A Time magazine article claimed that an Iraqi national taken in to custody along with other family members was the subject of cruel and humiliating treatment at the hands of US forces. The charges include physical and sexual abuse. However, the individual profiled in the article did not substantiate the claim, nor was/is there any independent evidence of any such abuse occurring to this person or his family members.

BASIS FOR INVESTIGATION: On 24 Mar 05, this office received Request For Correction (RFC) 0152-05-CID001, from Headquarters, United States Army Criminal Investigation Command (USACIDC), which stated a review of this investigation had been conducted and determined there were administrative and investigative deficiencies within the investigation.
This case is extremely complicated due to the involvement of a Class Action Complaint (hereinafter called the lawsuit), as well as the plaintiffs' attorneys' hesitation to provide information necessary to investigate the allegations, allegedly due to the plaintiffs', fear of retribution. Further complicating this situation is the fact that some of the allegations in the lawsuit were investigated under Report of Investigation (ROI) 0007-04-CID259-80133 death of , Internment Serial Number IS AKA.
The investi ation was initiated based on a Time magazine article re ardin a detainee name
AKA , who was allegedly abused and sexually assaulted by a. female soldier. The ROI included e original lawsuit and an amended lawsuit. The lawsuit was obtained after it was established as the sou.rce of the news article. The amended lawsuit listed eight individual detainees as plaintiffs, including the estate of a deceased detahiee. The ame ded lawsuit also listed a Plaintiff John Doe 1 and a Plaintiff Jane Doe 2 ISN: as well as John and Jane Does 3 — 1050. The Office of the Armed Forces -Medical Examiner (OAFME), Armed Forces Institutesof Pathology (AFIP), ruled1111111111death was a "Natural Death due to Atherosclerotic Cardio-vasculat Disease resulting in Cardiac Tamponakle" (build-up of fluid in the membrane surrounding the heart; heart disease/attack). About 1600, 25 Apr 05, SAIIIIIIIIrand Lin uislIMr. CBI, re-interviewed Detainee.who stated he was captured in his home by us forces in Desert Camouflage Uniform (DCU). The soldiers asked for him and his brother by name and then . handcuffed them and removed them from their home. They traveled separate from his father, uncle and cousin. They were taken to an unknown' location where they were,placed in a room with his father, uncle, and cousin. They stayed there for about three hours. They put all of his family members in the same vehicle along with other detainees and took them to an island in Baghdad.- They were kept over night there and then transferred to a police station run by US Forces. When they arrived at the police station the family was split up and independently questioned. DetaineealliMINstated the interpreter was not translating what he said and was being disrespectful towards him, his family and his way of life. After the interviews, the rest of his family members were taken away. He stayed in the police station for approximately 17 days until he was taken to Baghdad International AirportABIAP). He was taken into a room and told by an interpreter he would be held for 30.years. His clothes were taken from him and he was given a jumpsuit. He was then taken into a room with his face covered where he was hit in the face twice during questioning by two different people that he could not identify. One spoke English and one was an interpreter who had an accent like he might have been from the gulf" region, possibly Qatar. He was only hit twice and did not know why he was hit. He was then
'taken back.to the room he started in, at BIAP. He did not see any of
his family again until visitation. His grandmother told him during
visitation that his Uncle had passed away while in Abu Ghraib.
Detaineellillillasked how he passed 'away, but was told not to- worry
about it. His grandmother refused to further explain. His
grandfather was more than 60 years old and was in good health the
last time he saw him, before he was captured. He ha's seen his.

with the most recent time being 7 Mar 05. He asked his father-and
brother several times if they were ever abused or tortured while in
custody and was told not to worry about it.. He was unaware of any

During the initial interview, Mr. stated he was apprehended with his father, cousin, brother and uncle while in Baghdad, Iraq. He also states that his uncle died in custody fi-om an apparent heart attack while at Abu Prison. Mr. 11111111111.ontends that he nor any of his family members were abused or tortured while in U.S. Custody. l3oth his father, brother and cousin have been released and he had visitation with his father and brother on 7 Mar 05. Neither of them have informed him of any abuses they claim to have received while in custody. 1. This is a Category I Investigation. Results will be provided to this office within 24 hours of receipt. 2. On 22 Oct 04, USACIDC Report of Investigation 0188-04-01)259-80232 into allegations of Assault, Cruelty and Maltreatment and Indecent Acts against Mr.

On 22 Jun 04, this office received information from the Detainee Assessment Task Force,
USACIDC, Ft Belvoir, VA, regarding alleged possible detainee abuse of Iraqi citizens by American.
Forces, as documented in the attached newspaper article.

2.
According to the Time magazine article, a detainee, only identified as aIIIIPclaimed he was
taken from his home on the outslcirts of Baghdad, Iraq, last November 2003, and sent to Abu Ghraib
prison. While there, he was forced to disrobe and attached electrical wires to his genitals and
shocked three times. The detainee also alleges he was held down and forced to have sex with a
female soldier. On 6 Jun 04, the detainee was released. This information was confirmed by
coordination with the prison (see attached article for further details).

Request a Report of Investigation be initiated concerning the inforrnation reflected above.

4.

1. The inve§ 'gado was initiated based on a TIME magazine article regarding a detainee. named who was allegedly abused and sexually a.ssaulted by a female soldier. The ROI inc u ed.he original lawsuit and an amended lawsuit

The lawsuit obtained after it was established as the source of the news article. The
amended. lawsuit isted. eight individual detainees as plaintiffs, including the estate of a
deceased detainee. The amended lawsuit also listed a Plaintif-f John Doe 1 and a Plaintiff q/c.
Jane Doe 2, a3 well John and Jane t)oes 3 - 1050. The ROI focused solely on
and did not address th allegations involving the other named plaintiffs. Because the lawsuit CP-iro,si)
clearly documents alleg ions of abuse involving other detainees, each separate instance of

alleged abuse must be inv tigated. Some of these allegations have already been investigated
in other ROI, as detailed be "vv. The remaining allegations must either be investigated under
this ROI or under separate R if the alleged abuses are not directly related by date, time or

A MP interviewed during the aforementioned ROI stated that the decedent's son and brother brought the sick prisoner (the decedent) to the gate. 3) There are two options for investigating PlaintiffMirlegations, both of which ha.ve complications.
a. Since Plaintiffaillralleged his fa.ther was tortured to death, the first option is to reopen 0007-04-CID259-80133 and conduct all leads in that investigation. The problem with this o tion is that
_ reopening this death case to investigate Plaintiff legation that he was abused would require adding Plainti s a second victirn. 'This would greatly complicate 00 -04-CID259-80133, which was closed after AFIP ruled eath wo a Natural Death due to Atherosclerotic Cardm-vascu ar Disease resulting in Cardiac Tamponade. on the aforementioned detainees, as well as six other suspected insurgents who were also targets of the raid (see attached enclosure). This document identified the individuals listed below (including PlaintiffsIMP, Plainti explained apt arent relationships between them and listed 12-digit grid coordinates to their residences. The information in parentheses beside the miles below was developed from theater detainee rosters based on ISNs and capttue tags. The individuals with ISNs and capture tags by their mines were all captured by 1/37 AR. This office was unable to determine if the others were captured. Although some detainee rosters listed different dates of capture, this wasfilcely due to inattention to detail. Note that the informiation below was included to demonstrate how the relationship between the capture tags and the targets of the raid was used to identify some of the plaintiffs in the lawsuit. The ROI incorrectly lists the offense of Rape. The victirn alleges he was forced to have sex with a female in uniform. This does not meet the elements of proof for Rape and should instead be listed as Indecent Acts.

As documented in Exhibit 11, Mr. gillirstated he would assist in arranging art interview of Plaintiffallef he could be assured ofhis safety. Mr. claimed Plaintiff was fearful of retribution. Although Mr. mentiotte that maybe the interview co be arranged in Jordan, he did not definitive y se to arrange an interview in Iraq. There is no follow-up DII this.

Unreleased, classified parts of' the report on prison abuse from Ivlajor General Anthony Taguba, which were read to TIME, contain indications of mistreatment of female prisoners. In a Feb. 21 statenient to_Taguba,
former head of the Abu Ghraib interrogation center, said e had. received reports that there were members'of the MI [Military Intelligence] community that had come over and done a late-night interrogation of two female detainees" last October. According to a statement by alligiboss, Colonel/MEM three interrogators were later cited for violations of military law in their handling of the two females, ages 17 and 18. Senate Armed Services Committee investigators are probing

I'll only be here for the next 2 hours andiall be leaving for the next 4 days to complete another CA RFA. Mr. provided a cb of the original complaint of 155 pages and a 3 a civil document. Mr. stated he does not have the full ID of Mr.
and has never contac e or been contacted by him. He stated he is
simply a local attorney helping other lead attorney's who are spread out
throughout the U.S. In the document provided are the narnes of the lead
attorney's. The reason for his involyernent is that one of the defendants in
the case iS a corporation named the TITAN CORPORATION, which is a san diego,
ca based corporation, therekwe, he Was requested by another lead attorney
in the case to file the proper documents for jurisdictional reasons. The
courthouse was closed by the time I completed the interview so I was unable

at ESUcca Coordination with the medical clinic showed no records on file.
Also, the MI records are not maintained at Bucca. I talked to
the MI guys and the best they could do was to call their POC at JIDC;
have JIDC send the info to them, then they send it to us and we send it up
to you. Instead I suggest we cut out all the middlemen. I got the POC
info for Chief t JIDC. His e-mail is us.army.mil .

Should be able to ca o . at the same DNVT number. JIDC can
send it directly to you, which would be a lot quicker from the way they were

ing to the Baghdad Correctional Facility Detainee Roster System, this detainee was transferred to Camp BUCCA on 15 Jan 04.
I ran his NDRS on our BATS system and did not get any returns what so ever, I ran his name on our BATS systems,
using several different combinations of first, middle and last, and still did not get any returns matching the data you
provided below. I finally searched the detainee dossiers we maintained prior to establishing BATS, and there was no file
for this detainee.

Bottom line, I don't have anything to offer at this point.
Sorry to have kept you so long...we've been awfully busy down here.

sent to Abu. While there he was forced tO disrobe and attached electrical wires to his genitals.and shocked, which ruptured veins on his penis and refused medical attention. He also alleged he was held down IDy other guards and forced to have sex with a female soldier, while blindfolded with a bag. Other parts of the file St8te he W8S forced to strip naked, and a dog leash was put around his necicand he was forced to be on his hands knees with other detainees.

I have the detainee file from E3CCr;'whiCh has limited information. The one thing that stands out from the rest of the cases here on the TF is that he claims he was abused by guards BCCF and BUCCA, not taken by unidentified individuals and interrogated, which has been the norm in our cases. . ,
We took a look at your spreadsheet and didn't find any information for this individual, and he is not identified in the report from CID Command at the behest of MG RYDER, but he is identified in the Class Action suit.
The detainee was moved to BUCCA and has since been releaSed. He was never interViewed by CID and I have been unable to find any additional records for him, other than the minimal paperwork included in his detainee record from BCCF.
