The conduct of this investigation determined that Mr. Wwas no sWed as he originally reported. Investigation established probable cause to believe that Mr. committed the offense of False Official Statement when he provided a written statement that did not reflect the same details as he originally reported and statements taken of the personnel who attended Mr. clIrrsinterrogation denied any abuse took place. About 1300, 21 Jun 04, SA tiatior eceived a medical screening report and physical, pertaining to from the DAS, which detailed his allegation of abuse. (See Medical Screening Report and Physical) kr4c-3 About 1100, 23 Jun 04, SAWwith the assistance of LinguistW this office, interviewed11111111.111in reference to his abuse allegation. 111111.P stated the Americans and Iraqi 1- Civil Defense Corp. (ICDC) captured him in Baghdad on an unknown date. He was taken to the ,Airport in Baghdad and put in a small plywood room. While he was in the room, a bald white male in US Army uniform with a male linguist, which he thought was drunk by smell, began to question him about transporting weapons in his vehicle. Each time he answered the question; the white male soldier would punch him in the stomach and say, "wrong answer". This occurred approximately 15 times, but only on the first day of his capture. He was hooded most of the time, but his interrogator would sometimes remove the hood. He recalled seeing the name of 1111111 on the soldier's uniform top. He was rehooded and released from the small room. He went to a larger room where he _ believes he was beaten and kicked by several Kurdish ICDC. He recalled that he saw his interrogator's name on his property paperwork when he turned his property in at BCCF. 10-4z-dic 67-1.1 AGENT'S COMMENT:W spoke some English and was very cooperative, but could not write Arabic well. He recalled Wmaking the allegation of being punched in the stomach, but does not recall specifics. He noted that during the physical, no bruising or scabs were present. A: I saw the interrogator, and he was medium, bald, and has a red brown mustache, and blue eyes, and i saw the translator who was between 40-45 years old, and Arabic, and has a little almost white beard, and the third person was a white tall young man, and about the interrogation room, it was between 4x4 and 5x5M, and it contained an additional small room which contained yellow and orange detainees uniforms. There was a desk and a bed and split air conditioner "Plazma/LG", that was about the interrogation room. Q: Describe the translator, A: He was an old man as I said, short, and has an almost white beard, thin, and wearing civilian clothes, and he had Lebanese or Syrian dialect Q . Describe to us the interrogator. A: The interrogator was medium white bald man, he has blue eyes, and I saw him 4 times, and he was wearing the full military uniform once, and at the rest of the interrogation, he was wearing a brown T-shirt with military pants, and when he was wearing the full military uniform, I watched that his name was -AMR and on the other side there was US Army, and about the color of the uniform, it was the same you are wearing (This Agent was wearing standard Army Dais) 0: Can you describe the desk, which was in the room? A: It was a big metal desk, and I do not remember its-color. Q: Can yau-describe the bed, which was in the room? A: It was a metal low bed, and there was a mattress covered with cloth on it. 0 Describe to us how they hit you? A: They punched me on my stomach several times and kicked both my legs. Q: Were you blinded when they were hitting you? A: Yes, I was blinded. Q . Did the Americans kick you? A. The Americans punched me and the Kurds kicked me. Q. The father, was not at the residence, but two of his sons were. Additionally, approximately 25 million Iraqi Dinar (approximate value 16,000 US Dollars) and 4400 US Dollars were found at the house. All the money was confiscated and brought with the detainees to the Combined Joint Special Op-. .u.iliThk Force --Arabian Peninsula (CJSOTF-AP) Temporary Holding Facility (THFT. MIParrived at approximately 0500 on 15 JUN 04 already blindfolded and with his hands bound behind his back. Inprocessing to the THF consisted of a pat-do„ 1Wbefore he entered the facility, and then being placed into a cell. At 0537D on 15 JUN 04,Was brought into an interrogation rirritirseening. I cannot remember if there was a guard present with me during the screening. Wblindfold and binds were removed, and he was ordered to undres.&down to his underwear. He complained of pain in his shoulder resulting from having his hands bound behind his back. He managed to remove his dishdasha, but complained frequently about the pain. Two full-length photographs were taken of Illp(front and back) as well as a closer facial picture. As soon as I had taken the three pictures, I told 1111111110c -31i9f.-3 he refused to do so, stating he could not raise his arms above his head. Before I returned Unto his cell, I again told him to get dressed, and he again refused, stating he could not move his arms. I flex-cuffed his hands in front of him, replaced the goggles, and escorted him back to his cell. I told him that when he felt sufficiently recovered to get dressed, he was to inform the guards and they would remove the flex cuffs long enough to allow him to dress. I later found out he did that within five minuteWbig returned to his cell. I felt that he was trying to avoid sensitive topics, but in the case of the $ 50 141S. he claimed had been taken, he was correct.
