghraib Compound Cougar 3 shouted at the detainee to wake up, using profanities. It appears that the female soldier was counting detainees, following an earlier escape attempt by three other detainees. The victim responded to the female soldier’s command to “shut up” by telling her to shut up, after which the male U.S. soldier entered the fenced-in compound and struck the detainee across the face.

Several other detainees and another soldier corroborated the victim’s account. The male soldier denied slapping the victim, but acknowledged pushing the victim down. Investigation concludes there is probable cause to believe the male soldier had committed the offense of assault consummated by a battery. The commander stated his intention to take action amounting to less than courts martial.

a hand drawn sketch of the location where the incident occurred and a copy of a Memorandum for
Record (MFR), which he wrote detailing his knowledge of the incident. (See Sworn Statement,

About 1400, 02 August 04, SA wow and Interpreter llialrP, Titan Corporation, BaghdadInternational Airport (BIAP), Baghdad, IZ, interviewed Detainee , Interment Serial Number (ISN)1111.111P, at compound Cougar 3, BCCF, concerning an allegation of detaineabuse. Detainee stated that between 0200 and 0300, 04 Aug 04, he was asleep adjacen to the northwest corner of tent 1, compound Cougar 3, behind the concrete air raid bunkers, when he was awakened by a female US soldier yelling at him to wake up. The female soldier was standing outside the fence of the compound. The female soldier was yelling at him to "sit-up, sit­up." Detainee MEM said he believed the soldiers were trying to do a count of the detainees. Detainee aid he stated to sit up when the female soldier started to curse at him. He said he asked her what had happened and she told him to "shut up." Detainee 111111111111111, said he yelled back at the female soldier to "you shut up." At this time, a male US soldier entered the compound, came over to him, and slapped him across the face. Detainee 111111=111110said he believed the male soldier slapped him with an open, right hand. Detaineel....said the blow caused him to bleed from either the mouth or nose, and it pushed him into the concertina wire at the base of the chain link fence and caused him to cut his left, ring finger.
.14 Detainee.described the soldier who stuck him as a male, dark complexion, average height, stocky build, with a thin moustache, wearing eyeglasses, desert camouflage uniform (DCU), Kevlar helmet, and green flak jacket with numerous pouches. He did not know the soldier's name, but he has seen him working the night shift frequently. He believed he would
recognize him if seen again.

detainees related a similar incident in which detainee ' _ was stru ck in the face by an MP
Guard. They each stated that after the escape attervt by three other detainees, they and the otherW detainees were woke up by the MPs. Detainee 11111..was standing next to the fence near the W0-3 bunkers being yelled at by a female MP. The female was using bad words as she yelled. Detainee
11111111Pwas talking back to her, when a male MP came from outside the fence into the fenced in

and the mail MP struck Detainee min the face with his left hand. They were unclear as to
whether the hand was open or closed. Each detainee said he was only struck once.

There was a lot of yelling and then a male soldier came into the compound and approached Detainee 111111111111110who sleeping outside the tent by the concrete bunkers. The soldier yelled something at Detainee 1111111111111111. and then stuck him in the face. Detainee 111111111111111Pcould not tell why the soldier struck Detainee .Detainee .111111111111111111111Mescribed the soldier as male, wearing DCU's, a flak jacket, and a Kevlar helmet with goggles on the top.

Shortly afterwards, 6E4,-5 male soldier entered the compound and went over to where the concrete bunkers were positionedDetainees said he heard some yelling from that direction and then a slap. who had been slapped or why.

I was headed from the tent 1 to the shower
point..

I saw a female MP running the same direction as I was headed
inside Cougar 3 yelling..

I could not understand what she was saying, but
from her voice,.I passed the shower point

I could tell she was female..
and reached the Rec area,.toward Cougar 3,.

and I looked east,.and saw
approximately six MPs standing outside the wire yelling at the detainees
to calm down and remain in place..

I could hear the detainees yelling, but
I could not tell how many there were because the lights were off, and I
could not understand what they were saying. .

The detainees were outside
their tents between the wire (fence) and the their tents up by the gate to
the compound..

There was a single detainee who was at the opposite end of
the compound away from the gate, but down by the detainees'.

A: Yes.

Q: About how far from the incident were you?

A: I'm estimating about 20 or 30 meters, but I cannot be sure.

A: No. The 301st MP, 152nd FA, and the 391st MP all do guard mount at the
same time.

Q: Do you remember seeing the MP who struck the detainee at guard mount?

A: No.

During the early morning hours of 02 Aug 04, I was on-duty as a guard
compound Cougar 3. We came on duty shortly before midnight and took our
posts between 0015 and 0020. I was working a roving patrol in the fronts
of tent 1 and 2. The evening had been pretty quiet up until 0200 when
three detainees escaped from tent 1 of our compound. They cut the fence
at the northwest corner of the compound. SPC UMW who was sitting east
of tent 1,by tent 3, saw a male stand up between the compound fence and
the perimeter fence. SPC IMMINPbroadcast on her radio that some detainees

were trying to escape. When I heard her call, I was between tents 1 and

2. I immediately ran around to northwest side of tent 1 and found three

detainees lying on the ground. SPC OMMIMPand I handcuffed and searched .the three detainees. We lead them to the front of tent 1 and separated because we were going to place them in other tents. I knew that the detainees had come from tent 1 because I recognized one of them while we were handcuffing them. While we were doing this, SPC UMW saw the whole in the fence. SPC amp was positioned to watch the whole in the fence to
prevent any other detainees from escaping. I was up front with the
escaped detainees when I heard SPC 100110yelling at one of the detainees.

I could hear them arguing. SPC was telling the detainee to "shut

up," and the detainee was yelling back, "No, you shut up." I went back to
see what SPC UMW was doing and I asked her what was going on. SPCOMMMI
told me she was arguing with a detainee who was eying the hole in the
fence and refusing to turn around and not watch the fence. I told the
detainee that he needed to comply with SPC 111111111M5 instructions and "shut
up" when she told him to do so, and he said, "Fuck you, mister. You shut
up." I asked the detainee to repeat what he said and he just looked at
me. At this point, I walked around the compound and went in the gate. I
walked up to the detainee who was seated on his bed of sandbags next to
concrete bunker, and told him that he needed to comply with our
instructions. The detainee would not reply and he just gave me a very
defiant stare. At that moment, he reached down, braced his hands on the
sandbags, leaned forward, and started to propel himself upward toward me.
I thought he was either going to jump me or push me backwards into the
concertina wire that was at the base of the compound perimeter fence. I
instinctively raised my left hand and shoved him down by placing my left
hand on his right shoulder and pushing. That forced him back down on his
sandbag bed. I then stepped back and warned him not to assault me. The
detainee sat back down and placed his head in his hands and said, "Yes,

No problem." I turned and left the compound.

A: No, I raised my hand and pushed him down because I thought he was getting ready to assault me.
Q: Why would other soldiers and detainees who observed your actions say that you slapped the detainee?
A: I don't know. It could have been the distance they were from me when the incident occurred.
Q: Could you have brushed the detainee's face when you pushed him down?
A: I don't know. I could have; it was just a reaction to get him down. It's hard for me to explain because it
happened so quickly.

Q: Do the detainees frequently challenge the authority of the MPs?
A: Yes.
Q: What are your instructions concerning handling uncooperative detainees?
A: It depends on their level of aggressiveness. If they are just uncooperative we take away privileges — ice
water, cigarettes, and things like that.

Q: What are your instructions about laying hands on detainees?
A: Only in self-defense. I don't even like to touch them when I have to hand cuff them.
Q: Would slapping a detainee be against your policies?
A: Yea.
Q: Have you ever had a problem with this detainee before?
A: No, not me personally, but I knew he had a reputation of being a troublemaker. I know that he's a rock
thrower too.

Q: When you pushed the detainee did he end up in the concertina wire?
A: No. Not even close to it.
Q: Do you know anything about a cut on the detainee's left hand?
A: I heard about it at the end of watch. He complained to the NCOIC that he'd cut himself on the concertina wire. I think the NCOIC told the medics to look at him.
Q: Why did you feel the detainee was going to assault you?
A: The defiant look he gave me, the way he braced himself to stand and his hostile attitude toward our instructions and the MPs in general.
Q: Why did you feel it necessary to push him back down when he tried to stand up?
A: It was just a quick reaction to his moves. At that very moment I felt threatened by his actions.
Q: Why did you feel it was necessary to go into the compound when he was arguing with SPC .
A: I wanted him to move away from the hole in the fence and he was refusing to comply with SPCIVM/MW orders.
Q: Had you heard SPC order the detainee to move to the front of the enclosure?
A: No. I only heard him arguing with her about being quiet.
Q: How close to the hole in the fence was the detainee?
A: about eight to 10 feet.
Q: What were the lighting conditions like in the area where the encounter took place?
A: Shadowy for me, but the surrounding area was pretty dark.
Q: Do you have anything to add or change in this statement?
A: No. I think we've talked about just about everything.

want to make the following statement under oath: I am making this statement freely. At approximately 0200, 2 Aug 04, I was posted at tent three in Cougar three and was getting ready to conduct a perimeter check. I noticed movement along the High Risk Detainees (HRD) wall near tent one. I stood and took a couple steps forward, at which point I realized .ovement was from a detainee. I started running toward the detainee and informed the NCOIC, SSG.giy radio, that there was a detainee out. As I got
closer I yelled for the detainee to stop, and realized that there were actually three detainees and they did stop. I and the other MPs on duty arrived at the detainees' location at the same time. The detainees were hand cuffed and put into three separate tents, other than tent one. When we located the hole in the fence where the detainees had gotten out, I stood outside the fence to make sure no other detainees attempted to escape. There was a detainee sitting about 15 feet in front of me inside the fence. He was staring at me, so I asked the detainee to turn around. He just looked at me, so I told him again to turn around, using my hand to motion the action. The detainee became very angry and yelled at me to shut up. I may have -.ords. I told him to be quiet

It is very important that we as guards have total authority over these detainees. A: He is one of two that are really bad. He has never been cooperative. He yells at us on a daily basis and he hardly ever does what we ask him to do. If had an isolation booth available to discipline unruly detainees, he would be in there often. We have no means, other than taking cigarettes away, for individual discipline to handle detainees like him. He even throws rocks at us from time to time. He throws them from inside the fence at us. He even threw rocks at us that day. All we can do is tell them to stop. This is the place where the worst
detainees go. There is no other place left.
