Detainee alleges being beaten on the head and passing out. Detainee was punched; beaten with rifles; had water thrown on him; and was laid down in front of a tank and told he would be run over. Members of the unit were interviewed and denied the allegations. Medical exam did not show any injuries consistent with abuse. Upon further interview the victim said he was not choked as alleged. The detainee’s claim was determined to be unsubstantiated.

INVESTIGATIVE SUMMARY:
On 8 Jul 04, this investigation was initiated based upon receipt of Request for Investigation (RFI) (0324-04-CID001) from the U.S. Army Criminal Investigation. Command, Fort Belvoir, VA, which related u/) ,-4 -111111111111may have been abused by unknown person(s) at an unknown location, in IZ.
Previous investigation established there was insufficient evidence to prove or disprov AIMs ciociko-tootbi-y allegation of Assault and Cruelty and Maltreatment. Nalialleged he was placed in plastic (-`)(-)«)-v, (-4)14) -ef handcuffs, punched, beaten with rifles until unconscious, dragged on the ground placed in fron of a tank and was threatened to be run over if he did not admit to attacking Coalition Forces. On 11 Aug 05, CP Office of the Staff Judge Advocate (SJA), Multi-National Corps —
Iraq (MNC-I) (XV Air orne orps), Camp Victory, IZ APO AE 09342, was briefed on the merits of
this investigation, and opined there was no probable cause to support allegation of Assault or
Cruelty and Maltreatment; therefore, the offenses were unfounded.

UNDER OATH: I was deployed with the 401 st MP CO to Iraq from Mar 03 to Mar 04, I was involved in numerous raids which led to search and seizures of local national, which some of were detained and transported to Detainee Camps. The only incident I can remember where I went on a raid soon after and near an ambush site was sometime in Sep
03. The location was somewhere on the east side of the Tigress river from Tikrit, and was after a Cavalry Squad was ambushed earlier. Three squads from my unit were dis atched

to assist in raids to locate suspects. My squad went on a raid with LTC -Yi and we captured a suspect from the Cavalry incident There was a Army CID Special Agent (CW3, NFI) who was present when we captured the guy (unknown at this time) who we suspected. This guy was transported to my Battalion HQ in Tikrit, where I filled out the paperwork to turn the detainee into the Detainee Camp. The CID Agent requested that the detainee be transported to the D_ivision Holding Facility. At no time during the transport did anyone under my control abuse the detainee or strike him with a rifle. The detainee was flexi cuffed behind the back and he waiblindfolded for security reasons. My squad was traveling in HMMWV and was escorting the Battalion Commander and the CBD Agent in two additional IIMNIVV's.

WANT TO MAKE THE FOLLOWING STATEMENT UNDER STH: was the Special Agent in Charge of the 43d MP Det (CID) in Tikrit, Iraq supporting the
4th 4Infantry Division Burin Operation Iraqi Freedom. I have been informed that a )(7)" -Y: detainee identified as Detainee number filed a complaint ;)(b)-Y that someone in the coalition forces abused him during his detention in connection with
the deaths of three soldiers on or about 18 Sep 03. I specifically remembelli.
being a suspect in this particular ambush and recall seeing as well as talking with him the day he was detained in relation to the ambush. However, I am not aware, nor was I, of any abuse he suffered at the hands of his captors. My recollection of this investigation, although I can't confirm the date at this moment, was that the 720 th MP BN was notified by G Trp, 10th Cav superiors sometime in the early morning hours (2400­0600) the night the ambush took place. My detachment was not notified until around 0600-0700 that morning following the ambush. The rest of my detachment had just departed or were preparing to depart for Kirkuk on follow up on previously reported, investigations. The only agents left behind was my Detachment Sergeant and L The first word we got was that three soldiers were dead and their bodies were at the medical aid station on Camp Ironhorse where my detachment was located. SSG11111111111111(my Det Sgt) and I proceeded to the medical aid station, processed the bodies and as we were returning to our living area, we were stopped by a patrol from the 720 th MP BN and advised other members of the Battalion were still at the scene of the ambush. They had 70-80 detainees in custody there, all being held pending CID arrival at the scene and the patrol which stopped us was prepared to escort us there. When we arrived at the scene, LT Cinade contact with us and several of his soldiers escorted us around the scene which consisted of about a half mile square area or more Our arrival at the scene was approximately 1000 hours. During the processing of the scene, LTC -elated his troops had detained a large number of eo le as they were in the area after the attack. LTIMIlirelated one in particular .ad provided a wealth of information regarding the attack, including names of those involved and . a description of a vehicle used as well as specifics about who had what sort of weapon for the attack. Sometime around 1500 or so, we were completed with processing the scene .and LT pointed ouillillefrom the group of detainees in the area. He relate .ad identified two other locations which he was willing to point out as the homes of three additional suspects who were not in custody and asked i.and I wished to accompany them to those locations to complete the raids on the homes in hopes of capturing the remaining suspects who were at large .and I agreed. esidences that were probably 2-3 miles away on the northeastern side of Tikrit in the
countryside. The first residence gained us nothing. We captured one young Iraqi male
who was frying to run from the residence as the unit approached. The interpreter for LTC
questioned him and another malebriefly. They admitted they were relatives of
e men we sought, but they wouldn't or couldn't provide any further information on the
whereabouts of these men. The second residence we raided yielded another suspect
whom had been identified b411111111 e recovered an AK-47 out of the residence as
well as its owner, but nothing further was gained at that residence. The detainees were
transported by 720 MP personnel to the detention facility at Camp Ironhorse and
secured. At no time did I witness any sort of abuse of any ofthe detainees b an' of the
soldiers around us during that operation. Further, the brief time I spent wit
on the roadside upon our arrival at the scene, I did not observe any sort of injury that I
would think would have been visible had he been struck in the head or face with a
weapon as he has alleged. There was no bump on his head, he didn't complain of any
pain, nor was he bleeding anywhere on his body that I could see. I certainly would have
taken notice if Ihad observed something of that nature and would have dealt with the
situation there and then. Nor would I have stood by and allowed any sort of abuse of that
nature to take place in my presence. I have no sh -nply for detainees who are injured
during the course of their capture if they are resisting or attempting to flee, but once they
are in custody and under control, I would not have allowed an sort of abuse to take place
in my presence. Furth..a.nonce at theermore I had occasion to intervie
detention facility aniallilliinterviewed him on several other occasions at the same
facility during the course of several weeks after the ambush. Not once did he make any
sort of allegation of this nature to us during those interviews. I think I can speak forIMOas well, he has the same basic beliefs as I and I don't believe he would have
stood for any sort of abuse during his interviews or at the scene any more than I would.
I'll have to review the file and obtained the case number as well as specific dates as I
can't recall those off the top of rny head.. If research of the case documentation would
assist in this matter,,I'll be more than happy to research the file for you.

coordinated with CW the USACIDC SAC in Tikrit for support, In the morning following the attack on the U.S.
soldiers, I traveled WI NI. element to Abu Ajeel. There we found other soldiers from the 1st Brigade, 4ID and they had

gathered together many Iraqi maleS that had lived in the area. One of the Iraqi males had confessed to taking part in the ambush
saying that he participated in the ambush against U.S. soldiers for money.. I don't remember that Iraqi male's name but he told
us about two other people that were involved which01 o hasty raids in the vicinity of Abu Ajeeel and resulted in the
capture of one of the two named Iraqi males. CW3 ocumented the case and conducted the criminal investigative

interviews so he would probably have more informa Ion. ant
nt to state, however, that in the apprehension of these males, or in
those of all the people we apprehended in Iraq, I never participated in maltreatment of Iraqi detainees, nor did I witness my

soldiers do so. We always handled detainees in a safe and professional manner.

I am the detaine On September 1 . 8 2003, the day I was detained was Thursday September 18 at . was detained, by coalition forces while I was heading towards my sister's house. Moments before at that time there was an attack on a convoy passing the village of 'Aljuale' And I was about one kilometer away from that incident American forces were there and they came and detained me while I was on my way to my sister's home. They detained me in the street. Approximately ten American soldiers attacked me and started beating me. I passed out They threw water on me and after that put me under a tank and threatened to kill me. I was afraid for my life after that and that I may be killed. I kept saying I was not whO they said I was I did not do this attack against them. I was afraid they were going to kill Me. After that they handcuffed me and transported me to the place of the attack. They brought a weapon and put it in front of me so that they can say that this is the weapon you fought the Americans with About that, I never served in the military. They say I have a weapon I don't know how to use After that they detained many people when they told me that I did not fight by myself, there was somebody with me. I told them there was nobody else with me. But I was tortured in a brutal way. The human mind cannot realize how bad the beating was I passed out and they threW water on me. I gave them names. I gave them names I don't know. They brought them and they are the names on the confession even though they don't know me. And after that they forced me to confess in writing and they told me to write this and that as my statement. I told them I had nothing to confess and they tortured me and forced me to write the confession. I told them that they were with me but that was under torture that day that was organized. INSTRUMENTATION: This examination was conducted using an Axciton computerized polygraph instrument, SN: 4387, last calibrated on the date of the examination.
OBSERVATIONS: Unusual physiological/psychological reactions were not observed during this examination.

III I, WANT TO MAKE THE FOLLOWING. STATEMENT UNDER
OATH .

was deployed to Iraq in command of C Company 1-22 IN
from June 2003-March 2904- My company's sector was the city of
Tikrit. My northern boundary was the border with the town
KadaseeYa. My southern boundary was the border with the town of
Al Owja. My western boundary was the Highway 1 bypass. My

eastern boundary was the Tigris River. On 4 May 2005, CID
showed me a picture of an Iraqi male that I immediately
recognized from an operation in September of 2003- I recognized

him because my company captured him on or about 17 or 18

September 2003.

I had been executing patrols in Tikrit when I
received a call from my battalion commander that the Brigade
Recon Troop (BRT) had been ambushed across the river, southeast
of my position. I was directed to assemble my entire company
and reinforce the BRT. At this time I only had two platoons
available for operations: 2nd Platoon and 3rd Platoon-
assembled my forces and moved east across the river. I linked
up with the commander of the BRT, CPT .

CPT
briefed me on the location of the ambush and the possible
locations of the enemy forces that were attempting to exfiltrate
from the ambush sight. His remaining vehicles had established a
large outer cordon that contained two small villages inside it
The northern-most village I labeled Cobra 1, the southern-most I
labeled. Cobra 2. CPT.also briefed me that he believed
the insurgents to be in the marshy farmlands between the two
villages. He said they were canned with RPGs, PKCs, RPKs, and
AK-47s. He estimated ten insurgents.. At this time two Apaches
had come up on the net and were orbiting to the south. I tasked
3rd Platoon to seize Obj Cobra 2 in order to capture enemy
insurgents. I tasked 2nd platoon as the main effort and ordered
them to clear the farmlands between the two objectives in order
to capture the insurgents, and then seize Cobra 1. The Apaches
were tasked to support 2nd platoon. As the operations proceeded,

second platoon had reached their limit of advance and began
their turn towards Cobra 1. 3rd had seized Cobra .2 and was
processing the detainees. The Apaches had identified insurgents
through the thermals and we were engaging with small arms and
fire from the Apache 30mm. As second platoon continued

marshland. They were covered in mud as if they had been

crawling. Once 2n Platoon reached Cobra 1 the BEWs overwatched'
the platoon as it cleared the village. There was no further

firing. Once the village was clear 1SGIIIIIIestablished the
EPW sight inside the village. The EPWs were flex -cuffed and
blind-folded, then sat in a group on their butts facing

outboard. They were guarded by members of my command, group.
All of the members of the village were treated as detainees and
kept separate from the EPWs pulled from, the farmland. The BFVs
were positioned in a defensive perimeter around the area
en6ompassing both objectives to prevent any non coalition forces
from entering the defensive Position. The Platoons were tied in
by fire. Once both objectives were completely secure and the
hasty defense was established, the 720th MPs arrived and took
possession of all the detainees and EPWs. The detainees and
EPWs were consolidated in an open field near the ambush sight
close to Cobra 2. I did not authorize any abuse to any detainee
or EPW, nor did I witness any abuse.

OATH: Sep 03, C Co, 1-22 IN BN responded to arequest for
support after the BD8 Bim` Was; ambushed on the east side of the
Tigris River in Tikrit, Iraq. The BD2 BRT had taken casualties
and needed help in clearing the nearby area we arrived and 3 rd

nd PLT) wasPLT was given the western objective, while my PLT (2
given the northern objective. Both objectives were same mud
huts. When we arrived it was around 0100 and very hard to see
anything. I pushed my PLT, both infantrYmen on the ground and
Bradley Fighting vehicles (BFV), on line and using the support
of Apache Helicopters to locate any heat signatures in the wood
line and6 foot high grass fields- After we cleared the majority
of the field using night vision and bright flashlights we pulled
back to repair a broken BFV. The Apache spotted another heat
signature in the field no more than 300 meters from my Position.
It was still very dark outside and I had a difficult time seeing

anything, so theAPache pilot "walked" by BFV slowly to the
location of the heat signature. When I got to the location the
Pilot was watching, I pulled out a spotlight and started looking
around.• As I scanned the area I looked directly over the side of

the BFV and noticed a man in civilian clothes in the fetal

oriented my M4 on the man and told him to get up in both English
and. Arabic. The man did not move and appeared to be dead. I
dropped the ramp of my BFV and let the dismount infantry squad
on the ground to begin EPW procedures. I told them to be careful
for boobytraps: As they began to roll him over he made a noise
and he began to move. They searched him, blindfolded him, and
zipped tied his hands behind his back. The EPW was then loaded
in the back of the BFV and moved to the EPW consolidation point
located 500 meters.away. The EPW was turned over to 1SG alle

and we moved to set up an outer cordon until the MPs arrived to
question all the EPWs.

We didn't Imow what was .we only know we were moving across the bridge. When we got across the bridge, our c.o., CPT.with the company's commander who got ambushed. At this time I was our platoon leader's 1 . on his Bradley Fighting Vehicle (BFV) and he dismounted and got briefed by CP .1L.came back to the BFV and told me that a CAV troop had been ambushed by.am and soine militants that were still in the area. At this time, we dropped our dismounts and 1L.ismounted and they all went into a village that was in the area. They started clearing certain houses .heady targeted by the other commander..t them about two hours to clear the houses. 1L called up on the radio and said that CPT wanted the BFV's to move through and clear the surrounding area. We started to move and had an.pache over the top of us telling us were to go. Upon moving through the fields, we found one Iraqi militant lyingin the thick brush. By this time, we had to turn on our lights, because there was too many drop offs in thefield. The dismounts caught up to us and blindfolded and zip c •.• t this time, when they established he had no weapons they put him the back of the SP k. When we saw

they had it under control, he moved out and continued to search the area. 1L
BFV, the Apache called up and said they some heat signature's in a near by field. Our BFV went to the field
with the 23 vehicle. Upon coming to the field, the 23 vehicle broke track. The 22 vehicle stayed with the
23 vehicle and kept over watch on my track. We went through the field one time and didn't find anything,
so we decided to go through again, because the Apaches said there were still heat signatures in the field.
We went through the field one more time and the second time around, I saw something out of the corner of
my eye and I look down and I saw an Iraqi laying on his side. I thought he was dead, because he didn't
move and the track wasn't more than a half an inch from his head. We dropped the dismounts that were in
the back of the BFV and they went and searched him. They found out that he was alive and did the normal
detainee procedures and blindfolded and zip cuffed him and put him in the back of the BFV. At this time,
the Apaches over us said the area was clear and moved all of the detainees to the Casualty Collection Point,
where they were transported to the Battalion holding area.

Q: At any time did you witness anyone strike the detainee with the butt of their weapon?
A: No.
Q: At any time did you witness anyone use a BFV as an interrogation tool?
A: No.
Q: Did anyone attempt to interrogate that detainee?
A: No, the dismounts only asked him if he had any weapons.
Q: Did your platoon have an interpreter present?
A: The company had one, but he wasn't with us.
Q: Did anyone from the troop that was ambushed assist in detaining any militants?
A: I'm not sure, just in our area was our platoon, and they didn't help with that.
Q: Do you remember what that particular detainee was wearing?
A: A white, man dress.

2003. At an unknown time while I was deployed sometime during the night we received an unknownCavalry troop came under fire from some insurgents and my platoon responded. I was in the back of aBradley Fighting Vehicle (BFV) as a dismount squad leader, so I didn't have a headset and didn't get tolisten to much of what was going on. I was given an order my squad was to secure a building with threeinsurgents in it and capture the insurgents for interrogation. Sometime during the night, our BFV droppedthe ramp and my squad deployed. As I exited the BFV, I saw a man lying in the ditch in the field. He wasacting like he was dead, so I splashed some water on his face like he was gasping for air. He went backdown like he passed out. I splashed water on him again andhe woke up.. So I picked. him up, searched him,
,
zip tied his hands behind his back and put him in the back of the BFV. I think we transported him to thecollection point and released him.
Q: Did you witness anyone utilize a BFV as an interrogation tool on that night? -
A: No.
Q: Did you witness anyone use the butt of a weapon to strike anyone in the head that night? -
A: No. Nor did I hear of anyone doing that. In fact, the entire time I was in Iraq, no one used the buttstock, because it was not part of the rules of engagement that we had to carry on us the whole time.
Q: Did you witness anyone attempt to interrogate any detainees?
A: No.
Q: Did your platoon have an interpreter present?
A: My company had one.
Q: Was he with your squad in the field that night?
A: I don't recall.

Did anyone in the Cavalry troop assist in the detaining of prisoners?A:. I don't know.

C: On 9 Jul 04, this investigation was initiated based on a Request for Investigation (0324-04-CID001) from the U.S. Arras
Arrny Criminal Investigation Command, Fort Belvoir, VA, of possible abuse involving Mr On 29 Jul 04, Mr ...was interviewed and provided a sworn statement m which he related he was captured by Coalition Forces. Mr tated he denied the allegations of being involved in an attack on Coalition Forces and only admitted he was involved when he was struck with the soldier's rifle and fists. Mr .elated during the altercation he passed out and awoke underneath the track of a tank. The soldiers threatened that if he did not confess to attacking U.S. Ercs they would kill him. He then confessed to the attack due to fear of being killed. MR .was then transported to the prison in Tikrit where he said he was choked and his head was held under water after he recanted his previous confession. Mr.
MIA stated he had received a bloody nose from the incident and had no scars on his body or
any other injuries. On 26 Aug 04, SS . was advised of his legal rights,
which he waived and providça sworn statement in which he denied an abuse concerning Mr.

SS ecalled the incident where Mr .as arrested, but advised that at no time was bused or struck with a rifle. On 25 Aug 04, S
