Investigation found evidence to prove that an Army Captain committed offense of Maltreatment and Cruelty when he directed a civilian to instruct Iraqi looters to disrobe and had the words for "sinful thief" written on the bodies. Photos withheld because they depict foreign nationals and Americans.

INVESTIGATIVE SUMMARY:
On 1.8 Jun 04, this office received Request for Investigation ut.FD 0275-04-CID001, from the
United States Army Criminal Investigation Command, 6010 6 th Street, Fort Belvoir, VA 22060-
5506 (USACIDC), which requested this office investigate allegations of detainee abuse which
were published in the Dagbladet, an Oslo, Norway, based newspaper.

Investigation established there was sufficient evidence to prove the offenses of Larceny, Wrongful Destruction of Private Property and Conspiracy did not occur as alleged. Further 5 bC-5 investigation established there was sufficient evidence to prove CPT 1111111.111111 committed the P offense of Cruelty and Maltreatment when he directed Mr. (formerly SPC)111111.1111111111.11a
to instruct Iraqi looters to disrobe and had "Ali Baba Haram", which means "sinful thief', written
on the bodies of the naked Iraqis,

1.Preliminary investigation disclosed Mr. photographer, and Mrs. OW reporter, both of the DAGBLADET, observed four American Soldiers escort four naked Iraqi ales, all suspected of attempting to loot small arms, into a building and "a minute later" observed the soldiers ush the Iraqi males out of the building. The unclothed Iraqi's then fled the area in a nearby vehicle. Mr. L ..7/, allegedly returned and spoke with reporters after he clothed himself with a pair of shorts he found °

On 23 Jun 04, coordination with Mr. ili111011111 Chief, Imaging and Technical Support Branch, United States Army Criminal Investigation Laboratory, 4553 North 2nd Street, Forest Park, GA 30297, (USACIL), was made to review photographs, obtained from a website of the Dagbladet news aper dated 25 „ April 03, to determine if the photographs had been altered or were superimposed. Mr.4111111. stated, based' upon visual examination of the photographs, the lighting direction and the color temperature of the images appeared to be unaltered, but without greater resolution the edges of the personnel were not sharp enough to 17 determine if the personnel were superimposed onto the photograph. Further, Mr.111111111 stated due to lo resolution of the photographs, a reliable forensic examination was not possible. A formal lab request was not sent as noted in the Agents Activity -Summary (AAS) dated 23 Jun 04. ()

3. On 15 Jul 04, a Sworn Statement was obtained from CPT ann. who stated he was in charge of securing the park that was being looted for weapons from a weapons cache. After speaking with Iraqi park, workers, CPT dillairmade the decision to strip the looters and write "Ali Baba", roughly translated to "sinful thief'. The same group of looters continued to return to the park and were warned this would happen to z
rthem. CPT.... denies personally stn ping or writing "Ali Baba" on the looters and any assaults that
state he and his soldiers responded with the minimum amount occurred against the looters. CPT of force necessary to apprehend the looters and that h e did speak to news reporters and the article was skewed and did not reflect actual accounts of the event CPT referredto a 15-6 investigation during this' interview. During the question/answer portion of the statement CPT , invoked his rights and 4/7c' requested a lawyer at which time the interview Was terminated.

stated the looters were warned of what would happen to them if they were caught looting. The

He also denies any asspults committed against the looters. He stated that he and his soldiers responded with minimum amount of force necessary to apprehend the looters. CPT

Approximately 15 months ago, around the end of April 2003, an incident
took place in the company in which I was the commander where 1St Platoon
had on two occasion stripped Iraqi looters and sent them out of the
Baghdad Zoo. I believe it's imPortant to understand the circumstances
around these isolated events. As a company in Task Force 1-64 Armor We
had just completed 6 weeks of high intensity combat operations including
pitched battles at Objective Rams, An Najaf, Karbala, Al Mumiydiah, the
first Raid On Baghdad, and 2BCT 3Idst final assault on the city. In the
middle of April our mission changed suddenly from high intensity combat
operations to peace support operations and my engineer company was
assigned the Baghdad zoo to secure and operate. We were strung very thin

and assigned 1st Platoon the mission to patrol and secure the zoo and 2Platoon the ' ,iesi ra9per3t ---t
phe zoo including feeding the animals,
trying to.maintain the zoo etc. My third platoon,
Assault and Obstacle Platoon was overwhelmed with trying to maintain and
recover their equipment, much of which was damaged or destroyed during the
war and they were on missions that took them all the way back to Kuwait to
recover lost equipment and therefore were not available to assist in
securing and operating the zoo. During the initial weeks after the war
looting was rampant across the city and we still came under frequent
mortar and insurgent attacks in the zoo and we also were assigned patrols
outside the zoo to assess and attempt to repair Baghdad's infrastructure
including power stations and water stations as part of the task force's
patrolling requirements in and around Baghdad. Because looting had become
a major concern for the command in 3ID we were put under tremendous
pressure to stop the looting taking place in the city. Since lst Platoon
was given the mission of securing and patrolling the zoo they would most
often be the ones to catch looters stealing furniture, vehicles, sinks,
tools, and even animals from the zoo. We weren't given any support from
higher HQ to assist in these policing actions because the task force and
brigade were also strung thin trying to accomplish all the policing and
rebuilding tasks being assigned. We made a holding area out of a nearby

have any NIP support during these operations and we Could only send Iraqis
we caught looting to Brigade where the MPs could control them if they
committed more serious crimes than stealing sinks. If we captured
insurgents blowing up ammunition caches or captured as POWs during an
insurgent operation that would have been an appropriate reason to send
them to Brigade. The policing mission was a difficult mission without
specific support despite missions we were already conducting and in
addition to securing the zoo. By the end of April we had some success in
hiring local civilians to help us carry out our zoo operating requirements
and they assisted us primarily in feeding the animals and cleaning and
repairing the zoo. We were getting very frustrated with the failing
effort to stop the looting and the pressure from every level of command was great to stop the looting. After the incidents in question took place
I was informed by 1st Platoon that the Iraqis we hired were also getting very frustrated and several had suggested to 1 st Platoon that if they
stripped the repeat looters and sent them out of the zoo that they wouldn't loot anymore. My understanding from discussions with 1 st Platoon after the incidents took place is that they had several Iraqis that were coming in and looting on multiple occasions and that holding them for eight hours in the tennis court was no deterrent because they had returned 4-5 times despite the time they spent in the holding area I believe that
1st Platoon, in the spirit of accomplishing their daunting mission of securing the Baghdad zoo which is a very large area in Baghdad, were desperate to stop the looting and unfortunately they stripped these few Iraqis and sent them out into the zoo without being fully aware that they were breaking any rules or conventions. Given the heavy combat we experienced up to that point I believe that this seemed to them like a
relatively minor punishment to inflict on the looters who just seemed to keep coming back. I was not aware of 1 st Platoon's intent to strip these repeat offenders before the incidents took place and I found out later

that it happened on two occasions. After the 2incident took place the6 7 platoon leader, 11,11 Ammo informed me of what had transpired and he 6-5 also said that reporters had taken pictures. I told . that they,7C5 are to never to this again and informed the rest of the company that this .5 was not acceptable, and incidents like this never happened again. I immediately informed my chain of command of the situation within an hour Of finding out and a 15-6 investigation was initiated by the Commanding General, 3rd INF DIV, to investigate the incidents. The investigation took place and we ware all questioned and asked to make statements, which we did. The 15-6 was presented' to the Commanding General who approved the

Until recently I believed that the case had been closed. Fifteen months
ago lst Platoon was in a verydifferent and difficult situation under daily

I believe that the command at every level also felt that this isolated

incident didn't warrant further Punishment as demonstrated by the

escort our naked Iraqi males, all suspected of attempting to loot small arms stored at the Zawra
Amusement Park, Baghdad, IZ, into a building and "a minute later" observed the soldiers push
Ile Iraqi males back out of the building. The unclothed Iraqis then fled the area in a vehicle with ,
a friend who was waiting nearby. One of the Iraqis, identified as Mr..N.Nms allegedly .17
returned and spoke with reporters after he found a pair of shorts to clothe himself. The 676_ cf.
documentation also identified the officer in charge of the soldiers, 1LTammummingp
Squadron, 10th Engineer Corps (NFI), who allegedly told the reporters he and his soldiers took
the Iraqis' clothing, burned the clothing, wrote the words "Ali Baba Haram" in Arabic, which
roughly translates as slang for "sinful thief," on the chest of the Iraqis, and forced them to walk ,

On 23 Jun 04, SAMIllicoordinated with MrallialliMMI Chief, Imaging and Technical Support Branch, United States Army Criminal Investigation Laboratory, 4553 North 2" d Street, Forest Park, GA 30297 (USACIL), who stated due to the low resolution of the ‘64--photographs, a reliable forensic examination was not possible. Mr .stated, based uponvisual examination of the photographs, the lighting direction and the color temperature of the images appears to be unaltered, but without greater resolution the edges of the personnel were not sharp enough to determine if the personnel were superimposed onto the photogra.ph.
