A detainee was taken in to custody on January 10, 2004 and alleged he was abused during his arrest by being kicked in the face while he was restrained, hooded and in a kneeling position. He also states while detained at Camp Biap, Baghdad he was also subject to abuse. The report noted that the detainee resisted arrest and the injuries he sustained were minor and consistent with a minor struggle when being taken in to custody. Furthermore, the translator who was present when the detainee was interviewed on several occasions states the detainee never raised the issue of abuse. If he had, the translator states he would have reported it up the chain of command.

The injury caused by the blow was described as "localized tenderness in the left m.axillary area." Mr....related x-rays were taken at CASH 31, and that the hospital number4-1;,o6e­was 1790 or 1740.

The injury caused by the blow was described as "localized tenderness in the left maxillary area. At 0900, 2 Aug 04, this office received a request for investigation (RFI) (0369-04-CID001) from I, z,4
the U.S. Army Criminal Investigation Command, Fort Belvoir,VA, wherein Ms4111111Sreported,b-/76-14'
during a newspaper interview, she had been dragged, beat, and stripped of her cloths by U.S.
Soldiers (See News Paper Article).

she made a statement relating her alleged abuse. In the statement provided by
the alleged abuse appeared to have been from M initial capture and medicall,7„,,'

information could be found in report of investigation 0123-04-CID259-80248. SA
related all female detainees, to include Ms had been released by U.S. Coalition /
Forces.

was true but it was due to a routine medical examination that all detainees must go through to

BASIS FOR INVESTIGATION: ON 11 Mar 05, this office received information from the Operations Officer, 11TH Military Police Battalion (CID) (FWD), Camp Victory, Iraq (IZ), reporting receipt of Request for Correction (RFC) (0145-05-CID001) from the United States Army Criminal Investigation Command (USACIDC), which revealed. the necessity for additional administrative and investigative activities.
On 11 Apr 05, -the RFC was reviewed along with the case file and the following actions were
taken with regards to the recommendations noted in the RFC:
1.Finding 1 suggests this office interview the detainee. Interviewing the detainee would not provide any information likely to change the outcome of this investigation; therefore this investigative activity will not be conducted. On 22 Mar 04, the detainee wrote a statement concerning her arrest and detainment. In that statement the detainee stated she felt humiliated and was forced to disrobe for a medical check, however, she made no references to being beaten or dragged. The statement supposedly given to a reporter and later printed in The Globe and Mail on 21 Jul 04, has not been verified. The allegations are vague with no specific details and the source of the information has not been identified. The detainee had the opportunity to make claims of abuse while she was in custody and did not. Her claims that she was humiliated because she was forced to disrobe have been clearlY explained. The detainee would have been forced to disrobe to be medically examined and issued new clothirig upon being in-processed to a detainment facility. This was established as Standard Operating Procedures with proper procedures Set in place to deal with female detainees. The detainee does not describe any act in her written statement by the medical personnel that would have been deemed inappropriate or abusive. Further, it is not feasible to attempt to interview this alleged victim in the hostile area where she resides and she will not come to the Coalition Forces bases.

Intervievvs of the medics and female guards will not provide any information likely to change the outcome of this investigation; therefore, this investigative activity will not be conducted. As stated above it has already been established the detainee would have been made to disrobe and medically examined during the in-processing to thealaccording to the SOP in effect at the time. Interviewing female guards to confirm this will not alter the outcome of this case.
3. Finding 3 points out available information to locate and interview the detainee. The operational constraints and risk involved to CID personnel in finding the detainee outweigh any gain an interview of her might produce. Any information that might be gathered from the detainee is not likely to change to the outcome of this investigation; therefore, this investigative

activity will not be conducted. The detainee had opportunity to voice her complaints and did so concerning her arrest and confinement in U.S. custody and mentioned no abuse or acts by U.S. personnel that constituted abuse, assault, or cruelty and maltreatment. A review of all documents pertaining to the detainees' arrest and confmement showed no evidence of injury, or abuse. Statements supposedly made in The Globe and Mail are not explained and come from an unidentified source. The risk involved in finding the detainee clearly outweighs the need to interview the detainee concerning allegations that cannot be substantiated.

case file and marked with the appropriate exhibit number.

The tactical interrogation Report was added as Exhibit 10.

All administrative deficiencies identified in the RFC have been corrected and investigative
deficiencies explained as to why this office vvill not conduct such activity.

Further review of the case file revealed the DATE/THVIES/LOCATIONS listed on the Final
and Corrected Final reports had the wrong date and locations of the offense. This was corrected
back to the original date of offense as 25 Feb 2004, 0300-7 Mar 04, 2359; and the location
corrected to 4ininginigm Baghdad International Airport, Baghdad, Iraq.

The original Final Report listed the offenses of Assault and Cruelty and Maltreatment as 46?„‹,,,L. .7
Insufficient Evidence). Per the guidance of CW31111111111111111111. Detachment Commander, the
findings were changed to Unfounded and this case file closed in this office.
