Investigation into allegation by detainee that a US soldier kicked him in the back of the legs, back, and stomach while he was at a detention camp at Mahmodia, Baghdad. The detainee also reported he was hooded with a sandbag, handcuffed him with plastic handcuffs, and threw him into a truck, and that interrogators at this second facility placed him inside a cold and wet cell for several hours without warm clothing or a blanket. The soldier denied abusing any detainees. Other soldiers also denied that abuse had taken place at Mahmodia. CID found that the investigation failed to develop sufficient evidence to prove or disprove the detainee's allegation that he was abused.

While that was going on we were searching the grounds with metal detectors and inside the residence forcontraband, At the same time I sent a squad up to his workshop to search that as well for contraband and missiles. Nothing was located at both places. The DOD guys mentioned that maybe the buyer had not arrived yet and to hold up in another area close by with one
squad held up inside the house, so that when the deal goes down we could move in and neutralize the situation. We were waiting forapproximately 3 hours. When no one showed up, we decided to take Mr.1111111111111111ko Forward Operating Base

in MUHMADIYA, Iraq. We took him there and filled out the detainee paperwork and turn him over to the detainee cell. After that Ihad no further contact with him.

gast . 151167 w into Baghdad International Airport (BIAP). I spent about three weeks in BIAP to replace 3 ACR at FOB Voiturno (Fallujha Iraq). We stayed there until we redeployed back to Fort Bragg. My job was to drive up-armored HUMIvIV's through the city. We would scout target location for line companies. We also do counter mortar missions. I was rarely around detainees. I would sometimes be called to watch a detainee at their house while the line unit went inside to clear the residence but I never got any closer then ten feet of any detainee. I would always stay behind cover. I would sometimes transport detainees to Abu
Ghraib if they were deemed as important from our higher headquarters. While at Abu Ghraib we always stayed by our vehicles. We
had no interaction with the detainees of any kind. MP's would come out to our trucks and pick up the detainees from us. Even chow
was brought to usif we wanted to eat. That is all the interaction I have ever had with detainees.

I deployed on Approximately August 5 2003, to aghdad International Airport (B1AP), my battalion then moved south to Muhamadia Iraq, where we established FOB St. Michael. I was a rifle platoon leader, my platoon was responsible for many platoon sized platoon company sized raids in the area surrounding AL Yusufiyah. My platoon worked very hard to build a positive reportwithin the community. On several occasions local would approach us with information on weapons caches, IEDs and location of enemy personnel. Each time that we took detainees, they were processed quickly, with respect, and turned over to our battalion detention facility. Each detainee was turned over with a Coalition Provisional Authority Form (complete front and back) and a two
sworn statemen er indiyislual. No mission or activity that my platoon conducted on Jan 20, 2004, sticks out in my mind.

• rats od or about 7 Aug 2 t 03. The first place we were at was Camp Mercury, for about one month. I then went to BIAP
and worked out of there moving logistical packages down to FOB St. Michael on a every other day basis. I think it was about the
middle to end of Jan 2004 that I switched places with one of the other NCO's in the Platoon. While I was at FOB St. Michael I was the
forward Platoon Sgt for the Support and transportation platoon. My job aspect was to make sure that the ammo was distributed on

time, make sure that the vehicles were mission capable. and also controlling the shifts for the detainee cell. That consisted of making
sure that MRE's were available, latrine to use, water, and over all cleanliness. During the last week of February or the first week of
March 2004, I went to FOB Saint Mere. While there I was responsible for getting the mail and any logistical parts for vehicles. After
that, during the last week in March we redeployed to Kuwait to eventually redeploy back to Fort Bragg NC. As far as the name of the
detainee who allacasai4.. he was abused, does not ring a bell and does not stand out in my mine nor the incident of abuse.

up on that. Review the exhibit to see exactly

RFA - Prepare RFA to Fort Bragg and request they
re-interview (witness interviews) the soldiers
and determine if they know anything pertaining
to that specific matter. Once we have that, we
will specifically address it in the summary. The
statements can be verbal, unless they have
specific information that the incident did
occur. Get this one out asap.

I doubt if this will change the findings but at
least we will have addressed the matter.
