STATEMENT OF
AT 86 MP DET (CID), Bldg 108, Fort Denning, GA 31905, DATED 26 Jul 04 CONTINUED:
Q: SA Malfilig Va.
-1°1731
Ot: SSG ...111111
0 2-03- C1D4 69 -60175
Q: During what dates were you in Iraq?
A: 4 Apr 2003 through 17 March 2004.
Q: About what date did the incident in question occur?
A: It would have occurred in the morning sometime before November. I really don't remember the date. Everything that happened over there was documented in Iraq at the time of the incident and given to the First Sergeant and Commander.
Q: Who is PFC... geikt.2
A: He was one of the soldiers in the dismounted squad. I knew him pretty well. He's
had some problems. He put a lot of lives in jeopardy over there. He has a mouth that
won't stop. He won't listen.

Q: Had he ever stolen anything prior to this, incident?
A: Not that I know of. /6 ioe-
Q: Did you see PFC MIIIIIIrbreak any locks?
A: No. I didn't actually see any of the locks cut. I knew that the two doors had locks on them because I personally checked them. icb17-6'
Q: Did you or anyone else authorize PFC 1111.11.or anyone else to break the locks and
take the items behind each door?

A: No. They were told to stay away from the building and the doors. That was in the
briefing I gave them. They were put there to keep them out of the sun. That was all.
They were told that by the company commander not to steal and loot. I know when he
was talking to the company he said something about it, too.

Q: Did you order the soldiers to put the stolen items back.fromn where they were taken?
A: Yes. When I saw
out of the building, I asked the team leaders what -Swas going on, and then I went to get the platoon sergeant, SFC./.. The squad leader 7C-A -5–
j2/2, was SSG.1111.111 Once I told ...Me told SFC.I.IPThen SRAM.
saw what was happening and went and told the first sergeant. The first sergeant came
and talked to everyone and the stories all started coming out. The unit did an
investigation and then the commander sent it up higher.

Q: Where were you when this incident occurred?
A: I was about fifty meters away at the gate. I was sitting the back of the Bradley and I
saw the movement in the back of the store and nobody was supposed to be in there, so I
went to see what was going on. I said a few words and insisted they put everything back.
The only reason they were there in front of the store was because they needed to be in the
shade. We had those two team leaders involved, which is a problem. The soldiers did

what their team leader did.
Q: What was PFC team leader? 14bb 5--
A: It was either SGT/Marr SPCMIN. I can't remember which. But they ,,j,
pie!) were both there. It was SSG quad. SSG as down talking to 7(the platoon sergeant when all of this happened.
Q: In your statement you mention the acronym "BFV", what does this stand for?
A: Bradley Fighting Vehicle.
Q: Is there anything else you would like to add to this statement?
A: No.///End of Statement///

, want to make the following statement under oath:
On 12 June 03, my squad set up a patrol base on a peninsula in Iraq. We had to set up a wire gap
at the edge of our compound. There was an Iraqi store right across the street. While on 24-hour
guard duty, my team leader Sgt. lialtatbroke into the store for sodas, cigarettes, and other

miscellaneous things for the squad. I was guarding the wire gap at the time. After I was relieved
of my guard shift, I broke into the empty room beside the store. SSG. Ellaingbaught me in
the room and asked me what I was doing. I told him that I was going to use the room for shelter.
He immediately reported to the chain of command what had happened. My reason was so that
my squad would have shelter from weather and if we would have been engaged in a firefight with
the locals, we would have cover. My whole squad was involved in the incident. We all received

UCMJ actions for the incident. Me and the 2 team leaders received Field Grade Article 15's and
