Investigation into abuse of detainee who was captured on 01/04/04. Investigation found there was no probable cause to believe the offenses occurred as alleged; therefore, they are unfounded. The only names identified by this investigation were determined to be fake names utilized by the capturing soldiers; however, the abuse allegedly occurred during the interrogation of the detainee.

subsequent to his capture, he was taken to a detention facility, believed to be near BIAP. Mr. 111111.11alleged during interrogations he was placed in front of an air conditioner after he wa stripped naked. While in front of the air conditioner, cold water was poured on him. Also, Mr.
11111111111elated he was made to carry a heavy box which was connected to a rope around his neck, while blindfolded and naked, Further, Mr.1111111111elated he was told to hold meals ready to eat (MRE) boxes above his head in front of an air conditioner while cold water was poured on him. Mr.111111.111related he was kicked and punched if his arms were lowered.
(U) Further documentation, to include additional detainee records and medical records, to refute or substantiate Mr.IIIIIIIIIallegations of abuse could not be located. This Investigation did not diminish the integrity or credibility of Mr. allegation.

On 3 Mar 05, this office received information from the Operations Officer, 11TH Military Police Battalion (CID)(FWD), Camp Victory, Baghdad, Iraq, IZ reporting receipt of Request for Correction (RFC)(0125-05CID001) from the United States Army Criminal Investigation Command (USAClDC), which revealed the necessity for additional administrative and
investigative activities,
On 6 Mar 05, the lst Supplemental report was forwarded to USACIDC with the administrative corrections.
On 8 Apr 05, this case was forwarded to Current Operations, Headquarters, United States Army Criminal Investigations Command (USACIDC) for review. The case file was reviewed and forwarded back to this office to be closed.

A review of Interrogation Reports contained in the Joint Interrogation and Debriefing Center (J1DC) Interrogation Operations Database indicate Nay have been physically abused while in US custody.N" mmand Summary" section of an Interrogation Report pertaining N(Sc't) to an interrogation oNon 16 Feb 04, contained the following, "DETAINEE STATED HE WAS PLACED IN FRONT OF AN AIR CONDITIONER AFTER HE WAS STRIPPED NAKED. WHILE IN FRONT OF THE AIR CONDITIONER, COLD WATER WAS POURED ON DETAINEE. DETAINEE STATED HE WAS THEN MADE TO CARRY A HEAVY BOX THAT WAS CONNECTED TO A ROPE AROUND HIS NECK. WHILE BLINDFOLDED AND NAKED, DETAINEE WAS TOLD TO WALK THROUGH THE ROOM AT WHICH POINT HE WOULD HIT WALLS. DETAINEE COMPLAINED THAT THIS HURT HIS CHEST AND RIBS. WHILE NAKED, DETAINEE WAS THEN TOLD TO HOLD 2 MRE BOXES ABOVE HIS HEAD AND IN FRONT OF THE ALR CONDITIONER. COLD WATER WAS AGAIN POURED ON DETAINEE. DETAINEE STATED IF HIS ARMS WERE LOWERED HE WOULD BE KICKED IN THE BACK LEG (DETAINEE POINTED TO CALF) AND PUNCHED IN THE BACK. DETAINEE THEN STATED HE FAINTED AND FELL TO THE FLOOR. DETAINEE STATED HE WAS LYING ON HIS STOMACH AT THIS POINT. DETAINEE STATED THAT 2 BOXES WERE THEN PLACED UNDER HIS BODY. 1 BOX WAS PLACED UNDER HIS LEGS AND 1 BOX UNDER HIS ARMS. DETAINEE WAS THEN TOLD TO RAISE HIS BODY TO BE LEVEL WITH HIS ARMS AND LEGS. DETAINEE STATED WHEN HE COULD NOT PERFORM THIS FUNCTION HE WAS KICKED IN THE STOMACH WHICH MADE HIM VOMIT. I talked with Terry yesterday. He is the only person there right now

filling in for two other bodies so he is quite busy.

He has received a total of 14 RFA's from you, sent to him via HQUSACIDC. We
have USACIDC tracking numbers on all of them.

He has to first obtain the documents with which to search through and if
they are hits (and it appears they are) then he has additional work.

So, please consider this information above as a 1st Info Report for the

above 14 RFA's. He acknowledges receipt of the RFA's and will work as

expeditiously as possible to complete the leads.

We have discussed a suspense for completion for three weeks from today (6

Oct 04). In three weeks, if I have not heard anything from SAM.' I

will contact same for a status.

I understand this may not answer the mail for the CAT I updates, but please

reflect this information and if anyone has any questions, I will be the POC

for their questions/answers.

No effort was made to ideNand interview the interrogators and screening personnel who were working at th emporary Screening Facility (TSF) during the time period of the alleged incident -5 Jan 05). The detainee provided very good descriptions of the interpreterNas well as other individuals who were involved or present during the abuse and it may e possible to identify suspects based on his descriptions,

'The "lost records" explanation is unacceptable. Capture reports and interrogation reports do not just sit in a database on a local hard drive. They are submitted to higher echelons as well as other intelligence activities in an expeditious manner. The bottom line is this detainee's circumstances were rather unique, due to his relationship to another high value detainee (as detailed in the case file). Because of this relationship, the interrogators would have prepared and submitted a report to higher echelons. There is not indication that we had MI or the TSF search the available databases for any reports pertaining to this detainee.

During his interview with CID, the detainee stated he agreed to show the interrogators where the person lived who provided his fake passport. The detainee stated he was taken by helicopter to show the interrogators the location and then he vvas taken to Abu Ghraib. Again, more information that can be used to distinguish this detainee from other detainees and assist in identifying the individuals who interrogated him.

Exhibit 9 (AIR) contains a paragraph that states interrogation reports were reviewed that had variations of the detainee's name; however, the date of birth on the reports did not match the detainee's date of birth. The AIR does not indicate whether or not the dates of birth were close to the detainee's date of birth. We have found that the same detainee may have numerous dates of birth listed in his records due to a variety of reasons, including admin errors or even because the detainee simply does not lcnow his exact date of birth. Also of note in this case is the fact that the detainee's father was detained during the same time period and the detainee and his father have very similar names. The questioned interrogation reports should have been reviewed for content and compared with subsequent ieports that we do have from when the detainee was at Abu Ghraib. 'The detainee was questioned concerning a v s • lc issue and the circumstances of his capture were similarly unique.

This investigation was initiated upon receipt of RFI 033 -04-CID001, from HQUSACIDC, which indicated a review oNinterrogation reports revealed he was allegedly abused while detained by us Coalition Forces.
A review of this case file and investigative reports revealed this detainee was captured and detained by Task Force 6-26. Task Force 6-26 is stationed out of Fort Bragg, NC. A Request for Assistance was sent to the CID assest with this Task Force. An Information Report was provided to this office which stated fake names were used by the 6-26 members. The only names identified by this investigation were determined to be fake names utilized by the capturing soldiers; however, the abuse allegedly occurred during the interrogation of the detainee. The 6-26 CID agent related that the capturing soldiers would not know who the interrogators were. 6-26 also had a major computer malfunction which resulted in them losing 70 percent of their files; therefore, they can't find the cases we need to review.
This investigation meets the necessary requirements and does not need to be reopened. Hell, even if we reopened it we wouldn't get anymore information then we already have.
