CID investigation into allegations of prisoner maltreatment/abuse at Camp Cropper, Iraq. The investigation established probable cause to believe that eleven (11) members of the Military Police assigned to Camp Cropper engaged in cruelty and maltreatment of detainees, Failure to Obey an Order or Regulation and Aggravated Assault regarding the treatment of Iraqi detainees. The investigative report contains sworn statements of the Commanders and soldiers of the 443rd Military Police Company who confirm the practice of “hog tying” detainees; urinating on detainees; placing detainees under the desert sun in 115-155 degree temperatures, a punishment known as “sun punishment”; and “softening up” detainees prior to interrogations.

INVESTIGATIVE SUMMARY:
This investigation was initiated upon the receipt of a Request for Investigation (RFI) #
0211-04-CID001, received from the HQUSACIDC, Inspector General, Identifying Allegations
of Iraqi Prisoner Abuses.
Investigation established probable cause to believe
committed the offense(s) of Cruelty and
altreatment of Detainees and Failure to ey an Order or Regulation, when they violated the
Standard Operating Procedures (SOP) established by their Command regarding the treatment of
Iraqi Detainees.
Investigation also established probable cause to believe unknown soldiers committed the offense
(s) of Aggravated Assault; Cruelty and Maltreatment and Failure to Obey an Order or
Regulation, when they violated the SOP established by the Command regarding the treatment of
detainees.

The detainee victims were not able to be identified in this report of investigation.

Preliminary investigation disclosed several soldiers assigned to the 443rd Military Police (MP) Company (Co), 12100 Green spring Avenue, Owings Mills, MD 21117-1610, reported alleged abuses of Iraqi detainees by US service members assigned as guards in Iraq.

I, Marjorie Maye BAXTER.want to make the following statement under oath:

I arrived at Camp Cropper, Iraq, in June of 2003, which was the Corps
Holding Area #2 for Iraqi detainees. My job was to guard the prisoners.
At first I did external and Quick Reaction Force..

We then took over the
prison from the 115th MP Battalion because they had too many riots. .

The
115th personnpl cease to perform any guard mission in the main prison and
went to the High Value Detainees..

When we took over the CHA, our main
job was to guard the prisoners and to control their movements inside the
prison..

We would rotate where we would work as far as if we sat at a
cell or at the holding area or the sally port..

We worked 12 hr shifts
from 0400 to 1600..Most of the

The night shift worked 1600 to 0400..
prisoners that came into our prison were brought in throughout the day.
On any given day we could have received up to 300 prisoners..

The prison
was built to hold 250 prisoners..

We were a holding area and were to hold
them 72 hours only..

All the prisons were getting full and none of the
other prisons would take ours..

We would hold them until either another
prison would take them or they were to be released. .

At one point we had
over 1200 prisoner jammed into our prison:.When

It got very crowded..
working the sally port you got the first experience with the prisoners.
When the prisoners were brought to us, they were brought in by the
truckloads..

They would be shackled and usually brought in with bags on
their heads..

The first thing that happened was they went to the garage
to be interrogated..

The MI unit would ask them their questions and when
they were done with them, they would bring them to the sally port for us
to search them and put them in the holding area..

Sometimes MI would tell
us not to put them in the holding area because they were not done with
them..

If they were to sit in the sally port, they were to remain
shackled. Sometimes they were to keep the bag on their heads. One day
when working the sally port, a group of 3 prisoners came to the prison.
Their hands and feet were shackled together. After the MI had asked them
questions, 2 of the guys was allowed to go to the holding area. .

The
other guy was to remain in the sally port till he would talk to MI. .

The
first time MI brought him out he had to stand in the sun holding a
concrete cinder block..

He held it for about an hour then MI took him
again..

This time when he came out, he was cuffed with his hands behind
his back..

The MI put the block on the ground and pushed the inmates head

on the block and told him not move. The MI told us at the sally port that if the inmate moved or took his head off the block we were to rub his head across the block. A few times the prisoner moved and I would put his head on head back on the block. The MI wanted us to punish the prisoner. I told my NCOIC what was going on and he said he would take care of it. A few times the QRF would come down to the sally port and would help control the prisoner. One of the QRF soldiers would twist the handcuffs up on the prisoner's wrist to make him put is head on the block. After a few hours the MI came out and got the prisoner. The prisoner sat in the sun for a long time with no water to drink. When MI had brought him back out they had replaced the bag on his head and had tightened the bottom of it a little. We were instructed not to take the bag off his head. The inmate started to throw up and MI would not allow us to remove the bag. We took bottles of water and dumped it on the inmate's head trying to rinse out the bag. When I had gotten off shift the inmate was still sitting in the sun in the sally
port.
Q: What eventually happened to prisoner that had his head on the cinder block?
A: He was processed and placed into A Block.
Q: Did he sustain any permanent injury from that incident?
A: None that was visible to me.. .
Q: Do you recall the MI individual that instructed you to place the inmate head on the cinder block and rub it if he moved?
A: I do not know his name. We did not know any of their names they did not have theirnames displays.
Q: Who was it that rubbed the detainee face across the cinder block until it was bloody?

Q: The detainee that had the bag over his head and was made to sit in the sun was hebeing disruptive?
A: No, we were told by MI that he had bludgeoned an 82 nd Airborne Soldier to death.
Q: Did MI explain this was a tactic to get the detainee to cooperate?
A: Yes.
Q: Were any of these abuse incidents reported to your chain of command (i.e.)
Commander and First Sergeant?

A: That particular incident I do not know, I reported it to the NCOIC of the compound ,.that day.
Q: Who was that?
A: I do not recall, because it switched everyday.
Q: What incidents that you know of were re orted to our chain of command?
A: The incident involving took an inmate out of his cell at night took him to the garage and beat him. That wasreported and 11111111Xas court martialed while we were there. aIIIIIIIIIIIP
allegedly urinated on an inmate. 111.1111111111111Pworked night shift. I know nothing has happened in that matter yet. There were little stuff and the commander would relieve them from duty for a day. I do not know any specifics.

I was assigned as the. Shift NCOIC for Day Shift at Camp Cropper. My duties was to ensure that all the guards showed up on time and they were in the right uniform and provide them with their assignment for the day. Also make sure the prison operation was performed during my shift.
Q: Did you observe any abuse of Iraqi detainees during your assignment at
that location?

A: No, I did not see any detainee abuse on my shift.

Q: did others tell you about abuses of detainees?

A: Just the rumor mill, which I found later were handled by the
battalion. People lost rank and money for their actions.

give proper respect to a high-ranking officer that came into the area.

ROM THEIR PLATOON HOG-TIE A DETAINEE AND PLACE HIM IN THE SUN 115-155 DEGREE WEATHER. IIIIIIINIIFVAS THE ONE WHO INITIATED IT. ANOTHER TIME A SOLDIER TOOK A DETAE AND PLACED HIM IN THE SUN BECAUSE HE FAILED TO SIT IN THE HOLDING A A CERTAIN WAY.IIIIIIIIIIIIIIr ACED DETAINEES IN THE SUN FROM HIS COMPOUND AREA ON DIFFERENT 0 CASIONS. BECAUSE THEY FRUSTRATED HIM WHEN THEY CONTINUED TO ASK FOR WATER OR CIGARETTES. THIS WAS LIKE A COMMON PRACTICE IN THE-UNIT PLACING DETAINEES IN THE SUN BY SEVERAL SOLDIERS WHEN THEY GOT FUSTRATED. I BELIEVE THIS PRACTICE WAS INTIATED IN OUR STANDARD OPERATION PROCEDURES (SOP). AS TO WHAT TYPE OF PUNISHMENT A DETAINEE CAN RECEIVE FOR NOT COMPLYING WITH THE MP'S. SOME SOLDIERS, PLATTOON SGT/LDRS/SQD LDRS WERE TRAINED ON TAZING (STUN-GUN). AND SOME DETAINEES WERE TAZE. MININTAZED A DETAINEE BECAUSE THEY WERE FIGHTING. 1,. , WANT TO MAKE THE FOLLOWING STATEMENT UNDER OATH: I arrived in Iraq in June of 2003, and my unit was assigned to provide EPW control in Camp Cropper. During my stay inBaghdad, at Camp Cropper I noticed no incidents were prisoner abuse took place. There were instances were soldiers gottempered with detainees, but nothing that was abusive. For instance, I observed a soldier with his foot on the back of the neck of a detainee who was rolling around in the sally port. I quickly pulled the soldier to the side and asked him what was he doing? He replied " I'm keeping him still". I then explained to him that it looked like he was standing on the prisoner's neck.The soldier replied that the prisoner keeps rolling around. I replied, let him roll around because he is subdued and he can't harm anyone. That was the extent of the altercation. Later on that day the soldiers were given a use of force block ofinstructionto prevent any further miscommunications. I thought that was great on the leadership's part.

A: I believe she had passed a note between the detention cages. OMNI warned the detainee not to do it again, and thedetainee began speaking loudly back to him. It looked like and argument and the SPC was pulled and advised by the NCOICto maintain his composure. I can't recall anything more.

I am assigned to 443rd Military Police Co. I deployed with my unit to Baghdad Iraq on 14 May 2003 to 6 Dec 2003. My duties
were to guard detainees at Camp Cropper in Baghdad International Airport. While guarding detainees it was common practice to
put detainees in the sun for a period of 15 to 20 minutes for punishment. Detainees were not physically harmed during this
practice. SOP was written by my leadership that stated the punishment for all detainees.

A: No.
Q: Did you ever witness the physical abuse of detainees by US Service Members?
A: No.
Q: Do you recall 'Hog Tying' an Iraqi detainee and leaving him in the sun for an extended period of time?
A: I recall hog tying a detainee, but I can not recall what it was for. He was only in the sun for a short time, not more than 10 or
15 minutes. It was common procedure to hog tie detainees for safety and security reasons. Placing them in the sun was for
punishment.

Q: What was the condition of the detainee after you had placed him in the sun?
A: He was fine; it was only about 15 minutes.
Q: Do you recall who assisted in hog tying the detainee?
A: No.
Q: How many detainees did you hog tie and place in the sun while you were at Camp Cropper?
A: About six.
Q: Do you recall why the individual was hog tied and placed in the sun?
A: Either punishment or safety. When cage guards would bring the detainees up, they would tell us what the punishment would
be.

Q: What were the punishments outlined in the unit SOP?
A: I can recall Isolation, no cigarettes, setting them in the sun, and hog tying. There was a list of 15 things, but I can not recall all
of them.

Q: Who wasTesponsible for enforcement of the punishment?
A: I guess who ever was watching the detainee when the infraction happened.
Q: Who supervised the punishment?
A: The compound NCOIC.
Q: Did you ever witness an Iraqi detainee being forced to place his head on a cinderblock for an extended period of time?
A: Yes.
Q: What were the circumstances surrounding this incident?
A: That was done by Special Forces. I am not sure why they did that to him.
Q: What was the condition of the detainee when you saw him?
A: He was fine.
Q: Who was supervising this?
A: I guess that would still be the NCOIC

I was deployed to Iraqi to camp cropper in May 2003. Our mission was to guard the interior prison of the camp. While there I hadan incident with a prisoner were I had to restrain him while he was being punished for not following orders. I told him many timesnot to move from the spot I had him in he in turn refused to follow orders so I placed him in hand irons, he then continued to moveabout and I again told him to stop he refused again so I placed him in leg irons, he again refused to follow my orders so I "hogtied" him so he would remain in place, I let him lay there for about five reins in the "hog tied" position before returning him back to his c.ve him a bottle of water so he would not dehydrate.

I traveled from Kuwait to Baghdad, Iraq via convoy in June 2003. Upon arrival to Camp Cropper, I was assigned to become theNCOIC of the Quick Reactionary Force (QRF) for the compound. The QRF was divided up into two teams and performed duty ona 24-hour on/24-hour off basis. The mission of the QRF was to respond to incidents that took place inside the compound such as:prisoner riots, physical altercations, provide extra security, guard detainees on work details, etc. For the most part, we were neverin direct control of the detainees. We were definitely not in control of detainee punishment for infractions that occurred inside thewire. Those duties were the responsibility of the compound NCOIC/OIC. On several occasions, the QRF was called to performsecurity for the arrival of incoming detainees to the compound. This included posting armed guards at the vehicle that wasbringing the detainees in and inside the warehouse, where detainees were-held until they processed into the compound. In addition,the QRF did assign team members to assist with conducting searches of incoming detainees from time to time. There was never atime where I physically abused a prisoner. If anyone ever saw me do anything to a detainee that could be construed as abuse, thenthat was a result of a detainee resisting me while I was attempting to place them into a prone position for the requisite search tobring them into the compound. I have been a military police officer for over 11 years now and a Federal police office for over fiveyears. At no time have I ever abused a subject for any reason. I may have forced someone to the ground because they wereresisting, but I did not scrape a detainee's head across a brick. A few weeks prior to our (443rd MP Co) departure from Baghdad, Iwas relieved from my duties as the QRF NCOIC so I could assume duties as the assistant movement NCO to pack up and move theunit home.

I was on QRF and worked in 24hour shifts, so one ni.t I sto.ed by the sallyma Wee what was going on. That is when I was told about an alleged drug ring .di with the detainees..broughtlitTrffie detainees into the sally port and instructed him to stand with his ayesparallel to the ground and not to move. After a sometime, the detainee's arms began to drop, and .dinifilibed him by the hair and told him not to drop his arms again. A few minutes later, the detainees arms dropped again, angrabbed the detainee in what appeared to be the crotch and chest area, and forced him to the ground. While on the ground, itlooked like he grabbed the detainee by the hair and punched him in the face, and told him not to do it again. About that time,another MP Company had puled up, and were watching what was going on. A male soldier then asked if he could come in and ge t some of that..responded to the solider that if he wanted to come into the sally port, he could not bring a weapon.At this time in realized this was wrong and left the sally port. I gave a statement to my commander, and the matter was laterinvestigated by the unit. I do not know what had happened to the individuals who were involved.

In the month of June, 2004, our unit arrived in Baghdad, Iraq. Our mission there was to operate the inside of a prison camp. Wewere stationed at Camp Cropper, near the Baghdad International Airport. Our unit was there unit the month of November, 2004.I was in 3rd Platoon and our platoon work the night shift. Sometime in the month of July, 2004, I was working at the sally port ofprison. Around 3am a SEAL team had brought in 3 prisoners. The 3 prisoners were being brow t to us because they wereshooting at Americans, possibly killing Americans. After the SEAL team left it was myself, .andiemilll were left watching over the prisoners. I stated to MOM I have to go to the bathroom, and urinate. .replied saying "Whydon't you piss on the prisoners. I then began urinatinaS urinated beside the prisoners. Since it was dark outer askedme then if I did it and I said yes. The next morning .and I were talking about it and I told him that I didn't do it. He askedme why I said yes the night before, I told him I don't know. I didn't feel comfortable telling him that I said yes just to receive theglory. The reason why I did it for the glory was to be look at as a badass. Ever since our unit deployment at Ft Sam Houston,Texas from October 2002 to October 2003, I've been made fun of for basically not hanging out with my fellow soldiers.

A: I initially thought about urinating on them, but when started to urinate, I thought about the moral issues, and changed my mind.

A: Yes, I did. When the three were brought in by the seal team, they had urinated on themselves. They were sitting on the concertdriveway, which leads to the warehouse. To absorb the urine, I threw a shovel full of sand against the detainee's thighs. I did notdo this out of anger, but the urine needed to be cleaned up.

A: No, because I worked nights.

A: No, I tried to treat everyone equal.
Q: Were detainees ever denied basic needs such as water?
A: No. Once and a while, they would come out to get water. We would tell them no talking, and if the talked they were sent toback to the compound for about ten minutes. After that they were brought back outside for water.
Q: Other than what you stated above, did you ever witness any detainees being treated in a manner you deemed inhumane?
A: No.
Q: Were Tazers present at Camp Cropper?
A: No.

A: No, because I was not certified to use them.

want to provide the following statement, under oath: I was mobilrzed Feb 10 with the 229 MP CO. I was
then involuntarily transferred to the 229 1 Chemical Company out of Roanoke, VA. The unit went to Fort Lee, VA to go through the
mobilization train-up in Feb 03. Sometime in May persons were asked to go to Iraq with the 443r d MP Company, a reserve unit out of
Owings Mills, MD. I volunteered and later flew to Kuwait. I did not know any of the soldiers within the unit. We were in Kuwait for
about three weeks and then moved into Iraq by convoy in Jun. Once we arrived, the unit quickly assumed the duties at Camp Cropper
which was a general population prison. I was there as the NBC NCO, as I am a 74D, which is a Chemical Specialist. Since there was
no real mission for me, I was asked to be the NCO of the night or evening mission to in-process incoming prisoners and I agreed. I
don't recall the date this actually occurred, I think it was in July. I was on shift with at least four other individuals, in addition to or
11111.11110 Unfortunately he caught a lot of flack for not being real masculine. Some of the guys gave him a hard time for this. I
knew this was something he would not normally do. I can't remember if the Navy Seals brought these guys in or what. There were two
Iraqi detainee's. They were picked up in a scheduled raid and were brought in with Flexi-cuffs on their arms and ankles. They were
wearing only their underwear and hoods on their heads. One of the MP's cut the flexi-cuffs from their ankles. 411111111Mpushed
one of the detainees against the other. I imagine from fear, the prisoner urinated on himself and on the boots ofd11111/11/110.
NM became angry. .11/11111111011 then, for some reason, came over and urinated on one of the detainees. 11111111111110 was just standing there. It was completely out of character for .to do this Afterward , I don't remember which personbrought a flashlight over but it was shown on the detainee and it was clear that he was wet will,. 11¦40 urine. At that pointwe all just, it was one of those things you just...you know. 111111111111111111 came to me a few days later, crying. 4111110100 was an investigating officer and did speak with me about the matter. I told him exactly what happened. Anyway, .

A: That would be difficult to provide three scenarios. Basically they had to be really screwing up. Most of the guards would keep
close monitorship of what you could and could not do to a detainee. I know that prisoners had three opportunities to follow
instructions but I don't know that they would be hog tied or anything like that.

Q: Did you ever see or hear of a prisoner being hog tied?

A: I saw a prisoner being hog tied. It wasn't for very long, maybe 5 —10 minutes. I don't know what he did to deserve that. I couldn't
tell you who did the tying either.

Q: Describe the process of being brought into the "Sally Port"?

A: It was like a staging area. When prisoners initially come into the compound, they are searched there and depending on how busy
we are they could be there a while. This is a separate area that was cordoned off until they could be moved inside a tent area. They are
given water as there was no shade in this area. It wasn't established for persons to be there for extended periods.

Q: Did you ever witness. ndcuff a female detainee and place her in the sun for hours?

A: I would not know. I did not work with hum as he worked the day shift.

Q: Well did you hear anyone comment about .his actions with a female prisoner or anything else with him while there?
A: Honestly, I c t recall.
Q: Do you feel.encouraged.to urinate on the detainee?
A: Yes.
Q: Were you instructed by Military Intelligence soldiers to make things harder for the detainees? What MI Unit was present?
A: They didn't tell us to make things hard, but there were specific individuals that came in that, depending on who they were or what they came in for. For instance two brothers came in for attacking coalition forces. Those two were made to stand in the Sally Port for extended periods. This was requested by 011111111111.11 he headed the MI Unit there. I dealt with him most of the time. I think the MI Unit was the 325 th but I do not recall. I do know they were mixed reserve and active together. Our Commander, aIIIIINIMp did step in and say that the MP guards would no longer participate with handling requests from the MI.
Q: Were you briefed on the Standard Operating Procedures and Policies concerning the treatment of detainees?
A: The unit I was with actually wrote the SOP. All of had the opportunity to read it and yes, I did read it.
Q: Was your chain of command approachable about reporting abuse?
A: This is just my opinion, but I felt IMMININI. wanted a good OER. If he could keep things in the unit and from getting out, he
would have taken necessary steps to do so. I felt that .gave more credit and weight to what his MP's told him than
what I did.

Q: Do you feel you could have gone to .on other issues outside of matters referring to prisoner abuse?

A: No.

Q: Do you have any idea what the detainee to guard ratio was during your time there?

A: Probably twenty guards per shift and the number of detainees ranged from 300 to 1,200.

Q: Do you feel there were guards there with character traits not conducive to this type of a career field?

A: There were those who probably had no business being MP's. A recall a.who I felt had some control issues.
No specific incidents but just my overall observations about him. He made some poor judgment calls. He did attempt to send a lower
receiver of a Turkish weapon through the mail. It was found and a few of his soldiers were arrested.

Q: In your statement, you mentioned you knew "this was something .would normally not do" what did you mean by
that?

A: I meant pee on a person.

A: No, he knew what he was doing. It was three o'clock in the morning. There was light from a warehouse and there was visibility but
not real clear.

A: Because allee made it clear he did not want to be there or that he cared for the Iraqi prisoners.

A: I will agree that 11¦11111111111111 did it for the glory and that he would be looked at as such a feminine guy. It was clear to
everyone that aIIIIIIIIII1urinated ON the detainee and not next to him as stated in the RFA. It was 41111111111111111111111intent to
urinate on the guy before he approached him. His initial comment was "I should piss on him" or words to that effect. Everyone in the
unit was clear on the treatment of detainees who did not comply with orders, including .There were TAZER's at
Camp Cropper and 41111.11/10 had direct knowledge of this. They were used from time to time.

Basis for Investigation: On 16 Aug 04, this office received CAT 1 Request For Assistance
(RFA) 0066-04-CED342-64142, from the Carlisle Barracks Resident Agency (RA), Washington
District (OD), USACIDC, 116 Fordes Ave, Suite 11, Carlisle, PA 17013. The RFA requested
this office coordinate with the Military Intelligence (MI) Unit, currently located at the Camp
Cropper Detainment Facility, Baghdad, Iraq, and determine the MI unit that was stationed at
Camp Cropper, between May 03 and Dec 03. The RFA also requested this office obtain, if
available, a unit roster and the location where the MI unit re-deployed back to, when they
departed Iraq.
About 1600, 19 Aug 04, SAMIrcoordinated with SA.

rovided documentation detailing three MI units that were at Camp Cropper, between May 03 and Dec 03. The units identified as being at Camp Cropper between the aforementioned dates were the 323dMI BN, 221 st MI BN, and the 325 th MI BN. (See MI Unit Documentation for details)
About 1617, 19 Aug 04, SA irnconducted internet searches for the aforementioned MI units utilizing AKO and Google, in an attempt to identify where each unit's home station was located. The searches revealed the 323d MI BN was stationed at Fort Meade, MD; the 221 st MI BN was stationed in Atlanta, GA; and the 325 th was stationed somewhere in New York State (was unable
to identify the exact location of the 325 th)
About 1830, 19 Aug 04, sAisecoordinated with Deputy Director of Joint Interrogations and Debriefing Center, A Co, 202 nd MI BN1, BaghdadCentral Confinement Facility, Baghdad, Iraq, who related during the time frame in question the
205 th MI BDE was the main MI unit in Iraq. .related he did not know exactlywhere the 205 th MI BDE home station was.

Q. What is your current unit?
A. I am assigned to 301 st MP Co, 65 th Reserve Support Command (RSC), Fort
Buchanan, PR 00934.

Q. How long have you been assigned at that unit?
A. I have been assigned to that unit since November 2001.
Q. What is your current position at that unit?
A. I was promoted while the unit was deployed so I am currently a regular team member.
Q. Were you deployed to Iraq?
A. Yes I was. I was deployed with the 443 td MP Company from May 2003 through
December 2003. We were there for six months only.

Q. Were you involved with detainee operations in Iraq?
A. Yes, I was involved in detainee operations while deployed to Iraq.
Q. Were you assigned to the Baghdad Correctional Confinement Detention Facility?
A. Yes, I was assigned to the High Profile Area for the first two weeks of June 2003,
then I was assigned to the Corps Holding Area from July 2003 through October 2003,
when they closed the facility. The facility was located at the Baghdad International

Airport.
Q. Do you know
A. Yes, I know him. I first met illingon February 2003, but there no interaction with him during that time and while the unit was deployed. While we were deployed we would see each other because the jail was not big, but there was really no interaction with him. He was assigned to a different squad over there. I really got to met .on February 2004 when we arrived from the deployment and he was working with us in a daily basis.
Q. Do you remember requesting assistance to MUM to remove a female prisoner from her cell, during the deployment?
A. I really never worked with females while I was there. There was a female tent over there and I was assigned only one time to that tent while I was there. On the day I was assigned to that tent I got sick and I had to leave because the doctor sent me to quarters. My sinuses were really bad. The only time I worked with females at the detention facility was during searches when they first came into the facility or when they were leaving the facility. Also, on one occasion I transported females to a nearby female and juvenile detention facility. I do not remember asking 111111111Pfor any assistance removing females from their cells. Further, the female population on that detention facility was very low. The most females we had at a time were ten. This was due to them being transported to the nearby female and juvenile detention facility.
Q. During your deployment to Iraq, did you witness any acts of abuse towards anydetainees?
A. I never witnessed any acts of abuse towards detainees by anyone while I was deployed to Iraq. I did not witness any acts of abuse committed by OM while we were deployed.

A. No, I do not. I honestly doubt something like even happened. Again, leadership was always present there so somebody would have notice that.
Q. Did you witness any members of your unit taking photographs of detainees in
humiliating positions?

A. I do not remember or witnessed anything like that. Again everybody knew from the
beginning that it was against the Geneva Convention so I don't think anyone engaged in that type of conduct.
Q. Do you remember if .
as alone with any females while working at thejail?
A. No. The controls were very strict over there. Males were not allowed to be alone with females. Besides you would have to be crazy to go to a tent by yourself without being armed. Detainees were very abusive at times over there. Juveniles were the most abusive detainees of all. Detainee also liked to fight with each other, so we kept control of the situation at all times. There were also riots when we arrived at that facility.
Q. Do you remember if immowas suspected of detainee abuse at any time while you were assigned to 443' MP Company?
A. No, I do not.
Q. Do you remember any incidents that would be misunderstood as abuse or assault towards a detainee by anyone?
A. No, I do not. We didn't mistreat anybody, the rules were very strict. The leadership was constantly checking the operations. It was mandatory to provide them with cigarettes, water, food, showers, shoes, jump suits for the prisoners that did not have any clothes, blankets, medical treatment, females and juveniles had cots and never sleep on the floor while there, etc. If somebody was sick with any condition, even a headache, they had a right to medical treatment. If someone was sick, two MPs would go fet their food and provide it to them. Details by detainee were on a voluntary basis. Each cell had their latrine, which was emptied out every day. I honestly can not remember any acts that could be misunderstood. We took pride in what we did and I feel proud f our unit. Leadership; I think that was the most important factor, our leaders were there constantly supervising the operations. I think also that the fact that there were rumors about the company that was prior to us there mistreating detainees. Our leaders ensured that no-thing wrong happened over there and further I think took all necessary measures to prevent this type of incident.
0. What type of training did you receive to handle detainees?
A. We were at Fort Lee for about two and half months before we deployed and received constant training over there. We took courses on Geneva Convention over there, searches, etc. We even had a "mock up" prison facility there to train us in the daily operations of the jail. We were briefed on all the rules concerning the treatment of detainee, having common sense when dealing with detainees, safety, etc. We even simulated every aspect of our training with other MP companies. I feel very confident that the training was very good and sufficient to perform our duties with detainees.

i I am assigned to the 443rd Military Police Company. I deployed with unit to Baghdad Iraq on 14 May 2003. I arrived at Camp Cropper on 6 June 03. My duties were working at the internment facility as a pnsOn guard. While guarding detainees it was common practice to put them in the sun for a period of 15 to 20 minutes for disobeying an order from a guard, or creating a disturbance within the compound with other detainees. The detainees were never physically harmed during this practice.

ned to the 443rd Military Police Company, I have been in 21 years as a Military Policeman I was deployed to Operation Iraqi Freedom, my arrival into Baghdad was 5 June 2003 until about 17 November 2003. I was assigned to Camp Cropper, Baghdad International Airport (BIAP), Iraq. My dutiy was 3rd Platoon Sergeant, basically I worked as a duty officer in the CHA, Corp Holding Area. The duty officer oversaw the CHA, and acted as the "gopher" for all squad leaders working in the CHA. I did not work in the Interment facility directly, but we would over see the head counts, processing and updated theprisoner roster.

Q: Was there any written SOP or just standard practice when you arrived?
A: There were Memorandums in place, but no SOP's in place. There were rules of engagements, but as we set up, we began to write SOP's. The SOP's were written by the chain of command. We had input from squad leaders as they were the one's doingthe day to day dealing with prisoners.
Q: What was the rule of placing detainees in the sun passed down from your supervisors?
A: The only reason they were placed in the sun, was to segregate them from other prisoners. You could not avoid the sun. Anytime they were out of the compound was in the sun. The main compound was built for 250 - 300 Prisoners, but it routinely went over 800. The highest we had at one time was 1,200 prisoners. We had people there, the longest was about 6 months.
Q: How long would you say this practice went on, while you were there?
A:
Camp Cropper would transfer prisoners to Tall Aribase or Camp Bucca. When our prison would get over crowded wewould transfer them out.

How did the practice from a Supervisory standpoint place detainees in the sun start?

A.
It was in place when we arrived. At that time the 115th Military Police Battalion was in charge of the facility.

Q: What made it stop?
A: There actually were several things happening to make it stop. My squad leaders would tell us that they were told to do place detainees in the sun and do other things by Military Intelligence and we ran those instructions up the chain, because we did not feel they were right. Our job was prisoner control and we did not train on some of the things that were being asked by MI.
Q: Did you discontinue the practice after that?
A: Yes, I did. Almost immediately MI started telling us the detainees were ours do with them what we wanted and this was as
because they knew we would not do some of the things they were asking.
Q: Was there always water available to detainees that were placed in the sun?
A: Yes, but some of the detainees would say that there was never enough water when they wanted it.
Q: With that form of punishment no longer used, what did you start using to maintain control of the detainees?
A: We would still use segregation and sit them down at our holding area.
Q: Can you explain the Taser gun use on detainees?
A: Every time the Taser gun was fired there was a report that had to be completed. The Gun had information that was downloaded to a computer showing how many times it was fired. To my knowledge the Taser gun was only used 3 times when I was on shift. The Gun would only be used by squad leaders who were trained and certified in their use and only to break upfights.
Q: Was any detainee ever harmed from being placed in the sun by anyone to your knowledge?
A: No.
Q: Can you tell me about the practice of "Hog Tying" a detainee in the sun?
A: The only time they would that is when the detainee was unruly and would not cooperate.
Q: Any soldier ever came to you reported any abuse of a detainee, saying that an MP was bein abusive?
A: There were no abuse in my platoon. There were two Article 15's given out, one was .who was arm wrestling a

I Only remember one time, and that was started by MI after two soldiers were killed in downtown Baghdad and they were trying to get the location of the bodies.That was when we started getting complaints from the soldiers, if they should be doing that kind of procedure. We started questioning and passing it up to the 115th MP Battalion, because we did not feel it was right.

I arrived at Camp Cropper, Iraq at the beginning of Jun 03. My initial job was with the
QIiick Reaction Force, and then I began working as a guard. on the day shift.

Q: Did you ever witness a detainee being abused?
A: I did not.
Q: Can you explain when you would "Hog Tie" a detainee?
A: It would have to be a serious offense, such as attacking a military police or another inmate.
Q: Do you recall witnessing.handcuffing a female and placing her in the sun for several hours?
A: I cannot recall that incident.

I was deployed to Iraq from about May 2003 until about December 2003. I worked at Camp Cropper, Baghdad InternationalAirport, Baghdad, IZ. This was a detainee holding area, a place as a central holding area for the Baghdad Area. Any criminalwas brought to us and held for about 72 hours, however the way things were backed up there, some stayed for a while. I cannotrecall the Military Intelligence unit that was emplaced at Camp Cropper. I was assigned to 3rd Platoon, 2nd squad, B team. Wehad rotating shifts. In the beginning I worked QRF due to man power shortage. I also worked in the "Sally port", this is theentrance to the holding area. When prisoners came in, they were first taken into the warehouse area, then screened by MI. Thisprocess took as long, determined on how many prisoners they had at this time. Sometimes 5 or 20 Prsioners would come in. The prisoners were brow ht in by various MP, Infantry and Special Forces.

Q. Did you witness al=11.11.111. abuse any detainees, specifically when he attemtped to cuff a female detainee and placeher in the sun?
A. I do not recall that. But, I would not think an attempt would be abuse.
Q. Did you witness any other detainee abuse?
A. I did not think I saw anything that was unlawful. Meaning, if a detainee got out of line or had to be punished. Sometimes the.would be placed out in the sun. We were required to always to give them water. Only 15 minutes was about the time frame theywould be placed in the sun. I did not care for the set up of the camp as it was unclean. I do not recall witnessing anything that dinot seem right. I am not aware this was in the SOP.
Q. Were there SOP's in place?
A. Yes there were. We were briefed on them and probably did read them, but I cannot recall the details of the SOP's at this time.At this point it all runs together.
Q. If a soldier acted inproperly or abusive to a detainee what procedures were followed to report the incident?
A. I never came across any issues that pertain to that. If I did then would notifiy the chain of command.
Q. What type of scenario would a detainee be punished for?
A. Fighting. Not fighting guards, but each other. I recall an incident when the prisoners were throwing trash and had to beseparated. I feel we had a ood company. For the most part what I saw, it was drilled down our throats on War crimes.
Q. Do you know who
A. I do not know a .there was a , white male, 5'6", that would be the closest name I canthink of. I did not work with him,.as in 2nd Platoon.

Q. Why would. alleged ou witnessed abuse a detainee?
A. I honestly do not belivee would make that up, but I do not recall anything like that occuring. .I worked mainly days, I cannot recall ever working nights. I think it was 2nd Platoon that worked nights.
Q. Can you explain "hog tying'?
A. To me, "hog tying "would be arms behind the back and feet. I never did this, I never felt the need to. This would be done fo.the purpose of a detainee fighting as a controlling purpose, or if they were going to lash out at somebody. Maybe for throwing
rocks, in order to cease them from hurting someone.
Q. Was placing a detainee in the sun a normal practice?
A. Yes. It was a temporary punishment. On the average, when my unit first arrived there were over 1,000 prisoners. There
were about 22 to 25 soldiers during the day shift watching theses prisoners. That is not including the tower guards, they were a
different unit. When we first arrived the 115th MP Battalion was the unit we were taking over for and they did a train-up for us.
The first couple of weeks I was doing the QRF duty.

A. No I did not. The TAZERS were operated by the Shift NCOIC.

A. Yes. Spread legs and arms out. This was for a TERRY FRISK search. We searched them twice. At the Sally Port they werfrisked and pockets turned out, shoes checked in the holding area. A more thorough search. They would sit in holding. Theywould have to go to medical to get checked. Then forwarded to their cell.

A. Yes.

Police in general. I mainly worked the night shift from 1800 until 0600
or 2200 until 0600, it depended on manpower. I never witnessed any

I was charge assaulting a prisoner by hitting him in the testicles,
keeping him wake all night. I do not know who reported the incident and
I deny it ever happened. I never abused anyone. I hogtied one prisoner
who attempted to bite or fight a fellow soldier. The prisoner I believe
was on some illicit drug. I assisted tying him up, and he kept dragging
himself even when he was all tied up.

Name 3 reasons why a prisoner was tied up?

For our safety, some tried running through the barbwire, for their
safety. I only hog-tied one detainee while in the holding area. All
prisoners were treated well. They got food, water, 6 cigarettes a day
and carpets in their tents.

A. They were all separate incidents. 41111111urinated on a detainee.

suspected of bringing drugs into the compound. I was working a night
shift and we had a snitch in the cage and that person told us who had
drugs. I do not remember the detainee. We did find pills in the urinal
area of the compound cage.

or hog tied?

A. I do not remember if he was. But if hp did get up we probably flexi
cuffed him.

mid-Mid Month November 2003. I as a military policeman was assigned as a
prisoner guard. I worked the day shift.

Q: Can you tell me about an incident where there were prisoners throwing
rocks at juveniles and you had to intervene?

A: I was not there when that incident occurred. I heard about the
incident, but I cannot recall being there.

Q: Can you tell me about an incident where you were talking with AIIIIIIIP
about hitting a detainee?

A: I do not know anything about that. I never talked to.about
anything like that. I only knew him from the Dining Facility. He was
assigned to the 115th MP BI, and we never discussed those type of issues
with them.

Q: Did you ever have to hit a detainee for any reason?

A: No, I was not that kind of person or MP with them. The only thing I
ever had to do was put a detainee on the ground, who refused to comply to
our instructions.

Q: Did you ever witness.urinate on a detainee?

A: No I did not. I heard about it.

Q: What are three reasons you have to restrain a detainee?

A: (1) Not complying with our orders after repeated requests to do so;

(2) If they are causing harm to themselves or another prisoner (I recall
having to do that on one of my shifts);(3) If they had to be medically
treated and would not cooperate.

A: No, I have never seen that. They would throw food at them and the
juveniles would throw food back.

A; I heard that.allowed another soldier from the 82nd Airborne

I, want to make the following statement under oath:

I arrived at Camp Cropper, Baghdad, Iraq, mid May 2003. I was assigned
as the Military Police Shift Supervisor. I worked the night shift
primarily. I left Camp Cropper early Nov 2003.

Q: There is an allegation that you allowed an 82 nd Airborne soldier into
an area of the Sally Port on the Night shift to abuse a detainee, is that
true?

A: No, it was not an 82nd Airborne soldier, it was another MP, who's unit
was dropping prisoners. I let this soldier in that was pulling security
on his detainees that they were dropping off. While they were dropping
of the detainees I had to gb-up front with another soldier, as the NCOIC
I had to make sure the paperwork was correct and completed. While I was
verifying the paperwork the other soldiers down in the compound told that
they were oing to check on dru s in the com ound and I told them go
ahead..and.or.brought up a
detainee and they began to search him up front. .had to go

back down to the compound, so the soldier that was guarding the detainees
asked if he could help. I asked him if he was an MP and he Said yes. I
told him that you know the rules arm bars and pressure points are the
only thing to be used. He said "Roger that Sergeant". The soldier went
over and assisted/1m~ I continued verifying the paperwork with
the other soldier. I would not have allowed a soldier to abuse a
detainee and we were also under the watch of the tower guards, who would
report anything that they thought was abuse. I believe the unit that ran
the towers was the 186th Military Police Company.

Q: When.was searching the detainee was he abusing the
detainee by con ucting an improper search or hitting the detainee in the
testicles?

A: firmigirwas conducting a proper search, but he may have been
conducting the search with a little too much pressure, but I was not
there holding the detainee up either. The detainee was falling all over

while he was conducting the search.

Q: Wha time of day was it when the search was being conducted by

A: It was rate night early morning.

Q: Where wat the soldier that volinVolaillikaa d what was he doing during the search of the detainee?
A: He stood behind he detainee holding his arms up and he was also holding the detainee behind the neck or holding his hair.
Q: What was the soldiers name or unit?
A: I do not recall his name, but he was with a unit out of California. They were Military Police and had armbands. I do not know if they all had armbands.
Q: To your knowledge was there any abuse that took place during that incident?
A: I would not say any abuse took place.
Q: Did an 82nd Airborne soldier come to you in the prison and asked to get at a detainee, who had recently killed a 82 nd airbornesoldier?
A: There was an incident where 82 nd airborne soldiers dropped off some detainees that had just killed some of their guys and they were pretty fired up, but it had nothing to do with the guy I let into the compound. I never let an 82 nd airborne soldier hi to beat up or abuse a detainee. nnd airborne soldier do go into the compound, but I believe they were logistics or intelligence.
Q: Did you witness.allillrurinato on a de.?
A: No, I did not, I was off that evening. I heard that had put
u to urinate on a detainee. I do not know it happens or not. I over heard say she saw it ha en.
Q: o you have any knowledge of placing a detainee in the sun for hours as a disciplinary measure?
A: I do not knoW anything about that. He was in another platoon. It was common practice to separate detainees and that was either in the tent or out in the sun.
Q: 00 you know which military intelligence unit was working Camp Cropper When you were there?
A: No, I do not know, they did not wear any nametags.
Q: Were your chain of command aware of the practices and some of the abuses that was on going?
A: Yes, because sometime they would dictate certain procedures on prisoner treatment. I do not believe they provided enough command oversight-and really did not come down to the area, as they should. There was no AAR or NCODP to review and determine what was working and what needed improving.
Q: Did you ever report any detainee abuse to your chain of command that was not addressed by them appropriately?
A: I said to my chain of command that we need to have SOP's and access rosters. The SOP was eventually put together and we never got an access roster. I never saw anything that was out of control that required re ortin to the chain of command.
Q: Did you observe at anytime . Itingi, kicking or grabbing the testicles of the detainee he was searching for drugs?
A: I recall seeing his hands going up into the detainee groin are but he was not grabbing the detainee's testicles. The soldier that was assisting . the detainee collar are which could from a distance look like he was holding the detainee's
