Administrative reprimand in accordance with investigation which found a Captain guilty of "unprofessional behavior" towards detainees and his "attempts to coerce and intimidate members of [his] unit in order to sidetrack the investigation into these actions" stemming from the abuse of detainees at Ramadi Palace, Iraq – July 11-12, 2003. This document is part of an investigation in to an incident related to ACLU RDI 1136 through 1171.

SUBJECT: Administrative Reprimand
MEMORANDUM FOR Armored Cavalry Regiment, Ramdi,
1.
Between 9 July and 16 July 2003, you undertook a series of actions that included offensive treatment and unnecessary force against Iraqi detainees. This inappropriate treatment included both physical and verbal actions taken towards detainees who were already secured and in some cases already in a detention facility. On another occasion, you and other members of your unit forcefully interrogated an Iraqi national, forced him to dig a mock grave, and threatened to kill him if he did not provide you information about violence against coalition forces. You were witnessed holding a pistol to the head of one detainee and threatening to kill him. As a Commissioned Officer in the United States Army, you have displayed a serious lack of judgment and leadership in your actions. Your behavior has been detrimental to the Regiment's mission in rebuilding this country through our efforts lkorking with the Iraqi people. You have also abused the human rights of these people whom, we are tasked to protect. Finally, your behavior shows a clear lack of discipline and leadership skills and seriously hampers the credibility of the Officer Corps.

You are hereby reprimanded for your unprofessional behavior towards these detainees and for your attempts to coerce and intimidate members of your unit in order to sidetrack the investigation into these actions. You have put in question your authority and integrity and that of the Officer Corps. Your conduct raises serious concerns about your professionalism, judgment, integrity and leadership skills.

This is an administrative reprimand imposed under the provisions of AR 600-37, and is not punishment under Article 15, UCIvIJ. You have the opportunity to submit matters in extenuation or mitigation on your behalf. After reviewing the matters you subMit, if any I will decide whether to file this reprimand in your unit file or recommend that a general officer file it in your Official Military Personnel File (OMPF). You may seek legal assistance from the Rifles Base Legal Assistance Office or from civilian counsel at no expense to the Government.

You will acknowledge this memorandum by signing and dating the enclosed acknowledgment of receipt endorsement. Any matters you wish to submit for my consideration must be submitted, through your chain of Command, to the Regimental S-1 within 10 calendar days of the date you receive this memorandum. If I do not receive a response from you within the 10-day period, I will assume that you have no matters to submit and will make my filing determination.
