Detainee reported that he was arrested after US forces found a weapon in his home. He was detained at Al Sijood Palace, Iraq, and it was during this detention he states he was hooded; flexicuffed; punched; kicked; yelled at; and threatened. Investigation established that there was insufficient evidence to prove or disprove the charges based on the absence of medical records. The report did however interview numerous soldiers from different units who were in contact with the detainee during his incarceration. None of the soldiers corroborated the detainee’s version of events or any aspect of his alleged abuse, despite the variety of soldiers and units that were at the facility at the time. The report found that the allegations were therefore unfounded with no further action to be taken.

CPTIMIR rendered his decision 6 7C-3, I6S base on the absence ofaillitmedical records and the inability of this investigation to i c„-Ar -4( locate and interview some of the meMbers of the previous interrogation team. Further, CPTalatindicated, with the absence of medical record it is difficult to determine if the lacerations noted on the Detention Internment Facility Medical Screening Form were consistent with any physical abuse.

WANT TO MAKE THE FOLLOW/NG STATEMENT UNDER OATH: pon arnva to a ad on 20 May 2004, while assigned to G troop, we were placed in control
of the EPW holding cage at Al Sijood palace among other duties such as Brigade QRF. The troop
rotated duty at the cage every five days. On the days when my platoon had control of the cage I
was at times in charge of the cage and all operations pertaining to the cage. We were responsible
for handling, feeding, searching and detaining the EPW's who were brought to our cage from
other units within the l3iigade. The detainees would remain in our cage sometimes for up to 5
days, which means that several different people might have been responsible for that EPW
throughout his/her stay at the cage..The only incident that I could recall that a prisoner was
handled roughly was when a prisoner was denied a cigarette, so in anger he threw a rock at ,Z
ri
myself and another soldier. I entered the cage along'with ¦ also in G troop, yr
placed the EPW on the ground and zip-tied his hands behind his back and sandbagged his head.
Shortly after this, the EPW soiled himself so we re-entered the cage and cut his hands free so the 4., 3 zk,
prisoner could clean himself up. 2LTalliwas most likely the OIC of the cage at this time but /v probably knew little about this incident. Our troop was relieved of cage duty around July by an
MP unit from the National Guard or Reserves. Upon being relieved from the cage Our troop
continued our mission of Brigade QRF, convoy security and raids. We conducted a large number
of raids during the 15 months that we were stationed in and around Baghdad. When given a raid
mission, the mission statement in the OPORDER often stated "capture or kill" and then the name
of the person we were looking for When we were able to capture personnel, we would then take
them to a Battalion EPW holding cell and hand them off to the personnel operating that EPW
cage. If we were operating on our own as a troop we would normally take the prisoners back to
the Brigade EPW cage, (the same cage we had worked at).

e arrived aghdad in the end of May 2003. Our troop was assigned to BDE QRF and BDE EPW cage. The EPW cage was a tennis court with a chain link fence with C wire at the top We tied up cloth so the EPWS could have shade during the day. There was a sink in the cage with miming water. And we provided them with MBE's and bottled water. We were naming the cage in June. Reserve MP's took the cage over from us in July or August. When detainees got to the sage we would take their picture, p_lace a paper tag on their clothes with their information, and search them again. We would place their personal belongings in a bag and tag it with their information. One time there was an Iraqi man in their angry about something: He threw a rock at me and SSC," We entered the cage zip,stripped and sandbagged the detainee. A while later he started to g sick and vomit. So we entered the cage again and removed the zipcuffs and sandbag. He went to the water ancl,washed the vomit off himself.. Our troop conducted many raids. If we got detainees we would zip cuff them and place them in our hmmwvs. And transport them to the BDE cage. There we would fill out witness statements. They would be searched again, and have a tag placed on them so they wouldn't confuse the detainees. They would then be placed in the cage. I witnessed no mistreatment of Iraqis while I was deployed.

WANT TO MAKE THE FOLLOWING STATEMENT UNDER OATH: During our deployment to Iraq, my unit, G Troop conducted numerous raids in and around the city of Baghdad. During these raids we would normally infiltrate to the raid location on either huriwee's or five ton trucks. Once we reached the raid location we would dismount the vehicles and stack on the door of the target location. We would normally have at least two entry teams, and two or more security teams. Standard OPerating Procedure stated that we must announce entry by means of a bullhorn before entering the target location m order to alert anyone inside that we were coalition force§ and not thieves, thus preventing them from firing at us out of fear of being robbed. After we made our announcement we would forcefully enter the building if the occupants did not first open the door for us. If upon entering the building there were any Iraqi occupants that were not on the ground we would instruct them by means of an interpreter to get on the ground immediately. At that point in time if the individual refused to get on the ground we would forcefully put there on the ground by pushing, pulling, tackling, or using approved take-downs. All male individuals of fighting age where then zip-cuffed and or sandbagged in order to prevent them from spitting at or biting us. The individuals where then either dragged or carried out of the house and placed in the front yard and under the watch of one of the security teams. At this time we would conduct a detailed search of the house in order to locate any IED making material, weapons, anti-coalition material or large sums of money. Upon completion of the detailed search we would sometimes question the detainees in order to possibly gain valuable intelligence on the whereabouts of other wanted individuals: Upon completion of the questioning we would load all detainees and evidence back into the vehicles, gain accountability for all personnel and equipment and ex-filtrate from the target location back to the Brigade EPW cell. Once we arrived at the holding cell we would download all prisoners and evidence. The prisoners and evidence were inventoried and all material was annotated on the appropriate forms. Sworn Witness statements were filled out by at least two U.S. soldiers on each and every prisoner and signed by the platoon leader or ranking officer on location. These statements would include who the detainee was, what the circumstances of his capture were, when he was captured, where he was captured and why he was captured. We would also include any other pertinent information

such as something the prisoner may have said to us while in our custody or information the
prisoner may have given about other individuals. On 18 August 2004 while being questioned by 676i/
Investigator about the events which occurred on 5 September 2003, I was shown a grid PI/
location and asked if I could remember what may have occurred there during a raid on 5
September 2003. I could not recall a specific raid occurring on that date, since raids where an //IA;
almost daily event for most of the deployment. Also the grid coordinates where not in our sector 4P

WANT TO MAKE THE FOLLOWING STATEMENT UNDER OATH: On arrived in theater with my unit at the time, 2 BRT, lAD. Prior to being deployed my platoon conducted several days of training on the use of non-lethal force and MOUT. We were trained by other soldiers who attended a Train the Trainer's course weeks prior. This training consisted of effective take down methods used by Police officers when attacked or put in a situation where you must take positive control of another person. We also went over personnel searches and the use of Flex cliffs. Using at least a two man team one soldier would provide security while the other soldier searches and secures the EPW. This same training was refreshed at the platoon level throughout the deployment. On 22 MAY 03 we arrived in Baghdad and began our Relief in Place with 2 BRT, 3ID. At this point the 3ID had already created an EPW cage, using an old tennis court that was surrounded with 20' high fencing. When we took over this cage we immediately began improving conditions for the EPWs. Adding an opaque fabric wall around the perimeter and putting up fabric over head cover to keep the sun exposure down to a minimum, We then added a latrine and shower facility along with cots and blankets. All EPWs were un-cuffed before being put into the cage and were able to wander around freely. When we did encounter problems such as drunk or disorderly EPWs we would warn them, through an interpreter, that if they did not stop we would cuff them. When they didn't stop we would enter the cage and cuff them until they stopped being a disturbance. At no time did we use excessive force or beat the EPWs. After approximately 1.5 months my unit was taken off of EPW cage duty MT allow us to conduct other MOUT missions. As soon as we arrived in Baghdad 2 BRT, 3 ID told us that we would be conducting a variety of missions including raid, cordon and searches, and traffic control points. We then began training on the basics of MOUT warfare; including Close Quarters Marksmanship, room clearing techniques, non-lethal entry techniques, personnel and house searches, and again refreshing on non-lethal take down techniques. We always trained for the worst case scenario but after conducting approximately 50 raids while deployed in Iraq I never encountered a situation where people were actually waiting for us with guns. Regardless, every mission we wenton we entered a building with speed and violence of action; controlling the entire building within Minutes. Normally we would plan a raid to be executed between 0001 and 0400 in the morning. This gave us the element of surprise and allowed us to move freely on the roads. Once inside a building we would clear all rooms and seal all entrances and exits. Any personnel in the building would either be passed back to our entry point (woman and children) or cuffed and escorted to our entry point (military age males) by a soldier. At this point we would conduct a detailed search of the house and simultaneously exploit/interrogate our target. This would consist of asking his name and i

Using interpreters, sign language, and Arabic phrases we learned we were able to convey to all the people that they should lie down, put their hands up, or' come with me. When people would not follow instructions we would take positive control of them and search and cuff them. Taking-positive control of thein meant we would use techniques we were trained on and place the person on his stomach, search him, and then cuff him. In any other situation this would be considered assault. However, when entering a building and going in with the idea that every on.e in there is trying to kill you and then finding a military aged male who will not do as he is told, you will perceive him as a threat. Using proportionality, we used physical force to relieve the threat. Every situation was different but not once did I see my men use excessive force. We acted in a professional manner and were complimented on that numerous times by the Brigade Commander and other leaders. We also never had any complaints or issues come about because

About 1000, 23 Sep 04, SA interviewed Mr who stated the following About .1200, 3 Aug 03, US Forces carne to his residence questioned ruin and accused him of being "The Bomb Maker". The US Forces entered his residence and conducted a search of his residence, which resulted urthe recovery a 9mm pistol. The US Forces then escorted Mr.41111111011to Al Sojeoad Palace, Iraq. Mr. -
',Stated .tw was ,placed in flexi cuffs with his hands behindhis back and the USForces also put finger cuffs on Mr41111111111 middle fingers-. Upon his arrival at At, Sojooad Palace the US Forces placed a sand' r, bag over his head'and escorted him to an interview area. Mr.11111111111stated the sandbag obstructed his gd-6ee. view and he was unable to identify the personnel who interrogated hid. The interrogation lasted for approximate' 2 hours and consisted of questioning, yelling and striking him on his legs, face and abdomen. Mr. stated he remained in flexi cuffs and the bag over his head during the interview. Mr. stated he was forced to stand in one place while the interro ator questioned him and when he moved he was punched. During the conduct of the interview Mr. was punched in his face and abdomen numero 4 times and the interrogator kicked him in the shin sever times. Mr. stated he later received ji--V176-it (

I recall raiding his home and finding various amounts of LED materials. I recall alliii 4 b/ 1 coming with us very cooperatively. Our troop, G TrOop, turned over OM to the Brigade Detention Facility ht-44 -Yd:...V

also located at Al Sojooad, Iraq. He was wearing traditional clothing. I cannot recall if he was wearing headgear ''' 't when we turned him into the facility. I believe he was about 5'8 or 5'9 of average weight. I think he was clean shaven at the time. I do not recall him being injured at the time we placed him in custody. There was no confrontation when we raided his home so he would not have been injured. We did not do a complete search for past injuries, we only searched for weapons and any Intel. He went into the facility with only his clothing on. Normally, when one is placed in custody we would flexi cuff the individual in the back and place a bag over their head. Occasionally, they would be finger cuffed as flexi cuffs became difficult to obtain. I had not seen anyone that was flexi cuffed and finger cuffed as there would be no need for that. We were also later told not to place a hood over the individuals and we had to cuff them in the front.. After individuals were turned over to the Detention Facility we 1 /.....ze...4/

A: I do not know the Specific individual. It was who ever was working at the intake area I did not actually go to the. Facility with 111111.. We would have several trucks. The truck with the prisoner would have the detainee and b44/670 .guards in it and would go straight to the Detention Facility. We would come back the facility and prepare for what was going on next. So I was not actually present when he . went to the facility. The truck with the detainees also had / guards on it. I cannot recall who may have been on that truck with :. I believe at this time the 66.-44/ 7e--4z. interrogations were handled by the Military Intelligence (MI) guys who were attached to the Brigade. I am guessing though because I was not in there.

A: No. He was very cooperative and every thing was srno7r.fhe only thing that I could think would have been from the flexi cuffs; Sometimes the flexi cuffs were placed on to tight and they would have to be loosened. These were normally checked to ensure they were not on to tight.

During my command the troop was stationed in Baghdad, Iraq in support of Operation Iraqi Freedom. Our mission in Iraq included recon and surveillance, time sensitive raids, and convoy escorts (to include detainee escort/ transfer). Over the course of b1_ d the deployMent, we detained aprox. 200 anti-Iraqi forces. I can not reca bdealings with the detaineebdi e-1 or any specific, operations that took place on 13 February 2004 b4gel cari describe the process (SOP) that was used by my Troop to detain btransfer EPWS. During the
o ration (raid, cordon and search ...) suspected individuals would be detained. By February, we were no longer using sand bags oyer the heads, We would zip-tie the individual's hands to the front of his body. In addition to the zip-ties, we would also some times use thumb cuffs, since the zip-ties were purchased off the economy and were not very strong. The detainee was then transported to the palace area to be in processed. If a . large amount of evidence was to be turned in with the EPW, he was temporarily placed at the BRT headquarters. This prevented the EPW from standing in the road near the. EPW cage while we finished the needed paperwork. During this time the platoon leader would be filling out the CPA, evidence inventory and sworn statement forms. The detainee would be sitting in the BRT area, usually the wired in motor pool under guard till we finished. This process would take sometimes 2-4 hours depending on how many EPWs and how much evidence to be tuned in. Once the paperwork was complete, the EPW would be escorted to the BDE EPW cage (about 500 meters from the BRT). Here he would be turned over to the MP unit in charge of the cage. Once in the cage, the detainee would be questioned by the S2 personnel, usually within 24 hours. If the individual was a high profile target, he would be questioned by members of other organizations such asillit_t iji.,
linretc. The detainee would sometimes be sandbagged during a move to these compounds to be questioned:' This was done under the control of the other organizations and we had no knowledge dealings with those operations.
We did not conduct interrogations of prisoners while in;the palace. We did conduct questioning of prisoners on the objective to attain additional information (such as weapons in the Wise, anyone else in the area etc b), but once we left the objective we left all questioning up to the S2 sections.

I do not specifically remember bor the circumstances surrounding his detention in February 2004. HoWever, it was a command"polieYin 2 BCT that EPW's would be treated in a dignified and respectful manner. C01411111Sthe BCT Commander had written policies in place to ensure this and we lived his policy every6 day. For example, it was our Brigade Policy not to put sandbags on the heads of EPW's and I know for a fact that this policy ,was adhered to It was also the BCT policy not to flex cuff EPW's behind the back. In less than 5% of the EPW's I actually saw. brought in to the BCT facility, were the detainees flex cuffed behind their back. We implemented the "US SOUTHCOM" EPW handling procedures right after I arrived and used them as the guidelines for treating prisoners for the duration of time I was there. We also realized early on that forced interrogations were very invaluable in terms of information gatherhig. As a result, we chose the method of using "Cage Infiltrators" to gather intel from EPW's. We would hire local Iraqi's to pose as EF'W's and place them in the brigade holding facility next to the prisoners we thought had intel value. We would then pull the dage infiltrator out of the cage and ask him for the information the EPW had provided. I arrive in Traci on -I MaY 03 and was assigned to the 1 /501st MP Company. From May 03 -Sep 03, my platoon ran convoys from Kuwait to Baghdad, Iraq. In Jul 04, we were attached to the Division Artillery and did Area Secunty PatrolS and transported detainees from the Baghdad International Airport to Abu Ghraib Prison. In Sep 03, we were conducting the security patrols and transporting the detainees to the prison. During this time, I had no contact with the; interrogators and I did not witness any interrogations. The platoon that was assigned to the detainment facility was 5/501 st MP Company. What contact they had with the interrogations, I am not sure, but they were in charge of security. When we would transport detainees from the airport to the prison, we would pick up anywhere from 5-20 detainees. We would search them and then cuff them. We would place sandbags over their head and place them on a five-ton truck. At no point did I see any detainees that were injured. I have no information about the allegations of abuse by detainees. I have never heard of the Al-Sojooad Palace. If I have been there, I do not recall it.

job consisted of running source operations, local national liaisons,
local national screenings,, detainee interrogations, and other HUMINT
related tasks, This was-Pretty Much the routine. for most of the
deployment; though My -main task was source operations. ' The 97E

Interrogators were .more or leas, doing most of the interrogations.
During the deployment Tcan not recollect any specific case of abuse to
the detainees. By abuse: rmean .things such as hitting, punching,

breaking of the skin or bones, things that would bedeemed unacceptable
according to Geneva and Law of Land Warfare. I did not witness any
detainee.abuse by anyone in B CO. liumINT_section. during the deployment

either. I don't suspect any of our people would do this as my opinion,
but cannot say with certainty, as I clid not sit in on Other
interrogations. Also with. interragations taking place in the open or at
the front gate it would be hard to abuse a detainee without People
noticing it. AS stated above I personally have never treated a detainee
in any manner not in accordance with Geneva and the Law of Land Warfare,
It is also my opinion that my coworkers would not have abused detainees
