POLICY AND TRAINING WAY-AHEAD

PURPOSE
To provide the DAS a proposed way-ahead to develop policies that govern how the Army/units/Soldiers handle detainees from point of capture to conviction or release, to include a review of common task training and specialized MP training across the Army.
ARMY REQUIREMENTS
• DODD 2310.1 (AUG '94)

Designates the SA as Executive Agent for DoD for the administration of the DoD EPOW Detainee Program


Services shall comply with the principles, spirit, and intent of the international law of war and trained reference their obligations under the Geneva Conventions


Persons captured shall normally be handed over for safeguarding to

U.S. Army Military Police


Detainees may be interviewed for intelligence collection purposes at facilities and installations operated by Military Police

AR 190-8 (OCT '97)

Provides clear policy relative to the treatment of EPW, Civilian Internee (CI) and Retained Personnel (RP) in U.S. custody


Does not well address synchronization of detention and interrogation programs and procedures.
