This CID investigation concerns an allegation of a face slap upon an Iraqi detainee held in custody between June 14th and 20th, 2003. The Iraqi alleges that during his interrogation an Egyptian interpreter slapped him with a sandal, punched him, and "mildly mistreated" him at a location called "Kilometer 22" while several Americans in civilian clothes stood by without intervening. This CID investigation was initiated when a review of an Interrogation report contained two (2) line detailing the alleged abuse. In the opinion of the CID investigators, there was insufficient evidence to prove or disprove the complaint; however, the investigation was subsequently re-opened on March 6, 2005, on the basis that the investigating officers had not made a sufficient effort to identify the "Kilometer 22" location, or to locate the detainee or the Egyptian interpreter. In the ensuing investigation, officials were unable to find individuals who could identify "kilometer 22", although they opined that it referred to either the "Blacksmith Hotel" location or to F.O.B. tiger; officials found and interviewed the Egyptian interpreter, although his statement is not included in the CID report. Officials were unsuccessful in finding the detainee. The investigation concluded that there was insufficient evidence to prove or disprove the allegation.

INVESTIGATIVE SUMMARY:

On 2 Aug 04, this investigation was initiated based upon the receipt of a Request for Investigation (RFI) (0366-04-CID001), from the United States Army Criminal Investigation Command (USACIDC), wherein it was discovered during a review of an Interrogation Report (IIR) (pertaining to Mr. MOO he told interrogators he was slapped in the face by an Egyptian interpreter while detained at a location identified only as "Kilometer 22".

This investi ation was initiated based u n two lines of t xt which a eared in the IIR of Mr. former U.S. Army sergeant assigned to Tiger Team, Detainee Assessment Branc , 470 Military Intelligence Battalion, San Antonio, TX), which were extracted during a search of a database. Mr. interviewed Mr. or Military Intelligence (MI) purposes, during which, an allegation o assault surfaced. The allegation was annotated in the IIR, but not further explored.

On 24 Sep 04, Mr.Millit was interviewed by CID and reported the only available informa 'on on the assault was the information maintained in the IIR. Mr. recalled Mr.

leged only that an Egyptian male interpreter struck him, while Americans, in civilian clothes (NFI), werel
_plvzat. Additionally, the interpreter/partner withii Mr1111111111 during the session with Mr. mum was found and interviewed, but he could not recall anything about the interview at all.

All efforts to locate the location described in the IIR ("Kilometer 22") were unsuccessful. Additionally, Mr.1111111ras released from U.S. Custody prior to making a complaint and was never interviewed, and no records were kept indicating his current location within the country of Iraq, so there was insufficient information available to pursue this investigation further.

Investigative efforts did not establish sufficient evidence to prove or disprove Mr. ONE was assaulted. Investigative efforts did not diminish the claim in the IIR; however, no evidence was obtained to indicate there was a location called "Kilometer 22" used by or known to U.S. Forces at the time of this report.

Further, on 6 Mar 05, this investigation was reopened to conduct additional investigative activity and to attach additional documentation from the previous investigative activity conducted in this investigation. All investigative leads conducted, did not change the outcome of the investigation.

Interviews were conducted of the capturing unit personnel who indicated they did not recall having an Egyptian interpreter attached to their unit and efforts to locate interrogations records determined they did not exist. Additionally, interviews of the capturing unit personnel indicated they were not aware of a location known as "Kilometer 22", and indicated "Kilometer 22" was

most likely Forward operating Base (FOB) Tiger. This conclusion was based on the description the capturing unit personnel were provided of the area and their familiarity with the area, as the capturing unit primarily operated in and around FOB Tiger.

A review of the medical records did not indicate Mr.11111111111d any injuries or made any complaints of being injured. Efforts to locate and interview Mr. s were not conducted as his current location was unknown.

SINCE INVESTIGATIVE EFFORT HAS FAILED TO ESTABLISH EVIDENCE TO PROVE OR DISPROVE WAS ASSAULTED AND THERE IS NO AFFIRMATIVE ASSER OM THE VICTIM, THE INVESTIGATION IS MOST APPROPRIATELY CATEGORIZED AS INSUFFICIENT EVIDENCE. Basis for Investigation: This investigation was initiated upon receipt of Request for Investigation (RFI)(0366--iiiiii) from the U.S. Army Criminal Investigation Command,
Fort Belvoir, VA, that Mr eported he was abused while detained at "Kilometer 22",

At 1047, 9 Aug 04, this office received the detainee file of Millillivherein it contained an
terron report assessment notes dated 19 Jan 04. The interrogation report related Mr
ad been punched and slapped about the face by an interpreter and "mildly mistreated" at a second location. The reportdoes not clarify whatilifant by "mildly mistreated." The report identified two interro ators Tiger Team: Lead and Assistant d one interpreter identified as (See Interrogation Assessment Notes, 19 Jan 04)
At 1650, 11 Aug 04, the undersigned coordinated with CW3 ummimp502nd Military Intelligence (MI) Battalion (BN), Camp Victory, IZ, who related the detainee assessment notes dated 19 Jan 04 appear to contain similar numbers as their Field Reporting Number (FRN), which identify interrogatOrs that had conducted the interviews. CW3
elated he could not identify the FRN as being any member of the 502 nd MI BN or 504 MI Brigade (BDE) and further added the FRN may belon o the 20 th I BN who had been responsible for the Abu Ghraib Area during Jan 04. CW3 tated he would attempt coordinate with the other units and determine who the interrogators were and identify the interpreter used during the interrogation on 19 Jan 04.
At 1130, 12 Aug 04, the undersigned received and reviewed a co of a Source Information document, which identifi d two Tiger Team Interrogators (Lea d Assistan terpreter iiiThe Source Information Document reports e alleged 'abuse of Mr herein it is stated at "Kilometer 22" Station he had been punched and slapped about the face with sandals by the interpreter.

About 0830, 24 Sep 04, this office received a Request For Assistance (RFA) from the 3rd Military Police
Group (CID), Detainee dad 11 identi and _interview Mr.
(formerly with 470th Military Intelligence (MI) Group, Fort Sam Houston, TX 78234) concerning his
involvement in an alleged detainee abuse.
About 1655 24 Sep 04, Mr. 111111111ndered a sworn statement concerning his knowledge of the abuse of Mr. 11111.11ry his interrogators. Mr. 411111111ed he was informed by Mr. giumphat while inside an interrogation room at Kilometer 22, an Egyptian Interpreter asked him questions concerning weapons of mass destruction, the whereabouts of Saddam and the location of weapons caches. Mr. lirairrelated Mr.1111111111111informed him that when he did not give the interpreter and the two Americans who were dressed in civilian clothes the answer they wanted, the Egyptian interpreter would punch him in the face, stomach and torso areas. Mr. also related the interpreter hit him with a sandal across the face. (See Sworn Statement for details)

A.. nd Octo•er.rrived Abu Ghraib prison and worked there as a Tiger Team Leader for the detainee
assessment branch (DAB). I also functioned as the detainee assessment branch trainer. I trained all incoming
personnel as to the function of the DAB and how to properly conduct assessment .nd I also created a lot of the report
templates for our section. Around mid January 2004, one of detainees (Mr. .who was part of the Victory Bounty
cases, if I remember c rrect .Victory Bounty cases meant that he was .ap ured during a specific time. or in
a particular operation..(Civilian Contractor) was my p.ing that time. We chose Mr

in the booth with us. I began to assess Mr. .nd asked him.lographical information, which he prove ed o e .
best of his ability. I proceeded to ask him about.e circumstanc.unding his capture. I can't remember the
circumstances such as the date or reason form his capture, Mr. .informed me he was taken from his home,

was in Northern Iraq. Mr..related he only spent between one and three nights in Baghdadi before being driven
down to Kilometer 22 with a con oy. Once he arrived at .'.22, he was placed into a cell and sometime early the
next morning he was taken to an interrogation room. Mr. .elated that while he was in th .' t.tion room an
Egyptian interpreter and either one or two civil' n .sed Amencans removed his blindfold. M .as sitting on
a chair and they began interrogating him. Mr.related they started a.m questions.ncerning weapons of
mass destruction, the whereabouts of Saddam, an weapons caches. Mr. .elated when he did not give them

BASIS FOR INVESTIGATION: About 1600, 8 Jul 05, this office received a Category I Request for Assistance from the 48 th Military Police Detachment (FWD), Camp Victory, Baghdad, IZ, requesting this office coordinate with the Rear Detachment (Rear D) Commander (CDR), 3rd Armored Cavalry Regiment (ACR), Fort Carson, CO 80913 (FCCO), and determine what documentation exists in reference to the forward deployment of 3rd ACR in support of Operation Iraqi Freedom (01F) I from Mar 03 to Apr 04 and the occupation of Rifles Base, Ramadi, IZ. The requesting office additionally requested this office ascertain whether documentation exists related to the operation of a ention facili known as Kilometer 22 in reference to an allegation of detainee abuse made by

, WANT TO MAKE THE FOLLOWING STATEMENT UNDER OATH: I was deployed from April 03 to March 04 with Apache Troop 1/3 Amored Cavalry Regiment to the Al Qaim area of Iraq. I was a Platoon Sergeant of a tank platoon, where we assisted with raids of suspected insurgents and patrolled the city and helped with the Border Checkpoint operations. We would detain the suspects and secure them in the back of trucks for transportation to Forward Operating Base Tiger. Once the detainees were at the FOB we unload them to the short-term detention facility and then ,the Military Intelligence or Special Forcewalk with the suspects for information gathering.

About 1625, 17 Sep 05, SAMIginterviewed CPT eadquarters (HQ), Iraqi Assistance Group (TAG), Multi National Corps-Iraq (MNC-I), Camp Victory, Baghdad, Iraq (IZ), APO AE 09342, who stated during his time with 1/3rd Armored Cavalry Regiment (ACR), Operation Iraqi Freedom (OIF) II, Forward Operating Base (FOB) Tiger, IZ, his unit did not conduct any of its own interrogations of detainees. Instead, they utilized interrogators primarily from the 66th Military Intelligence (MI) Company (Co) and Operational Detachment Alpha (ODA) 531. CPT further stated their interpreter support came primarily from local national citizens hired off of the economy and interpreters working for TITAN Corporation. CPT then stated there were only two detention facilities utilized by 1/3rd ACR during OIF II, which were the detention facility located on FOB Tiger, and a temporary facility set up by ODA 531 to support one of its larger operations. This temporary facility was located approximately
-meters east of FOB Tiger, and was only in operation for a couple of weeks in Nov 04. CPT

About 1030, 28 Feb 06, SAM/interviewed Mr. Operations Coordinator-
OCONUS, L3 Communication 1 us Commons Dr., Reston, VA 20191, who related he was in
Iraq from Mar 04-Mar 05. Mr. stated he was not familiar with Kilometer 22 Detention
Facility but was aware of some of the Egyptian decent interpreters. He stated the regional managers kept
the historical documents of where the interpreters were located • Ira d that these documents are not
usiinlly kept after the regional manager leaves the area. Mr. stated he did keep some of the
documents of the interpreters and would have to search his iles and coordinate with this C/A at a later
date.

About 1400, 20 Mar 06, SA 1111111111was contacted by Mr.1111 who related he did not keep
any of the historical documents from Iraq. He further stated the company did not have any kind of
documents that would contribute to this investigation.

ant to make the following statement under oath: I was with 1st Squadron, 3rd ACR as the S2 in Iraq from 5 Apr 03 to 8 Apr 04. Between 14 Jul 03 and 21 Jul 05 I was assigned to FOB Tiger in AL QAIM. I was the squadron intelligence officer. I did everything from AO intelligence assessment to detainee processing and those sorts of things. I also performed some physical security duties. Regarding detainee processing we had to gather all paperwork concerning the detainees and collecting and maintaining detainee property. We also in processed them into FOB Tiger. I was responsible for the detainee operations but usually did not directly participate in the processes. Basically I oversaw the operafi e would also analyze the interrogation reports for intelligence purposes.

Q: What was the location and purpose of Kilometer 22 Station?
A: I think I remember a Kilometer 8 station, but cannot recall a Kilometer 22 Station. Kilometer 8 station was about 8 KM down the tracks from FOB Tiger. Kilometer 8 was an old train station and was completely empty in Jul 03. We used it in the November 03 time frame. It was called the Blacksmith Hotel at that time and was used as a detainee holding area.
Q:
Describe Kilometer 8. A; There was a train station there with a housing area formerly used for employees. Everything was empty in Jul 03. U.S. Forces began using the facility in the October or November 03 time period. I helped to pick out the site for a place to hold detainees, so I am sure it was not in use in Jul 03. I had been by it several times and am sure it was just an empty building.

Q:
Where was FOB Tiger?

A: It was about 18-20 Km southeast of Al-Qaim, Iraq.
Q: What was FOB Tiger's purpose?
A: It was a forward operating base that most of Tiger Squadron operated out of. Tiger Squadron is 1st Squadron, 3rd ACR.
Q: What was the relationship between FOB Tiger and Kilometer 8?
A: I had some detainees who were sent from FOB Tiger to the Blacksmith Hotel (located on Kilometer 8). This occurred in late November. Detainees were sent from FOB Tiger to Blacksmith Hotel on one occasion. It was a one time movement that occurred prior to Operation Rifles Blitz. Once the operation was initiated, detainees were sent directly to Blacksmith Hotel.

After the operation was over, no more detainees were sent to Blacksmith Hotel. I believe the
hotel was only open for about two weeks.

Q: Where specifically was Blacksmith Hotel?
A: Blacksmith Hotel and Kilometer 8 are one in the same. The Blacksmith Squadron took it over and re-named it.
Q: What was the purpose of Blacksmith Hotel?
A: Full processing and interrogation of detainees captured during Operation Rifles Blitz.
Q: What was the SOP or unwritten policy for processing detainees from the moment of capture through interrogation and transfer of custody and responsibility?
A: My policy was as follows; I assume the Blacksmith Hotel followed a similar policy. Mine was a Regimental Policy so I assume it was similar. Two sworn statement and a capture card were supposed to be generated upon capture. These were supposed to be turned in when the detainees were processed in, but rarely was done. I would have to follow up with unit commander to have these things completed. A picture of the detainee would be taken and we would have them write their names in Arabic. Then they would hold that card in front of them for the picture. They were given a number for tracking purposes. My 97B's would do an initial interview of the detainees. If we had evidence to support sending them higher then we would send their paperwork and the detainee to the regimental level, along with targeting information surrounding their capture. I did not have interrogators. My 97B's would work with interpreters. I had the authority to release detainees if there was insufficient evidence and towards the end we would turn them over to local police authorities.
Q: What constituted an interrogation team, to include U.S. Military, foreign, or contractor involvement?
A: I am not sure how the Blacksmith was running teams. I believe they had Mobile Interrogation Teams from Corps level. I believe they were from 5th Corps possibly. They also had guys attached to 3rd ACR. We had a couple of interrogators and an interpreter. But I am not sure how the teams were arranged.
Q: Do you kno es of anyone involved in the oversight or execution of interrogations?
A: Chie versaw the interrogators. He was the Regimental terrogator. I cannot recall the names o anyone else who might have worked there. Chief is at Fort Carson now.
Q: Do you know if contractors or foreigners were part of the interrogation teams?
A: The interpreters were all Americans. They were CAT 2 interpreters. I did not know any of them or know where they were from. I don't recall any of Egyptian descent.
Q: Do you know what the interrogator team members wore to and during interrogations?
A: I don't know what they wore at the Blacksmith Hotel. My guys wore sterilized DCU's. My interpreters wore sterile DCU's or civilian clothes.
Q: How many times did you go to the Blacksmith Hotel?
A: Twice in two weeks. I did not actually oversee the operations though. I did see some interrogations occurring, but cannot recall any interpreter of Egyptian descent. But I did not know those guys, so it is possible an interpreter meeting this description was there.
Q: Do you have any knowledge of any detainee who claimed he was hit in the face with sandals at the Blacksmith Hotel or Kilometer 22 (8) station?
