CID Report of investigation into alleged abuse and sodomy of detainee. Victim was captured on May 4, 2004 “by two males wearing green t-shirts, cargo pants and tan vests, who stated they worked for the Criminal Investigations."He was handcuffed, hooded and transported to their headquarters in Baghdad, where he was interrogated and abused for a period of four days. He was then transferred to Abu Ghraib. A week later, he was again transferred, this time to Camp Bucca, Iraq. For details, see Incident.

Investigation concludes there is not sufficient evidence to prove or disprove the allegations.

This e-mail is in response to the below e-mail you sent to 7' This is my RFA. It seems most of your questions relate to bleeding at the time of exam, however that Is not what my AIR says.
1.
The medical records indicate that the patient's complaint was bleeding from the anus, but what was noted in the exterior hemorrhoid", "oval fistula" and later "anal fistula". Upon interview COL described this as an "anal fissure".

2. See above description.
I believe SSG itj,h.3 statement is referring to the initial screening that all detainees arrive at Camp Bucca. However, upon receipt of your RFA I coordinated with COL and requested "a medical examination specifically for trauma

due to sodomy".

5. MR .was not bleeding,.at the time of examination. COL.stated that due to the scarring, the age of the injury was older then 2-3 'weeks from the time of examination, but a beginning time could not be established.

You read those portions and know my position and the position of the command. This is a very easy case. If there is no medical evidence one or two days later when he was transferred to 39th BDE THF or a week later when he went to Abu then you should close this investigation. If there isn't medical evidence then this terrorist lied and you should find a way to charge him with perjury, filing a false statement and anything else available. That is the only way that these people will learn the value of their word and that there are consequences for a lack of integrity. If you need to interview members of the command let me know and I will coordinate those meetings. ­
