A detainee alleges he was burned with "hot gases" coming from a transport vehicle while he lay on his stomach in the back of the vehicle while being transported. Medical records revealed that the detainee suffered burn injuries which required three months of hospitalization, multiple skin grafts, the amputation of his right index finger, and the permanent loss of the use of his left fifth finger secondary to burn induced skin retraction. The unidentified detainee allegedly suffered extensive burns over his abdomen, anterior aspects of his lower extremities, the palm of his right hand, and the sole of his left foot. It is not known if the detainee received his injuries during capture or transport and whether or not his injuries were accidental or due from negligence, or from a malicious act. But it is known he received his injuries while in custody and to that extent the claim is verified.

This office received a request for investigation (RFI) 0289-04-CID001 from the United States Army Criminal Investigation Command(USACIDC), 6010 6th Street, Fort Belvoir, VA 22060-5506, which requested this office to investigate allegations documented in an excerpt from the International Committee of the Red Cross (ICRC) on the treatment by the Coalition Forces of Prisoners of War and other protected persons by the Geneva Convention in Iraq during arrest, intermnent and interrogations, dated Feb 04.

Honorable Sir, 0176-04 CID253-3:2J5 I am asking your honor, to take some time and read my letter. I would like to inform you that my blind trust in your laws and your fair justice has encouraged me to write to you and ask you kindly to hear my case. Additionally, your kind treatment to me and my fellow prisoners detained in this camp, where your conducting and performance abide by the American and inter-national laws, has urged me today to wtite to you and ask you to hear my case based on my lawful rights and my familial situation as well as my health
conditions. Please receive my sincere thanks
1- March 10/2004, I was informed officially that based on all the information provided I
am considered as a prisoner of war (POW) according to the intemational convention of
Geneva dated on 12 August 1949. I thoroughly ag-ree and respect you decision, but I
would like to clarify the following matters:
A-I worked with the secret services as an (officer). As you might lcnow that the former
Iraqi secret services is a civil institute. And has no relationship whatsoever with the
military work. Its law is totally civilian. Its ranks and functional posts are civilian and
have no relationship with the military law.
B-the ranks varies between a (clerk, assistant superintendent, executive administrator
and dire,ctor manger) while the functional post varies between an (officer, division manager, province manager and general manager). And all these positions are congruent
with civilian ranks in other countries.
C-institute or college graduates are entitled to officer titles by definition while a high school graduate or less than -that is called an employee. In the secret services, more than 6000 employees are called officers while 1500 are being considered as directors based on their years of service. Moreover, more than 250 others are being division managers. So, since served more than 24 years in that job I was a division manager.
D-I have a college degree (university of law and politics). I have never attended any military school or institute. And I was never granted any military rank. Sometimes, even if one is a graduate of military school, police academy or school of national security,
once he or she joins the secret services his ranks are not applicable anymore, and he or
she abide by the civilian codes and laws.
According to. what I have stated above, I was not a soldier, and I was never granted a military rank. Nor have I ever attended a military school. The duties of secret services are
limited to the usual daily job description. In case of emergency, the secret services main job is to maintain order in the country, and has no deal with military operations in defending, attacking or networking with the different bodies of the military. I would like to state the fact that I have never worked or served in any military post or any job that might have military traits. I was never asked or executed any military order. And my duty
during the last war vvas to defend the organization where I used to w-ork as division manager at the secret services. I was captured in my house after the end of the war 2003/7/2. Thus I believe, according to the definition of prisoner of war in article 4-
(A&B), that the nature of my job does not fall under the conditions stated in the
convention. Plus, I think if I had been able to defend my case in front of you, your honor,

the day your court has granted the permission to the prisoners to defend their cases, I
would have explained to you clearly my points. Unfortunately, I was hospitalized at the
time and I could not show up and defend myself.
2- so since article 4 of the Geneva Convention of 12 Aug,ust 1949 was the legal ground of my capture, then I am considered to be a security detainee. Also since the convention defends civilian rights, I believe I am a civilian and should be protected by the Geneva, Convention. With all my respect to your decision, you carmot accuse a suspect with two articles for one act. Therefore, the term prisoner of war does not apply to me according to what I have stated above. And the fact that I have never served in any military or political act or ever have the intention to do so, even after the fall of the regime on 2003/4/9. On the contrary it has been brought to my attention that a group of secret services have started cooperating working with the American agencies responsible of working together in order to maintain order inside the country and discourage any form of regional covetousness and greediness in Iraq, especially those coming dovvn from Iran. I was promised to get a job with them. Unfortunately, my detention has brought an end to this

powers.
3-on 2003/7/2, after midnight, the American forces engirded my house in Baghdad. When I heard the noise of the coalition powers, I asked my nephew to open the main door of the house and let them in without any 'resistance. But they broke into my house through different doors and I was captured without any resistance or refusal. And if I lcnew I was wanted by the American powers, I would have surrounded myself willingly and as soon as possible. I did not know the reason for my capture at the moment. I thought it would be a simple and conventional investigation. I thought that someone who does not really know me denounced me. And me being home on 2003/4/9 is a proof about my ignorance about all what was going around me. Everyone lcnew that I was home.
4- when I was captured I was suffering from a tear on my capillary vessel and a blood thickening in my left leg. I could not walk. And the American responsible whom I do not lcnow his name or rank treated me in a harsh way. My hands were fettered behind my back in a painful way, and they put a plastic case on my face despite my family's begging because I have chronicle asthma. I was pushed roughly to the car that was in front of the house and was on the floor on my belly and_my hand cuffed behind my back, plus the plastic bag on my face. I was wearing very light Iraqi clothes. When we got to the car, the same person put his foot on my back and started screaming and cursing me in English, which I do understand. And after 15 minutes, I felt that one side of my belly and thigh started to burn due to the heated air that was coming out of the car. And the back of my feet started to burn. I asked the responsible to be careful but he did not care. He started slapping.. me on my face, three times. I begged him on the name of God, Jesus and the Holly Bible to be careful but he refused. Due to the bums that I had, I turned on my back with my cuffed hands. They got burned badly too. And after an hour of driving we got to

a.n unknown place. They got me off the car and I was in a bad shape. I could not walk. I
fainted and I was taken to a small hospital by a jeep. I knew afterward that it was camp
cropper. I was taken to a hospital close by on 2003/7/8. A helicopter took me and I was
taken care of. After more than one month I woke up after being under anesthesia.

5- I stayed there from 2003/7/8 to 2003/8/18 and after that I was taken to Ibn-Sina
hospital, that the American forces has taken and used as. military hospital, and this was
my injuries:

1-the upper part of my thumb on my right hand was broken. They operated on me and
they cut the upper part of my thumb and my nail.
2-my forefinger of my right hand was burned and broken. 'They operated on ine in order
to fix it. It is still broke up till now and I cannot move it,
3-i have small bums in my right hand ann.
4-my left hand was broke and I can not move it.
5-my left hand palm was burned brutally. They did operate on it.
6-the back of my left hand was bumed. They did operate on it.
7-the front side of my right and left leg was btirned. They did operate on them.
8- the front side of my right and left thigh was burned. They did operate on them.
9-brutal burns on my belly. They did operate on it.
10-my right and left anldes were burned badly.

6-Due to all these burns, they had to cut big parts of my leg for the prosthetic surgeries.
All this has left big scares and I suffered through the whole surgeries. I had more than 10
surgeries according to the people working at the hospital, because most of the surgery I
had were under anesthesia. I also suffered physically and emotionally due to the
operation and the bad marks that are all over my body. Despite all that I asked the
hospital direction to stop the whole rehabilitation process and to send me to the camp. I
was hoping that they would finish the investigations and let me go back to my family and
normal life in order to get over all the physical and emotional pains. I was taken to the
camp on 2003/10/17.

I am pretty sure that the American authorities share the same opinion. It is a lie invented by the Prague authorities. It is based on true lies told by someone whom I do not even know. I am in prison. I am relying all the time on my friends to help me do everything. Also, the
burns and the multiple operations I have had made me depressed. The scars are extremely
noticeable and will stay with me the rest of my life.

I have no way of making money, knowingly that I have a big family compounded of (two wives, 4 children, one of them is at the university, the others are in junior and high school, a sick and crippled mother, and two sisters.) and I am their official and legal supporter and they have no one else to count on.

Plus I am not asking for any physical or moral indenmity or compensation because I believe it is God's will and I am forgiving everyone for everything that happened to me.

Sworn Statement
On 07/02/2003 around 1/30 AM .1 was sitting with my son and my sister's son in the saloon of my home located in Baghdad /Alkarakh /Alkhadra district area number (631) street number (26) Home number (19) watching a program in the TV when we heard a sound of movement of people out side the house. So I asked my sister's son to open the door to make sure of that because Baghdad city was not save by that time .entered my sister's son, told me the American forces surrounding the house from all directions. My house located in a cross of two roads, I asked him to open the door for them to enter so to avoid exposing my family to the danger and works of violence and breaking into. They entered through the main entrance which opened by my sister's son, broke through the kitchen's door and the door of my second wife's apartment in the upper floor by breaking and exploding. Then I, my son and my sister's son were handcuffed from the back, and the rest of the family members were put to gather in one bed room. I didn't resist or complain the military force, I remained in that condition for more than(45 minutes) though I was unable to move because of my injury of shredding of the hairy blood vessels in my left foot , I informed the responsible person about that , later they put a sack on my head and I requested from him to lift it up a little because I have asthma and can't breath , then one of my family members requested to hand me the medical sprayer which I use ,then they allowed me to have it and then put it in my pocket. I was removed from the house with my hands tied to the back and a sack on my head, the same person ordered me to lie on my stomach inside one of the military jeep cars parking in front of my home entrance which (it's engine was running) for a while, I felt the bum of the heat in my stomach. After the car was driven for fifteen minutes .the heat began to increase and I requested from the person responsible of me to help me by any way to protect me from the heat but he refused and he hit me on the head and he put his foot on my back and refused to show any help to me . After more than 40 minutes I asked him again to helping me after the smell of the bums of my body began to spread in the car but he refused and he hit me also repeating the word (I hate you several times) and to avoid burning my all body, I turned over my body to the back side where my hands were burned also. when we arrived the camp I was unconscious which led to my not being able to walk, then same person and other one carried me from hands and feet and put me in a front of a stopping car, and I was carried to camp Cropper hospital and I was given an emergent treatment then I was sent to a closer hospital where I slept for the purpose of cuttin off the burned skin.

Prepare your AIRs for all files, to include SDFs. Make sure all AIRS are signed upon transfer of cases, and a copy is placed in the case file.

6. Place note envelopes in every file.

I don't see the actual collection of med records for when 11111/as at the 28th CSH. Many attempts to find (28th CSH in the rear at Bragg did not have them, they weren't at NPRC or Vets Records, St Louis, MO, they weren't at PASBA, Ft Sam Houston, TX) the records met with negative results. As I said before it seems like, at least some of these records are with the Cropper records already collected. We have not been able to locate med records before from the CSH's and after looking at the former CSH's, the PASBA and NPRC still could not find them. Make sure all efforts to locate them are annotated in AIRs. That is all we can do on that aspect.

TF's. There was no way to determine who used the names on any different
mission. Further, the people that filled out the capture documents were not the
capturing soldiers. They were the soldiers that the capturing soldiers dropped the
detainee of with for transport to the, Detention Facilities. If it was necessary he
could find the soldiers who did the capturing of a detainee.
On 0128-05 — they never had this detainee and were not involved in his capture.
0125-05 — it was listed that detainee resisted so miniznurn force was used to subdue. He would not interview further.
He is still working other leads for us.

excerpts from the Report of the international Committee of the Red
Cross (ICRC) on the TreatMent by the Coalition Forces of Prisoners
of War and Other Protected Persons by the Geneva Conventions. in

-Iraq During Arrest, Internment and Interrogation, dated Feb 04,
wherein a "High Value Detainee"- reported being abused while
detained in Oct 03.

2. Coordination was made with MAJ.Chief,
International Law, CENTCOM CCJA, whO related the Multinational
Force-Iraq (MNF-I), has overall responSibility for the Iraq theater
of operations and-is the senior headquarters to CJTF-7. ACcording
to MAJIIIIIIrtinINF-I would be the responsible party to make both
policy and legal determination concerning allowing USACIDC access
to ICRC employees.. As such, this headquarters was unable to obtain
additional information concerning the referenced ICRC allegatiOn. A
search of all available USACIDC data failed to disclose the
initiation of a USACIDC investigation concerning the referenced

ICRC allegation.

information reflected above.

Request acknowledgment of this RFI no later than 24 Jun 04.
Further, request the sequence/report of investigation (ROI) number

liberty in the "High Value Detainees" Section in
October. 2003 who had been subjected to a similar
treatment. He had been hooded, handcuffed. in the back,
and made to lie face down, on a hot surface during
transportation. This had cauSed severe skin bUrns that
required three months hospitalization. At the time of
the interview he had been recently discharged from
hospital... He had to undergo several skin grafts, the
amputation of hiS right index finger, and suffered the
permanent loss of the uSe of his left fifth finger
secondary to burn-induced skin retraction. He also.
suffered extensive burns over the abdomen, anterior
aspects of the lower extremities, the palm of his
right hand and the sole of his left foot. The ICRC
recommended to the CF that the case be investigated to
determine the cause and circumstances_of the. injuries
and the authority responsible for the ill-treatment.
At the time of writing the results of the report were
still pending'.

I have so far been unable to locate any such record8. I met dead ends at the Human Resources Command - St Louis (formerly Army Reserve Personnel Center) records center so I contacted the 28th Combat Support Hospital at Ft..Bragg. They indicated- they believed some records were. possibly sent to "St Louis" but had no idea. where exactly they were sent. They did have a bok of medical treatment records from Iraqis, they treated while deployed. The two individuals in your RFA's did not have any records. in that box. They thought perhaps the records went to the Veteran's Administration Records repository in St Louis so I checked with them, again with negative results. VA told me that had they received those type of records, they would have returned them to the-•sender since they are not authorized to. maintain them..
