Detainee states that he was taken to the Kilometer 22 Station, Al Qaim, Iraq, between July 14 & 21, 2003. An interpreter who was present at the facility at the time and may have participated in the interrogation stated that they never witnessed any cruel or abusive treatment of detainees. The only physical interaction witnessed was when a detainee attempted to escape. The detainee would not cooperate with the investigation once contacted and the allegations were determined to be unfounded.

About 1345, 6 Oct 04, SA111/111. and IA coordinated with CPT
Commander, 66th Military Intelligence (MI) Company, 3rd Squadron, 3rd Armored Cavalry Regiment
(3/3 ACR), who stated that during the time period of 14 Jul 03 to 21 Jul 03 all interrogation and
interrogation interpreters were provided by 66th MI. No local nationals or Titan Corporation personnel
were used. The interrogators attached to 1/3 ACR durin this time were SSG and PFC °

The interpreters attached to 1/3 ACR were SG and SGT.imp CPT_iistated

n 04 October 2003, I was the team leader of one of the clearing teams conducting raids for a Squadron-sized series of raids for
1 st Squadron 3rd ACR. During the day I encountered a house that had an atti-tank blancher empty tube several heavy weapots

,
mounts in the yard, and 9mm live ammunition hidden under clothes in the bedroom. Speaking with the. men of the house and the women of the house, it was apparent that the women and the men had different stories explaining the weapons and thewhereabouts of our target, the father of the house who was supposedly in Baghdad at the time A
iliao, we learted frOm the
women that they, were of Syrian descent. After a recommendation from my mterpretor, SPC , I decided to detain the (of
age) men of the house based on the eVidence above. During the day, the only person I rem= er that was hurt was an old man,
at a-different location, who had heart probleMs. We detained him but then released him due to pleas from his family. After the
male relatiVes of our target were detained, they were taken to a temporary holding cell at Tiger FOB (Al Qa'im, Iraq). There
they were either questioned and released or sent to another holding site at Al Asad airfield. I have no knowledge as to what
happened to th after I sent them to the Tiger FOB holding cell. •

About 0940, 6 Dec 04, SA and IA interviewed SGT clarify his prior statement. SGT provided a verbal statement in which he stated the detainee Physical Training (PT) program was discontinued after the death of an Iraqi General who was in custody in Nov 03, this order was given to SGT....by CW31111111.1.. SGT tated during PT, the detainees performed squats, wall sit, walking, arm raises with a 1 liter water bottle that was full; however, detainee's could drink from the bottle during the session. He witnessed one detainee doing the low crawl, directed by ODA who SGT ould not identify as they were wearing BDU's bearing only a "US ARMY" tape. The PT sessions were conducted until exhaustion as identified by US personnel, but usually less than 30 . minutes. SGT... stated he never saw a detainee refuse to conduct PT. SGT imiliwas not present during the summer months, he arrived on 16 or 17 Oct 03 and PT was discontinued in Nov 03, and he stated weather_ conditions pleasant not too hot or too cold. SGT of
also stated that he did not know the frequency of PT and that no injured detainees were made to do PT and is unaware of any complaints of the detainee's regarding PT. SGT en. stated he witnessed one detainee who made a knife out of a spoon and was punished with PT. PT

THE p WING STATEMENT UNDER OATH: was the S2 for 1/3 ACR in Al Qiam Iraq from 12 May 03 to Approximately 8 March 04. While in Al Qaim I was overall in charge of Detainee Operations. From the end of May 03 until Sept 03 SSG and spcimwere the Counter Intelligence (CI) agents assigned to .
1/3 ACR. They conducted initial interviews of detainees consisting of basic information as well as questions pertaining to the reason the detainee was detained. I saw no abuSe to detainees preformed by either of the CI agents. They were both trained in reading body language and
conducting interviews of US persons-This trail& used in the interviews of the detainees.
From Sept 03 to March 04 SSG fine SGT PC 41.110and SPC IIIII.were the assigned CI agents for 1/3 ACR. During this time the same techniques were used as under SSG 1111111pong with limited sleep modification (meaning the detainees were allowed the required

During this time I witnessed no abuses conducted by any CI agents assigned to 1/3 ACR. Some PT was directed by the CI agents. Walking in circles, push ups, and standing with their arms perpendicular to their bodies. The PT was never done for more than 15 min at a time except for walking in circles and that lasted up to 30 min. All detainees were feed and given water as required as well as shelter and latrine facilities. Medical checks were done daily to ensure all detainees were in good health The MP unit assigned to 1/3 ACR was the 94th MP unit from the Massachusetts Army reserves. They were not involved with detainee activities outside of initial detention during daily operations.

As a detaining unit. They had a tactical mission there and did not guard detainees or interrogate them. We used them on patrol missions and room clearing during raids. Later on they went to train Iraqi Police.

On 29 Jan 05, SA this office, discovered peculiarities during a review of two separate ROIs initiated at the direction of HQ, USACIDC (under RFI #s 0366-04-CID001 & 0334-04-CID001). The RFI resulted in the initiation of two distinct CID ROIs into allegations of detainee abuse (ROI #s 0211-04-CID259-80246, initiated on 14 Jul 04, & 0243-04-CID259- 80277, initiated on 2 Aug 04).

In both cases the allegation arose from information gleaned from an IIR written by Mr.11111111111.111111111.
reviously U.S. Army SergeaAt assigned to Tiger Team) who was working with a .a Titan Services interpreter. Both case files contain the IIR from whence the data was extracted, each report bears data reporting both interviews were completed between 1300-1500, 19 Jan
04. The detainee ISN number are roughly 300 numbers apart (115579 and 115819), indicating some time elapsed between captures. The reports read in areas exactly the same, to include location and circumstances of capture, when the two detainees were captured months apart in different provinces of Iraq.
Since it is impossible for both intenogator11111111111111and interprets o have conducted the interviews simultaneously, the most logical interpretation of this data is tha overwrote the language in an earlier ilk to include references to abuse. The veracity of the reports is in such question as to make the basis for the initiation of any allegation into assault suspect Therefore, without direct information from the detainee referenced, it impossible to tell which man made the claim, if in fact either did. It is equally plausible that .andalliNiverwrote reports as a matter of practice and therefore it is impossible to verify the veracity of the information contained therein. About 0952, 25 Aug 05, SA dvised Mr•llogil of his legal rights which he
waived and stated be was stationed in Germany from May OG May 03. Mr hen
stated he was deployed to Iraq, assigned to 66 th MI Co, 3d ACR, from 10 Jul 03-Jan 04, Mr.

stated he arrived in Baghdad, Iraq on 10 Jul 03, and traveled to Al Asad Air Force Base (AFB) on 11 Jul 03, where he received MOS related training for 2 IA to 3 weeks.
