This CID investigation concerns an investigation in to detainee abuse in Afghanistan. A New York Times newspaper was releasing a story on 12 May 04, concerning allegations of a Afghan Police Colonel that was alleged to be abused by U.S. Forces in Garcjez, Afghanistan, in Aug 03. The investigation found that several of the detainees at Gardez, Afghanistan gave statements that they were not abused while in custody and one statement describing how the alleged victim was abused and one statement from the alleged victim himself. The investigation established that the offenses of Indecent Assault, Aggravated Assault, and Maltreatment of Persons in US Custody, did not occur as alleged by the soldier(s) named as the abusers, nor was there any evidence to find that abuse occurred at all.

there were allegations of abuse by Coalition Forces against an Afghanistan Police Colonel who
was held in Gardez, Afghanistan for 22 days in Aug 2003.

As he admitted himself he 16- tf, trtc -* studied with Mojahedin Police force in Pakistan. We do not have any kind of document from him in our record. Because there were some report against him with the American forces in Gardez. On July 13 th 2003 we transferred him from Gardez security office to the American base, on 2/6/1382 (August 24 th 2003) after two month and twenty days he has been released. As per his request and according to the law of Afghanistan Interim Government we accept him back to the olice force and up to present he is working as a reserve. More important when Said Ureleased from Jail of allied forces he never £ -4-. 191C-4
verbally or in writing reported to me or the office regarding how he been interrogated and how inhumane treated him, how he been tortured. He never complained to me that what happened to him. I heard about his complaint from world radio stations. This was my statement.

office and I had my police uniform on and I have been called by commander of Security,

11111.1to his office, I saw that there was several people from coalition forces 14 -`F- (0.-tc•4 were seatin at the commander office. The commander called several police officers like d others on. He wrote our names and hand it to the coalition W.4, 12 1c-4
orces and the commander of security told them that allNllcnows more than every other. Coalition forces took me with them and hand me to the director of detection of • national army and then they moved me to the tent belonging to the national army. At this time the director of detection by using threatening words took my inhaler medicine, which I needed for my asthma. After a few hours of waiting on the national army tent, which located inside the base I have been moved by an American interrogator to a different room and they shut the door close. At 4:00 PM the same American interrogator came in with a translator. The erson in charge of interrogation asked me about Jihad leaders like 1111111andUd others, I gave him the answer. After spending several nights in that room, the room got flooded and I was drowning. Then a person from national army got me out of the water and moved me to the main street and there was one more prisoner in that room that they took us to the national army tent and then by the American they put us back to the same room which was flooded after several hours because we were very ill they moved us from this room and they put us inside a vehicle body. In the night they moved us to national army tent but after a few days the, American moved us by ridding the motorcycle to another location for interrogation. During the interrogation my eyes were blindfolded and my hands were cuffed but from noises 11.1 knew that there were 3 or 4 Americans and one linguist that they were • interrogating me. By using bad words they put me doWn and with laughter they were asking me that with what kind of animal I had sex. At the same time all of them that were involved in the interrogation they sounded like animals and put their fingers in my ass and were laughing. And then they said that my family has become prostitutes and they are begging. They also said that there is a snake crawling all over my body and asked me if I can feel it. They told me that they are going to send me to Fidel Castro. During the interrogation they were not letting me sleep. They made me stand on my knees by cuffing me to a piece of wood that was connected to a belt. Then they would beat me clown with their feet and put their feet to my neck. I was not allowed to see or talk. They were telling me no to say Allah, Allah (God God). After twenty or twenty two days which there several other prisoners from this province they transported all of us with an aircraft to Kandahar, inside the aircraft threw us on top of each other and we were really hungry and thirsty. In Kandahar without giving us food or water they cuff and chained every one of us to a chair; then they made us kicked and started beating us and called us names. I could hear camera sounds, we were blindfolded. After beating us by feet and taking pictures they put us inside a wooden cage. We were not allowed to look or talk. They did not give us enough food. They would bring bucket full of rocks and would hit us with rocks all night from four sides. They also were throwing bottles full of water at us. They would bring dogs around the cage and treated us. They put some of the prisoners on pill of dirt and throw water on them until morning.

Americans were laughing at us. They threw more rocks at me because I was very ill, and
they were threatening me. Approximately after twelve days they moved me to Bagram
airport. In Bagram they took me to the second floor. They made me necked and asked
me where is this place, I told them that I Ili not know. They told me this is America and
do I accept American law. I said yes. They told me to make sure I obey the solders.
Look around and get necked at this time I got fully necked and they inserted something in
my ass and I was not allowed to see it They took my fingerprints, then after shaving my
head and gave me red color clothes they put me inside of 13 people cage. Furthermore
the people in charge of interrogation in Bagram and Kandahar as they treated me well but
in Paktia they treated me inhumane. Up to now my police hut, which I paid 80 RPS for
it, my ID card and some other personal property they kept. Because of all beatings by
feet, sleep deprivation, standing on one foot, seating on my knees and keeping both hands
up and heavy wood to my hand, I developed mentally and physically conditions. I have
nightmares, the linguists in Paktia they treated me very bad. One of them had a red

jacket and had regular height and they had mask in their faces because I was blind folded
I could not see anymore. Because of personal problem and wrong reports I was arrested

and my family suffered.
My request is to identify those people and bring them to justice, and I should get paid
restitution. Furthermore in Bagram they gave me a holly Quran but there was no water to
Wodu (wash myself before pray)

Our office requested information from him regarding how he been treated or tortured. He insisted that they warn me, threaten me that I should never to nobody talk about how I have been treated or tortured. Because of my trust to the Human Rights office I can only verbally explain it to you that what happened to me, It was during the regular work hours when they picked me up from my job. For a period of 22 — 26 days every nights they were interrogated me and they tortured me and they put their finger to my Ass, call me bad names and using very bad names like wife became a prostitute, your daughter became a prostitute and they are bagging everywhere and this kind of words. They would not let me sleep and they were making noise like animal's and they were saying that with which one of those animals you had six with. After they transported me to Kandahar they put me in a Cage, necked and they were throwing rocks toward me and they released Dogs on me. They had a mechanical thing and shove that into my Ass. It was a very bad condition and inhumane and against human rights and all accepted rules and laws in the

world. Once I got in Bagram the conditions changed. In contrary to Gardez and Kandahar it was very humane.

Oh-2/14/1382 (July 13th 2003) which I had my police uniform on, they turn me over to the American forces. After a long interrogation and torture in Paktia, Kandahar and Bagram I acquitted therefore I brought my case to your office to do your own • investigation and for fmancial and physical damage that me and my family suffered during my detention we should be compensated. Those people who wrongfully reported me must be found and should be punished by roll of law. Further more once I released by the American some unknown people they took over my land and removed my sons and my brothers. Government officials found out about this and arrested them. The case is under investigation.

SFC MINOWdetailed the typical process for a detainee being brought to the
PUC Facility. SFC 11111,related the detainee is escorted to the in-
rocessing station, which is located in the rear of the. facility. The
detainee is told to stand'in a marked area in the middle of the in- •

rocessing room. The room during this process usually has numerous MP's,
a Criminal Intelligence Task Force (CITF) and Military Intelligence
representatiVe, an interpreter and medical personnel. The detainee is
then asked a series of biOgraphical questions and is told the rules of the
facility and in ptocessing procedures. The'detainee is. instructed to
disrobe, the items he. has on his person are documented and photographs are
taken-of the detaihee to document their. condition and any'injuries. The

edical perSonnelchecks over the detainee, which includes a PPD test and
rectal exam, and thet he is provided clothing. The detainee has his
fingerprints and mugshotS taken and he is escorted to the showers and

ave to have his head shaved. The detainee is then interviewed by MI

ersonnel. The detainee is placed under watch for 24 hours and is placed
in the respective holding area. Outing the stay at the-Itt facility the
detainee is seen by medical personnel for a PPD reading and any other

roblems -they may have. At MP escorts the detainee to—the medical
screening area and stays with them the whole time.

Once the detainee has been approved for release from the detainee review
oard, Medical personnel again see them to be out-processed. SFC.

CRIME SCENE RE-VERIFICATION: About 1200, 12 May 04, SA IIIMIllitonducted a crime scene re-
verification of the Gardez Detention Facility, Gardez Firebase, APO AE 09354.
Characteristics of the Scene: The detention facility was approximately 44 feet long, seven (7) feet wide, and six
(6) feet in height. The floor and ceiling was wood type construction. The walls were made of Hesco barrier's and filled with dirt. Mounted in the ceiling were two fluorescent light fixtures. There was very limited light illumination from the two light fixtures in the inter cell. The outer room was illuminates with direct sunlight. The Entrance/Exit (E/E) to the outer and inner entrance to the cell consisted of a black in color metal type construction door, which were secured by padlocks. The outer room of the facility contained one metal chair, one makeshift desk, and one metal type construction wood-burning stove. The cell contained five padded mats, which were used for sleeping, one metal type construction wood-burning stove, two metal cans, two water buckets, and a box of bread, which was located outside of the inner cell. The inner cell door was secured upon examination and an Afghan National Any guard was posted in the outer room of the cell. Behind the south wall of the cell was a wood building, which was used as a latrine for the detainees.
Conditions of the Scene: The floor of the cell was littered with dirt and trash. There were numerous insects on the floor and ceiling of the inner cell. There was a significant amount of ash around the stove area.
Environmental Conditions: At the time of the crime scene re-verification the interior temperature was approximately 75 degrees Fahrenheit and the exterior temperature was approximately 90 degrees Fahrenheit.

Characteristics of the Scene: The building contained a wood type construction frame, which was covered with
dried mud and brick. The floor of the building was constructed of cement and covered with a cloth material.
The building contained two interview rooms, one in the southeast corner of the building and one located in the
northeast corner of the building. The interview room located hi northeast corner of the building contained an
Entrance/Exit, which led to a small room where a guard was posted. The small room consisted of one chair,
one small desk, and two Windows. The interview room consisted of shelveS, which were mounted on three of
the walls. There was one table, one chair, and one wood-burning stove in the room. There were numerous
cables throughout the guard area of the northeast interview room. There was a light fixture which was mounted
in the ceiling and two windows mounted into the wall. The second interview room., which was located in the
southeast corner of the building, had one E/E, which led into the main interview room. The room contained
counters and shelves on three walls and two tables. There was one light fixture, which was mounted in the
ceiling. At the time of the examination both interview rooms were unsecured.

ConditionS of the Scene: The interview rooms were dusty, stained, and contained numerous amounts of debris
and trash.

Environmental Conditions: At the time of the crime scene re-verification the interior temperature was ­approximately 75 degrees Fahrenheit and the exterior temperature was approximately 90 degrees Fahrenheit.

Scene Documentation: SAIIIIIIIIIxposed digital photographs of the crime scene re-verification utilizing a

BASIS FOR INVESTIGATION: On 7 Jul 04, this office received a Request for
Assistance from the Bagram CID Office, Bagram Airfield, Afghanistan, requesting this
office conduct canvass interviews of soldiers assigned to the 327th MP BN, Arlington
Heights, IL.
b7r--/ (eUl About 0930, 12 Jul 04, SAIIIIIIIIordinated with SFC' , 327th MP Bn, Arlington, IL, who related there were about 113 soldiers assigned to the unit; however, not all had access to the detainees. Further, they would all be attending drill on 21 -22 Aug 04. SFC MIIIIII-urther advised there were other soldiers assigned to t 805th MP Co, which had been under operational control to the 327th MP Bn for duty, and worked with detainees at the detention facility.

CANVASS INTERVIEWS: Between 0730 and 1130, 21 Aug 04, SAIIIIIand
tlis/tice conducted canvass interviews of soldiers assigned to the 327th MP BN, who were assigned to the Bagram Detention Facility (BAF), Bagram Army Airfield, Afghanistan between Jun 03 through Apr 04. All of the soldiers canvassed could not provide any incidents of reported or observed abuse of detainees (see canvass interview worksheets for details).

327th MP Bn, Arlington Heights, IL, who related she was the commander of the unit while they were deployed to the BAF, Bagram Army Airfield, AF. CPT stated the only incident she was aware of pertaining to Abuse of a detainee involved a soldier attached to them. The soldiers name was SPC Home Address:' I). CPT stated this soldier was laterally trans erre to t em om a Re onal Reserve Center from Tennessee (See DIEDS print out for details). CPT related SPC was securing a detainee during in-processing, and an inspection team believed that he rolled the detainee harder then necessary and SPC was counseled in writing. The letter of reprimand was locally imposed and destroyed upon their return from AF, and did not follow the soldier back to his unit in TN. CPT aim stated the incident occurred in either Oct or SEP 03.

as the soldier was justified in his actions; however the inspecting team (NFI) insisted on the action. CPT aillarstated this was the reason the letter was locally imposed, and was destroyed upon the soldiers transfer. CPT stated the detainee was not in juried and after an assertion on the part of SPC he detainee did not struggle. CPT tated there were numerous personnel that observed this incident and on y one o t e inspecting members complained.
STATUS: This is a final report. No further investigative activity is anticipated by this office.
