Detainee alleged being kicked and punched, shocked with a Taser, and threatened at knifepoint at Kheriolla House. Detainee said his face was covered with plaster until he almost suffocated. Medic examined detainee to determine if he was fit to undergo interrogation. Medical exam showed scar consistent with knife wound and scars consistent with electric shock injuries. All counts of aggravated assault, maltreatment and cruelty are unfounded. Claims were unsubstantiated due to a lack of evidence.

On 1 Jun 04, this investigation was initiated upon receipt of a Memorandum of Transmittal (MOT) (0042-04-CID789), from the 75 th Military Police (MP) Detachment (DET) (CID), Ba dad Central Confinement Facility (BCCF), Abu Ghraib, IZ (AGI), which reported

alleged he was abused while detained at the Kheriolla Tolfah House, Tikrit, IZ.

On 6 Oct 04, during an administrative review of this investigation, it was noted ,)--11 17C-4 and were canvass interviewed at BCCF, AGI, on 25 Jun 04, in reference to their b6-4, knowledge of injuries. During the interview, both reported they were alai b6 -b1C -4 abused while detained at a detention facility in Tikrit, IZ. These allegations were inadvertently missed and left undocumented until this time.

Investigation further determined an AR 15-6 Investigation into numerous allegations of detainee abuse was conducted between 15 May 04 and 10 Oct 04, in which was included the specific allegations made by and embers of the b4-4, 6--e.?-4-capturing units and involved interrogators were interviewed as part of the investigation: The allegations of abuse claimed by the listed victims were unsubstantiated due to a lack of supporting evidence.

On 7 Jun 05, this office coordinated with MAJ Office of the Staff b6 -`I Judge Advocate (OSJA), 10 th SFG, Special Operations Command, Forward Operating Base (FOB) Central, Baghdad, IZ, who opined there was no probable cause to believe the offenses of Aggravated Assault, Cruelty and Maltreatment, and Conspirady occurred as alleged; therefore, they are unfounded.

He sated he was captured h6--ttic-1 about 0200, 27 Apr 04, while at his home in Tikrit; Iraq, He was taken to the Saddam's uncle's hbuse in Tikrit,• which is .now used as a American military post. He stated he was detained and interrogated at the hOuse for eight days before being transferred to a local Islarnic SchOol in Tikrit. He said he arrived at Abu Ghruyeb on 24 May 04. When he arrived at the house, he was blind folded, hands tied behind his back, and stripped naked. He could see below his blindfold, one white male in an American uniform and one Kurdish interpreter. When they would interrogate him, he would be lying on his stomach with his hands behind his back. During the first days of interrogation, they would only slap him. As time went on, they would kick him in his ribs and face, When he would deny the allegations. He stated the Kurdish interpreter mostly kicked and hit him, but the American was present and sometimes' participated. He stated that at some point during the seven days, he suffocated to the pOint he passed out When he awbke, moUth-to-moUth resuscitation was being performed on him. They would also step on his shoulders and pull his head back until head became unconscious. On the second day he stated he was shocked with a tazer type device on his leg. At one point, the Kurdish interpreter held a knife to his arm and threatened to cut him. Although he received a cut, he stated it was an accident. He continued to state he was naked the entire seven days with no food or water. He stated his abuse caused a large dark bruise on his ribs, blood in his urine, blackened eyes, and a bruise on his nose. He said he reported the abuse to the American head of all interrogators at the School, which is called Abu Mohamrned, but was told that nothing could be done. He said he was not abused or mistreated at the school or Abu Ghruyeb. icic-q AGENT'S COMMENT: 11111111=eferred to thq American as Captain. On 25 May 2004 I talked to a 34 year old detainee NDRS # empwho came to me for routine g-41 medical screening to determine if he was medically fit to undergo interrogation, During the course of the evaluation, the patient reported 28 days prior experiencing physical abuse while in Tikrit, at the "Kheirolla tolfah" house. The patient reported he was hit in the head, abdomen, shoulders, and back: He also stated that food was withheld from him for 7 days. He stated that following the injuries, his urine was red for 7 days and one time he passed blood out of his rectum. He stated that the injuries were inflicted by 5 Americans and one Kurdish person. He said that the abuse took place at the Kheriolla tolfah house. The patient initially talked to the in processing staff prior to seeing me and a report was initiated. The patient also said he was interrogated at that time with his face covered with "plaster". He said that at one point he became short of breath and required "mouth to mouth" resuscitation. He also stated he was hit with "power" on different parts of his body. He indicated this was a device of some kind that produced electric shocks. He also Stated he was cut in his left arm area with a knife. His exam showed a linear scar in the left arm that was consistent with a knife injury. He also had multiple circular scars on his extremities consistent with the electric burn injuries the patient described. He also had handcuff abrasion marks on his wrists. Pictures were taken of all visible injuries. He complained of a headache. After my exam, it was determined he was fit for interrogation. He was given Tylenol for as needed headache relief, and discharged to the Vigilant prisoner camp.

I saw Mr daily while he was in our custody. b.b More than once a day. We had to feed the prisoners, check on them. I interrogated Mr 1111111111.about two or three times. interrogating him. A lot of times during my interrogations I had a medic with me. I recall one time when we got him out to feed him, he started to fight us. All we did was subdue him by grabbing him and bringing him down to the ground. We always used the minimal amount of force. When we located him in the house, he was sleeping and we kicked down the door to his room and asked him his name. He told us his name was IOW That's when I told SFC111111111111N5‘. -4, 61c `f that he was our guy, and while he was still laying down, he grabbed for my M-4. At this point, I made a decision not to shoot him because his wife was in the room and I didn't want to traumatize her. I used the force necessary to subdue him and get him in flexi-cuffs and blind folded. At that time, we handed him off to the Sensitive Site Exploitation team. They come in the house behind us and take control of whoever we arrest because we have to move on to the next target. At the time of Mr rrest, he was not seriously injured. While he b 6 1, 1)16-was detained in our facility I interviewed him twice and never used force. He was combative at times, so when I interviewed him, I kept his blind fold on and his flexi-cuffs on. I never beat him or abused him I never electrocuted him and he was never starved. He was fed three times a day the same food I ate. If any of the detainees needed medical attention, the medic was standing by.

A: Other than the marks on his wrists from the flexi-cuffs, he was fine. And when I handed him over, I even informed the NCO at the in-processing desk of the injuries on his wrists. I also warned them that Mr was combative and to keep two guys on him. to -A-
Q: When you arrested Mr did you ask if he was taking any medications or had 1064 k/C -te any medical problems?
A: Yes, and he said he had no medical problems and was not taking any medications. That was standard practice for us to ensure that if we did find any medications in the house, we would find out who they belonged to, and if they belonged to the person we were arresting, we would take it with us.

in the morning and we went in to the house. He was sleeping on the floor with a pregnant woman. As soon as we went in to his room, lie became belligerent and we were telling him to put his hands on his head. He would not comply with what we were saying, and he grabbed the barrel of MSG IMISM-4. When he did that, I immediately butt stroked him in the side/back ig-6 k 7c -V of his head. He was still holding II= barrel so. I came around to the front and butt stroked 66 -q, b1 c -1-f" him in the front of the face, then I hit him with my forearm to get him down on the ground. He was on the ground and we were trying to detain him, he was resisting so I hit him in the back of the head with my forearm. We were finally able to flexi-cuff him, at which time I did not hit him again, because he was under control by that point. We took him outside, put him on his knees facing the wall and we moved on to the next house. When we left him, he was not injured other than he may have had a small cut above the nose.

A: No, other than a couple times I may have guarded when he was being brought food. I also helped guard when they took him to the vehicle to take him to the DCCP.
Q: When he was released to the DCCP, what was his condition?
A: I was not there when he actually arrived at the DCCP, but I saw him walk to and get in the vehicle that took him, and he was fine.
Q: How long did he stay on the compound with your team?
A: I'm not sure, but I think only three days.

A: I'm sure that did not happen. And if he did require resuscitation, the medics would use an oxygen mask, they would not perform mouth to mouth.

He was blindfolded and his hands were tied behind his ack with plastic ties and he was transported to a military base in Tikrit, possibly to an Iraqi Military eadquarters Compound. Mr. stated he was placed in a room, where he was left for two days withic.6 approximately 30 unidentified people. After the second day, six unidentified American intelligence individuals arrived and transported five detainees, including Mr. FIllindfolded with their hands tied behind their b6 ack, to the former Ministry of Defense house. Mr. stated the house was only a couple of minutes 1)6-away. Mr. MN was taken to a 120cm x 60cm x 120cm room, where he spent three days with his hands b4- loic ied behind his back, blindfolded, humiliated, and beaten. He was not released to go to the bathroom, was not fed or given anything to drink. He would be beaten if asked for food, water, or to go to the bathroom. Mr. was beaten on two occasions for a couple of minutes. The individuals who beat him were not106-4,,13• erican soldiers. The individuals spoke Arabic and Kurdish and were from the Iraq Civil Defense Corp (ICDC). A Kurdish translator was also present. The beatings consisted of being hit with a square, wooden stick on top of his head, across his back, and on his legs. He did not suffer any injuries from the beatings. Mr. stated he did not see the individuals due to being blindfolded. After the third day, he was taken to b6.-another room where an English-speaking civilian, who looked like an Iraqi, with a beard and stocky build, nterrogated him with the assistance of a Kurdish translator. He was untied, but the blindfold was left on. He as able to see the interrogator due to one time he removed the blindfold, but was hit on the head and told not
o turn around. Mr. - was not able to identify the translator. The interrogation lasted about an hour. t6
fter the interrogation, he was taken to South Tikrit to seek medical attention for his shoulder joints. U.S. soldiers evaluated him and provided medicine for the pain he had in his shoulder joints due to having his hands ied behind his back. Mr. gm"was interrogated a second time, however there were no beatings that h6 -4-ti occurred. The interrogator was a tan American wearing civilian clothes and the interpreter was wearing

They arrested me in my home late at night on 4-27-2004 by American forces and I was sleeping. I woke up one explosion sound that they put to open my door, and after they entered the house I got out of the bed and I stayed in my room I welcomed them in English they screamed and came toward me they handcuffed me and took me outside the house and throw me on the street on my face and one soldier stepped on my back after that they took me to the prison called the North location and after two days 6-5 group of people entered the cell including the masked linguist. They handcuffed me and blindfolded me with a tape. They took me to a car that look like a Land Cruiser with a group of prisoners and they took me to a different location that belong to the American Intelligence and it's the house of in Tikrit and they put me in a 15C-41L •tc -At small cell about half meter wide and one meter high, and I stayed in the cell handcuffed and blindfolded for three days without water or food including the psychological depression by using loud bad music and banging on the metal cell roof and after that two people took me, one of them is the Kurdish linguist that hit me on my head with his hand. When I got out from the cell he was wearing black mask with two holes for his eyes and a hole for his mouth he was hitting me and pulling me and saying lets go dog they took me to a big room and there was a wooden box in it, the room have a cement floor and I couldn't see the ceiling and the walls because I could see under the tape on my eyes. There were 3 really strong American military men and now there was total 5 people one of then hit me on my forehead, then the Kurdish start tearing my pants with underwear that I was wearing with a sharp blade and he wanted to pull my cloths out but I grabbed it, he hit me on my head and said leave it dog. I was naked and they were laughing and stepping on my body with their boots, and rubbing my skin with their boots. I didn't know what to do like I was a fest and they are the beast all of them start hitting me on my head and one of them stepping on my back and the other hold my feet and my hands and start hitting me with a stick on my feet and one of them drag me on
the cement floor and I was naked and my skin is hurting me by rubbing it on the floor and the mark from the pain still there until now. They put me in the bathroom that the cell in it. My chest was one piece of blood and the cuts on my shoulder and my legs. One of them started a motor that they use to spray the farms and the smell was very strong, they sprayed my body then they washed me with water, they left me for a while and during that time they were torturing another person, the tape on my eyes was bad because of water and my hands were free but I stayed blindfolded. One of them came and screamed at me and told me you son of bitch you want to escape and he didn't let me talk then he handcuffed me with a plastic handcuffs. He took me to another room they hanged me about on meter from the floor but the handcuffs opened and I fall on my head and one of the shock my feet with electricity. They took me to a different room the Kurdish linguist was carrying a pliers and told me to open my mouth dog he put it inside my mouth and try to pulling my teeth and he wanted to pull my teeth but he suddenly stopped I don't know why. They took me back to my cell and I stayed there for 3 days then they interrogated with me. They took me to a different prison in Tikrit called the religious school in the south and I stayed there for 17 days then I got transferred to Abu Chraib.

During the night of 27 April 04 Our ODA conducted a raid in the village of Al Winat. Our primary target was an insurgent cell leader named Illiresponsible for several IED attacks in the Tikrit AO. There b6-4, were five or six cell members in his cell who were also targeted but I do not remember their names. I did not witness any interrogations take place that night and there were no ICRC on target or in any phase of the operation. The Detainee named mowlooks familiar but I do not remember who he was or in which 106 t;_'! C

Q: What manner and method was used to apprehend these detainees?
A: Break down the door with breaching tools, cleared the structure, and we detain all male personnel on
target. During this process we don't know who is who, so we grab all males on target and then later
determine who is the target.

Q: When apprehending a Iraqi male what methods are used?
A: We clear the room, and we direct them to put their hands on their head and direct them to their knees
using hand and arm signals. Then we systematically flex-cuff them. We usually put a blind fold on their
eyes, sometimes duct tape if no blacken goggles are available.

Q: At any point tape their mouths?
A: No.
Q: At any point did you see a member of your team step on any of the detainees?
A: No.
Q: Have you ever witnessed any detainees abused?
A: No.
Q: What occurs when a detainee is non-compliant?

alleges he was detained on 27 Apr 04, by Special Forces, and was taken by the CIA to the which he stated belonged to the CIA. MAIIIIIK6-4, 06-4 related a Kurdish translator and five or six Americans hit him, and the Kurdish b6 -4, L1C-"( translator hit him in the head with a pistol. (See Statement for details)

78th MP DET (C11)), Baghdad Iraq, prior to the Detainee Abuse Task Force (CID), Bahgdad,
Iraq, receiving the case file. After reviewing the AAS entry made by SAINIMINIM. on 10.66-4,
Jul 04, at 1300, which stated he received the Final Info Report from BCCF, there was no mention

•My name is.Went they went to arrest me they asked
me about somebody and during of my torturing they accused me of
doing operations a ainst the Coalition forces. They asked me if
I knew.I was detained on the 27th of April, at/304616-'1

my house in Ewinat. It's 35 kilometers south of Tikrit. I was
detained by Special Forces; I knew this. because of the writing
in Tikrit. I made a friendship with a sergeant and 20 days
later I found out they were Special FOrces. The sergeant's name
was... He was military police. This man was at the second b6-01e-4f
place. The second place was in Tikrit. When they captured me
they took me somewhere up North, in a big hall. 31 people were

• apprehended the same day. I was at the big hall for two days
and then some people took us. The ICDC told me that the CIA
picked ma up after two days. Then they took me to the Karela
Tahlfer house. Where I stayed was one meter long, one meter
high. Three days no food no drink, very loud music, they were
hitting the ceiling so we won't sleep. I said what do you want
from me, I'll tell you anything. As soon as I got out they hit
me on my eyes and head. .A Kurd hit me and some Americans.
There were five or six. I was hit with a pistol on my head; I
can't tell who was hitting me because I was blindfolded. They
were all beating me. They shred my clothes so I was naked. I
was naked for two days. After five days of this I was
interrogated. A guy with a beardand glasses interrogated me,
he was a good man. I was tortured the first days but when the
interrogations started they treated me humanely. I was beaten
at the Karela house. I was beaten with the pistol at the Karela
houSe. I was handcuffed and put'on the ground and they kept on
beating me: I was naked all this time. The first three days I
was not beaten. It was the last two days I was beaten. I ate
cake and water. They gave me that on the first three days, no
food when they were beating me up, and they gave me cake and
water on the day they interrogating me. I was able to see
people that were more tortured than me. The Kurd was wearing a
ski mask and the Americans were not. One was tall, had a t-
shirt and pants, bald, sunglasses. The other one was a strong
