Criminal Investigation Command (CID) report into allegations of assault, cruelty and maltreatment of a detainee by guards at Abu Ghraib. Among the detainee's allegations, he stated that a US Army Sergeant hung him by his arms from the bars of a metal door with his feet off of the floor for two hours. The detainee also recounted abuse he suffered at the hands of the Iraqi police prior to being transferred to Abu Ghraib. The investigation concluded that the offenses did not occur as alleged based on lack of medical documentation, inability to determine if a scar was the result of a cigarette burn and based on a statement by a soldier that the victim was "like a hypochondriac."
However, an assessment of the investigation stated there was no evidence to justify the finding that the allegations were unfounded, it was recommended that the investigation be re-opened.

This is an "Operation Iraqi Freedom" Investigation,
On 7 Jun 04, this office received Memorandum of Transmittal (MOT) 0051-04-CID789
from the 75th Military Police Detachment, Baghdad Central Confinement Facility, Abu

On 3 Mar 05, this office received information from the Operations Officer, 1 l th Military 1

(MP) Battalion (Bn)(CID) (FWD), Camp Victory, IZ, reporting receipt of request
for correction (RFC) (0115-05-CID001) from the United States Army Crimina l
Investigation Command (USACIDC), which revealed the necessity for additional
administrative and investigative activities,

Further investigation determined there was sufficient evidence to believe the offense of
Assault did not occur as alleged based on there bemg no medical documentation to suppo r
Mr.- s allegation, Mr did not report the incident for six months; a military
intelligence interrogator made a statement that the detainee was like a hypochondriac; an
there was no way to determine how old the scar was or if Mr. 11111.eceived the scar
from a burn as he alleged.
Further investigation established probable cause to believe the offenseof Cruelty and
Maltreatment did occur when unknown female(s) detention guards observed Mr.1111111,
take a shower as a means to embarrass and insult him.

Whilejn Iraqi Police custody, he was beaten, which resulted in broken ribs and a broken hand. He was transferred to the BCCF, on 2 Jan 04. He was then transferred to the "hard site", Tier 1, on 5 Jan 04. He said that once he was in his cell, about 0100 hrs, a fat, black, male soldier in uniform, named SGT im from his room with no lights or windows. Once inside, SGT

howed this agent a scar on his right thigh that would be consistent with a cigarette
burn. He also showed this agent surgical scars on his abdomen and left elbow, which he alleged,

On September 15, 2003, I was arrested by Deyala Police Department in Yaacioba and I was
tortured there by the Police department. My left hand and one of my left ribs were broken as a
result of the torture. On Janurary 1, 2004, I was transferred to Abu Ghraib prison and on

jJanurary 5 2004 I was tortured by a black American soldier named who broke my b. cd.5

hand and stripped me in front of the female soldier's, and placed me under the cold shower for
15 minutes, and repeated that act at a second and third day, and he dipped his lighted cigarette
in my right leg, and turned on a noisy recorder all the night, and that is my statoMent.

I, want to make the following statement under oath: I am making this
statement freely.
On the night in question, either the sixth or seventh of January, 2004, tali' iLc,li6-0Y
moved from the room at Screening to Tier One of the Hard Site, also referre to as Segregation.
The reasoning behind this was to provide him safety and anonymity from all other detainees,
while maintaining security required when local nationals are on post. We had been keeping him

in a half furnished roo in Screening, and had been guarding him ourselves 24 hours a day for about three days, while we tried to find better accommodations. We had not considere of detainee, per se, but as a guest; we saw the interrogations as debriefings. Unfortunately, the
, ,, prison has no facility for debriefings, we were not able to continue the 24-hour personnel
1" resources, and Segregation was the best we could do for him. To improve the situation, we

To make matters worse ythe woman had required that he move his hands from where they werecoveringlis genitals, She explained tolligthat it was necessary so that she could ensure he was not illicitly bringing anything into the facility. OW said that his own wife of 18 years had never seen him completely naked, and that this American woman had done so. I think he was also bothered by the casual or unceremonious nature of it I supposed that he felt she should have been coy or less direct about her visual inspection.. I think said that was also present, and that he had come and gone from the shower room while
am,was showering. I do not remember if aid that he had ultimately moved his
hands, or if they had been forcibly moved by one both of the MP's, but I do recall, that he was
told to do it quite a number of times'. Whenliarrela.ted the story to me, I was upset and told
him so, but I also tried to downplay the experience, wanting to minimize issues with US
Personnel, as we still viewed his presence as essentially voluntary. Consequently, I did not press VMS done with hat day; I returned to my office and briefed

days a week, for an average of three and a half or four hours a day. I found that he was prone to exaggeration, sometimes gross exaggeration. Hewas also a hypochondriac, regularly announcing some hew disease or symptom that he was suffering from. He told me of the sudden onset of diabetes he was experiencing, thathis teeth were beginning to fall out, that he was suffering from intermittent bouts of temporary ,blindness, and that he was experiencing sudden spells of unconsciousneVe tglcr once that during onetiatitAirgqis of unconsciousness, he feillAndhita bad on a wall. He grabl46W-hancrtd , show me the bump on his head. What I felt with my fingers was not a bump but a skin-colored, raised mole on the right side of his head. There was no bump. There was only one female MP present when I left Segregation that night. I saw her on duty in Tier One many times after that. She always seemed good about ensuring that fagwas well taken care of. gip occasionally complained that the guards had removed hii-s-h-eet, and each time, I spoke to them to try and ensure that it did not happen again. He also said that they were occasionally brusque with him. Aside from that,gysignever complained that he had been mistreated in any way. Whether or not wife has ever seen him completely naked, my impression of his modesty was reduced by tales he told about women he had dated, both before and during his marriage.

A. About three years and seven months.

Q. What is your current position at Joint Task Force-B (JTF-B)?

A. I am a Counter Intelligence and support Force Protection as a de-briefer.

Q. How long have you been in that position?

A. Since 2 June 2004.

A. YeS, I was deployed to Iraq from 19 Oct 2003 through 10 April 04. I am not
exactly sure about the dates.

Q. Were you assigned to the Baghdad Central Confinement Facility (BCCF), Abu

A. I was assigned there from 19 Oct 2003 through 10 April 2004: I spendtall my

He then kept going to the U.S. Armed Forces to provide information. At one point
the AtmedForCes ordered his arrest to prevent him from keep coming to them. As
far as I know he spent about a month in jail and when he was released, he then

' went 'on his own to AGI to volunteer information again. It was then that he called the attention of Army MI community and he was placed on AGI as a friendly source of information. Therefore he was not considered a detainee.

A. The first time he was moved from the inprocessing center to the hard site I
wasn't present. When he was moved from the hard-site to his room we moved him
and provided security to him, so there was no Military Police (MP) contact
between them. Then we transported him back from the Room to the hard site, so
again there was no interaction between MPs and him. Everytime he was
interrogated we would go and transport him and on those occasions the only
contact between MPs and.

official manner with the proper authorities. These instructions came -from t

BASIS FOR INVESTIGATION: This investigation was initiated based on a Memorandum of
Transmittal (MOT) 0051-04-CID789 from the 75 th Military Police Detachment (MP DET),
Baghdad Central Confinement Facility, Abu Ghraib, IZ .(BCCF), which related Mr.ffIEN
NDRS laimed he was assaulted by guards while he was detained a
BCCF.
About 1000, 9 Jul 04, SAMIllinterviewed SSG .372nd Military Police Company (MP CO), 515 th Combat Support Battalion (CSB), Baghdad, JZ, who stated he assumed duties Assistant Noncommissioned Officer in Charge for night shift guards at Tier 1, BCCF, on 19 Jan 04. SSG stated prior to this date, he worked as the Force Protection NCOIC and had little contact with the detainees. SSGENlatstated he never witnessed the abuse or maltreatment of any detainee. SSG stated he had no knowledge that any detainee was burned or beaten. SSG so stated he did not know of any detainee who suffered broken bones while at BCCF or was handcuffed to hang from his cell.

SSG and SPC SOT as identified as being assigned to the 2' MI BN,
Darmstadt, Germany, SSG was identified as being assigned to the 205 th MI BN, Camp Zama,

Any criminal investigation where the remaining leads to be completed are best conducted by another criminal investigative unit, office or organization will have 2" Status Reports completed referring the investigation to HQUSACIDC. After the 2nd Status Report is dispatched the investigation will be written Final Referred, reviewed by the Team Chief, Special Agent in Charge and Detachment Commander, before being closed and sent the HQUSACIDC. Once received by HQUSACIDC it will be determined which investigative agencY is best suited for completing the investigation (i.e., NCIS Flu...) and the investigation will be forwarded
