(UNKNOWN); (NFI); [ASSAULT (Insufficient Evidence)] [CRUELTY AND MALTREATMENT (Insufficient Evidence)] 106 -1-6 - VICTIM: 1._IV; IRAQI; ISN: _ M; WHITE; XZ: Date of Capture: Unknown; AKA:_ (NFI); [ASSAULT (Insufficient Evidence)] [CRUELTY AND MALTREATMENT (Insufficient Evidence)] INVESTIGATIVE SUMMARY: On 19 Jul 04, this office received an International Committee of the Red Cross report, dated 30 Jun 04, from the 22 nd Military Police Battalion (CID), Camp Victory, IZ, which indicated ail (9.7C-4 between 15 — 25 Mar 04, he was restrained with metal handcuffs for eight hours while in the isolation section of the Baghdad Central Confinement Facility (BCCF), Abu Ghraib, IZ. Investigation established insufficient evidence to prove or dis rove the offenses of Assault and Cruelty and Maltreatment occurred as alleged by _ wasKc--qt (66-1 interviewed and alleged during an interrogation someone pushed or bumped into him, causing him to fall to the floor of the interrogation room, while his hands were handcuffed to a hook fastened to the floor. 1111=11111111111kelated he was blindfolded during the incident and was unsure if it was an accident or if the individual intentionally hit or pushed him to the floor. (No sworn statement as he can neither read or nor write.) It's clear from his description of his treatment that he was treated at the 801st CSH on Abu. (He descibed the x-ray procedure and the x-ray room to a tee.) I spoke with the hospital commander and he said they may or may not have an x-ray log documenting the prisoners that they take x­rays of. The Iraqi clinic does not have x-ray equipment. The treatment records are still MIA, but I've asked them to determine if they might have kept an x-ray log and to see If his number is in it. That the problem with this whole thing. No one saves or files records and they language/cultural isues are such that the detainees say stuff that frequently does not make a great deal of sense. Early in May of 2004, I went to pick Detainee 111111110111.1pand I saw that his left wrist was bandaged. I asked him why his wrist was bandaged and all he would say was that he hurt it. Detainee 1111=111110istated that when he struck or pushed no one said anything to him, so he acknowledged that the incident could have been inadvertent; however, someone had been yelling at him shortly before the incident that he could be in Abu Ghraib for 50 or 60 years. When questioned concerning the allegation inthe RFA, 11111111111.11M claimed that he had never made a complaint against anyone and denied that he had ever been maltreated by anyone since his detention. When questioned specifically _ about the allegation that he was handcuffed and left alone for eight-hours in a detention cell, ocs-q 6'`4 ~MOstated that he had never made that allegation. He did state he had spoken to a man in civilian clothing, who he believed was in the military, about being interrogated while his hands and feet where restrained by metal handcuffs and anchored to the floor of his interrogation room. During one of those interrogations, which 1111111111111111111111111111 believed occurred between two and three months ago, one of his interrogators struck him in the left stioulder.11111.1111 ¦pdid not knowwhich interrogator struck him. At the time he was struck, one of his interrogators was asking him about attacks on US and Coalition Forces.
